Gary Michelson sued someone, won, defendant went bankrupt. Gary appeals the bankruptcy! And loses.

Gary Michelson sued his ex-partner/landlord for fraud. Fraud, theft, cheating is a common theme in Gary's life. In this case he was ripped off because he wasn't paying attention to the books. A woman warned him that he was being ripped off, Gary confronted his landlord/partner and the landlord said the woman is a liar and he fired her. After a little while Gary takes a look at the books and realized he was being ripped off. Gary Michelson is a poor judge of character. He does not know whom to trust or distrust. He gets himself in these messes all by himself. 

Gary wins the lawsuit against his ex partner/landlord. That causes the partner/landlord to go bankrupt. Gary has caused this man to go bankrupt yet Gary is not satisfied. He appeals the guy's bankruptcy! Gary Michelson wasted money appealing someone else's bankruptcy. You can't get blood out of a turnip. Why waste money doing that? Because Gary is consumed by vengeance. He needs his pound of flesh. He doesn't just want to win. He wants to destroy these people's lives. That's the same thing he's trying to do to Richard and Neil. In their case it's even worse because there was no crime, no fraud, no theft, no loss.

This is a quote by Gary Michelson which he gave to Forbes magazine in an interview,

"Vengeance is gnawing on a leg and looking down and realizing it’s your own. –Gary Michelson." 

I'm amazed Gary Michelson has any legs left. With all his nasty vengeance you would have thought he'd already gnawed off his legs and arms. He doesn't seem to learn. There is no way these false complaints, meritless lawsuits can possibly be worth the grief. He already has plenty of money. He can't get money out of these lawsuits. He only wants vengeance. He needs to have Warren Buffet manage his money so he can focus on other things. Gary is a horrible money manager. He doesn't bother to research anything.

Ton of hits on the post which proves Richard is innocent and Dr. Gary Michelson is a lying evil billionaire

This is the post getting a ton of hits, linked below. Please, retweet, repost, share this post. I hope the underlying documents are admitted into evidence. It would save the court a lot of time to read this. This is the case. There is no case for fraud. No crime was committed. The DA in Costa Rica stated in final summary "In like manner this prosecutorial agency dismisses entirely the existence of the crime of fraud, since the objective elements that constitute this type of crime as such were not proven; deception by the accused was not proven; no proof is provided to calculate financial damages."

The only crime committed was by Gary Michelson. It is a crime to file a false criminal report against someone. The DA needs to go after Dr Gary Michelson for perjury, fraud upon the court and filing a false criminal complaint. This is not the first time Dr Gary Michelson has done this. He tried to file a false criminal report against his ex-director. The LAPD specifically said "Gary Michelson" is "crazy," a "flake," "no crime was committed," "there was no embezzlement." Even after the LAPD told Gary there was no crime, we will not go after the ex-director Gary still told everyone that LAPD would arrest the ex-director "any day." That never happened.

Many class action medical malpractice spine product lawsuits filed against Dr Gary Michelson

There are now a ton of class action lawsuits against Dr. Gary Michelson for malpractice and design flaw in his Medtronic spinal cage. Talk about karma. You steal someone else's invention, run and patent it, make the money then get sued for design flaw. Not only that but Gary made everyone put labels on all his products that said "Michelson technology in action." On top of this Gary sued anyone that used his product with another product. In some cases they inserted his cage then inserted bone growing tissue into the cage instead of a  bone graft. Michelson demanded part of that money. That of course makes him liable.

I don't feel bad for Gary but I do I feel really bad for these patients. They all have the same back problem as me in the exact same location. Thank god I swore I'd never use one of Gary Michelson's products or this could have been me.

In the last nine months many class action lawsuits have been filed in Los Angeles County alone for malpractice against Gary Michelson and Medtronic. They are being transferred to Federal court in LA due to diversity of parties. Here is but one. This is only the basic lawsuit. The rest is 287 pages available on Pacer.

If you read the lawsuit you'll see it mentions Medtronic doctor/advisors who push Medtronic products on patients. Few days ago I posted about the UCLA whistle blower who got $10M because he said doctors were pushing Medtronic products on back surgery patients after being compensated by Medtronic. UCLA claimed no patient was harmed by this but that doesn't seem to be true now. Why else would they settle right before trial. They knew they would lose which makes them instantly liable in these new class action lawsuits. The whistle blower Dr. Robert Pedowitz was represented by lawyers Mark Quigley, Ivan Puchalt, and Christian Nickerson with the Santa Monica, CA law firm of Greene Broillet & Wheeler, LLP. The above lawsuit is just one of seven I see filed recently in LA alone. Each lawsuit has many, many plaintiffs.

It appears that Medtronic was paying doctors to recommend their products to their patients. Some of these products were used off label and were known to have many risks and side effects. The doctors did not disclose this to their patients. The patients used the products and now their backs are in worse shape. This is the world Gary Michelson chose to live. This is the result of Gary Michelson's patent trolling, invention stealing and lawsuits. This is where Gary Michelson gets his money, from lying to and screwing over people with injured backs. I don't think this is what Gary's grandmother had in mind when she supposedly said "one day you will fix this (her bad back) for me." His granny must be spinning in her grave. Of course Gary is probably just lying again. In his high school year book he said he wanted to be a lawyer. Well, he is involved in law, just as a serial litigant.

Law360, Los Angeles (April 17, 2014, 8:48 PM ET) -- A Los Angeles surgeon suingProskauer Rose LLP for more than $20 million for allegedly advising him to sink large sums of money into illegal tax shelters urged a California judge on Thursday to reconsider his dismissal order, saying legal opinion letters from Proskauer are admissible evidence against the firm.
During a hearing of plaintiff Gary Michelson's motion for reconsideration, Dale Kinsella ofKinsella Weitzman Iser Kump & Aldisert LLP, representing Michelson, told Los Angeles Superior Court Judge Mark Mooney that his tentative ruling that Michelson didn't have enough evidence for his malpractice claims should be overturned.

Kinsella said that if eight opinion letters sent by Proskauer, which allegedly induced Michaelson to invest in illegal tax shelters, were sent directly to Michaelson, and not his longtime advisers Jeffer Mangels Butler & Mitchell LLP, they are admissible as evidence. Kinsella said that on a motion for summary judgment, the evidence at least shows a factual dispute over whether that is the case.

“Why has Proskauer remained silent for years about evidence in their own records that would settle whether these letters were sent directly to Dr. Michelson or to the Century City office of Jeffer Mangels?” he said.

Michelson, a spinal surgeon and medical device inventor, had sued Proskauer Rose in Los Angeles Superior Court for malpractice over eight opinion letters the firm had issued in 2001. The letters said two Ernst & Young LLP tax reduction vehicles should hold up to Internal Revenue Service scrutiny, causing Michelson to lose tens of millions of dollars when the IRS disallowed the deductions generated by those investment, according to the surgeon's complaint.

Michelson's complaint says that in 2001, he was approached by Ernst & Young about investing in two “generic tax products,” that would lower his tax liability. Michelson invested $121 million in these tax products.

As part of his investment, Michelson paid $150,000 to Proskauer for independent opinion letters stating these transactions “should” survive IRS scrutiny and provide their anticipated tax benefits.

The surgeon contends that at the time Proskauer sent him the opinion letters, the IRS already had made clear that tax products like those Michelson was investing in were considered “abusive” and potentially illegal tax shelters, according to the complaint.

The IRS assessed roughly $48 million in additional tax liability for 2001 and 2002 on Michelson's investments in the tax products, and after he entered into a closing agreement the IRS in 2007, Michelson sued Proskauer for at least $20 million in damages on claims of malpractice and breach of fiduciary duty.

Proskauer had argued in a July motion for summary judgment that the opinion letters were not admissible, and that without them, Michelson's case had no legs. It also claimed that Michelson had never spoken with any representative at Proskauer before making his investments.

In October 2013, Judge Mooney tentatively granted the motion for summary judgment, but in January he said he would hear Michelson's motion for reconsideration, saying that although it was too late for Michelson to waive his attorney-client privilege or introduce new evidence, he would re-evaluate the existing evidence before granting Proskauer's motion for summary judgment.

On Thursday, Paul Spagnoletti of Davis Polk & Wardwell LLP, representing Proskauer, told Judge Mooney that even if Proskauer had sent some letters directly to Michelson's house, that fact wasn't enough to over come the doctor's own testimony that the information he relied upon when making the tax investments came from his attorneys at Jeffer Mangels.

“Even if Proskauer Rose sent something to Dr. Michelson's house it doesn't matter, because that's not what he read and what he relied upon,” he said. “Dr. Michelson said that what he read, what he relied upon, was sent through Jeffer Mangels.”

Judge Mooney took the arguments under submission and said he would issue a formal written opinion on the matter.

Proskauer stated no one from Proskauer spoke to Gary ever. More Gary lies about these opinion letters? I noticed Gary sued a lawyer for malpractice who went bankrupt. Maybe that's the one who gave him the advice? Gary's involved in a lot more lawsuits mainly for his spinal products being defective. I bet he's "happy" that he forced Medtronic to put his name all over those products now ;-) Sorry but Gary Michelson is his own worst enemy. You want money, fame, attention, okay but that'll come with a lot of bad press, lawsuits and stress. I bet Gary thought he could get away with tax evasion.  I think the Judge is just trying to appear overly fair by reconsidering the dismissal and writing an opinion. I look forward to reading the opinion. Based on Gary's history of filing suits with no merit, I think he'll lose this suit. He filed a ridiculous suit against a real estate person for overpaying for property. He created his own loss by buying the property in foreclosure. Judge ruled against him.

I just realized that if Gary Michelson had funded his non-profits and awarded his prize he wouldn't have needed the tax breaks. Here Gary rants that everyone is cheating him when it's really Gary cheating himself...  and the IRS.

I just read this from one of those articles. Serial litigant Gary Michelson is going to lose this case.

"In a demurrer filed in April, Proskauer asserted that it issued the opinion letters long after Michelson completed the transactions, and says that the letters only stated that if Michelson contested an adverse IRS determination, a reviewing court should uphold his position.

“Each letter cautions that ‘there can be no guarantee that following an audit, the [IRS] will not take a position contrary to the opinion set forth herein, which ultimately may be sustained by the courts,’” the demurrer said.

Proskauer claimed that when the IRS did make an adverse determination, Michelson chose not to litigate. Instead, Michelson settled with the government and went after Proskauer, the firm said."

Gary Michelson has now sued many people for "cheating" him and he lost most of the cases. (1) He sued a real estate person for appraising a property for more than what it ultimately sold for. He lost, appealed and lost again. He created his own loss in that situation. (2) He sued Proskauer for cheating him on tax free investments and will soon lose again. (3) He claimed Loftus cheated  him and stole. Loftus sued him and won for defamation. (4) He claimed Richard cheated him in Costa Rica yet the DA said there was no crime, no evidence of any crime. Something is obviously very wrong with Gary Michelson.

There has been an increase in hits on this blog last couple of days. As usual the people viewing this blog are mainly from US, Ukraine, Costa Rica. The main traffic comes from Google search results, Cravendesires.blogspot.com and this blog bookmarked. People are searching for "mary cummins richard powers april 22," "neil david campbell arrest," "dr gary michelson," "mary cummins gary michelson," "mary cummins aim gilbreath," "ab 2343 found animals."

The main file they are looking at is the transcript which proves Richard Powers did not commit a crime. The transcript also shows that Gary Michelson committed perjury. Gary Michelson perjured himself in my case as well. Since then he has continued to defame me by telling anyone who will listen totally false things about me. Anyone who really knows Gary knows he's just lying. Unfortunately people who don't know him well believe him.

When I worked for Gary he used to make up these huge totally false stories about people such as Loftus, his ex-wife, celebrities. He once said that Kim Basinger invited him over for dinner. I highly doubt that. If you read articles about him he tells reporters these totally made up stories about his "lobster claw" hands, palming a bowling ball, his mommy favored her eldest son, mommy didn't love him... These are stories to garner sympathy or attention. "Look how amazing I am! Look how poorly my mommy treated me!" His mother is actually a very nice person who raised three great sons who are doctors. Gary is very different than his three brothers.

When I worked for Gary he would offer to donate money to a cause then never donate. The people would ask me where the donation was. I'd ask Gary and he would say "I never promised to donate to them" when he clearly did. I always took written notes for this reason. I don't know if he's intentionally lying or has a mental illness of some type and just forgets. The big lies he said about Loftus were intentional. He knew Loftus never stole a penny yet he still tried to file false criminal charges against him. Thank god LAPD refused and told everyone Gary is crazy and a liar. Even after LAPD told him there was no crime, they would not file a report against Loftus Gary still told people LAPD was going to arrest Loftus any day. That is really pathological lying.

Gary Michelson would also promise to go in one direction such as spay neuter as a means to control pet over population. The next day he would change direction 180 degrees and promise to buy microchips and kiosks as a means to control pet over population. The next day he just wants to give shelter dogs bed. The next day he wants to open stores to sell cats and dogs. The next day ...

I videotaped Gary Michelson at a meeting with at least 50 people in attendance. He promised to do massive spay and neuter. That was the focus of Found Animals Foundation. Days later he says he's going to do chips and kiosks. Kathleen Riordan asked me "didn't he say two days ago he was going to do spay and neuter?" I said "yes, I have it on film." Then Gary would say "I never said that." I have it on film yet he denied it. That's mental illness.

Odd recent interest in two posts in this blog which I wrote yesterday April 22, 2014. The first is the main post which proves there was no crime and Gary Michelson is a liar. The second is the post where I talk about people attending the pre-trial. I will be there just as I was during the previous hearings quietly and politely taking notes in the back of the room. These are public hearings. The media is very interested and will be there taking their own notes. I will be posting about the trial here.

Here are the posts again. This proves there was no crime. The DA of Costa Rica already fully investigated this case and said there was no crime. What is wrong with the DA of Los Angeles, California? And why are they even investigating a case from Costa Rica?

I just checked Neil's inmate info. The hearing is postponed until June 2! That means Neil would have been in jail for a full year with no pre-trial with no bail! They're not supposed to keep you in there for more than six months without a pre-trial with no bail and that is for murderers. This is supposed white collar crime. What's a zillion times worse is the fact that there was no crime. No money was lost. No one stole a penny. There was no contract about 6%. Gary Michelson lied about all of that. Even though the DA in Costa Rica found out and Gary admitted there was no contract, Gary still said that in the civil case here in California. The only reason Gary won was because the defendants could not afford to reply.

I will try to find out why this was postponed yet again. Neil is not doing well in jail. He does indeed look like one of Gary's boyfriend's. That type of person won't be doing well in jail if you know what I mean.
