Jewish Journal, B’nai B’rith write glowing article about Gary Michelson's made up history

The Jewish Journal and B'nai B'rith wrote a glowing article about Gary Michelson's made up life and history. It was actually written December 2015. They just republished it. I believe they are writing this glowing article to hopefully get donations and money. They even asked him why he doesn't donate to Jewish causes. He told them he doesn't because that's thinking small and he never asks people what their religion is. I believe they are republishing it because Gary Michelson and his PR team donated some money. Gary has been trying to post lots of news since March 31, 2016. I believe he's doing it to hopefully drown out the articles coming out about his evil, vindictive false criminal complaint against an ex-friend. USC articles are also being reposted. Looks like a calculated PR push.

For the entire time that I knew Gary Michelson he never once said anything about being Jewish or celebrating Jewish holidays. Here in Beverly Hills, Brentwood, most are Jewish so one would not feel odd about telling people they are Jewish.

What's even more surprising is that Alya Michelson goes to a church in Santa Monica, Palisades area. Gary or Alya announced the birth of their kids in the church newsletter. With Jewish people the religion of the mother determines the religion of the child. Gary obviously does not care that his kids are being raised Christians. I personally don't care about any religion at all. It's just odd that the Jewish Journal would pick up this story as it's not really about Judaism at all.

If you read the article you will see Gary Michelson and his made up story about his grandmother. It keeps changing so drastically every time. Gary gets more brazen with his stories as time goes by. I guess he feels confident that people have been sucking up his stories. He always plays the poor little boy that no one love. In this version of the story his parents were always at war. In the last version his mother ignored him. Kids at school beat him up. His only friend was his dog. That's the only part of the story that I believe.

In the original telling of the grandma on fire story she merely puts her hand on a hot stove. Over time she puts her hand over the flames. Grandma just burns her hand one time. Another time Grandma is on fire and Gary has to put her out. Even if his grandma couldn't feel heat in her hands, why would she put her hands on a hot stove or in the flames? Was she also blind and senile? This story is as ridiculous as the story that Gary has one less patent than Ben Franklin. Ben Franklin has no patents as he didn't believe in patents. He said we should share the inventions to help society. That's obviously not how Gary feels about things.

What happened to Robert Knowles the Deputy DA from the Gary Michelson case?

He's still listed in the California Bar Association directory as working at the LA County District Attorney office. The only mention of him in their website now is from this press release about the Gary Michelson case. Previously they omitted this result from searches.

Notice they were each charged with 140 counts of fraud. They were found guilty of only one county of fraud which I believe is in a misdemeanor amount. This press release and all this work when they knew these two people were innocent.

I don't think Robert Knowles is working as a prosecutor anymore. I think he may have a desk job somewhere in the DA office. In 2013 he was listed as a Deputy District Attorney IV. The last bit of news I see for him is this case.

Dr Gary Michelson's contractor commits perjury and other crimes on behalf of Gary Michelson

The web dude Dr Gary Michelson hired to try to get photos and blogs removed has failed yet again. Not only did he fail but he committed crimes while doing so. He committed perjury and fraud. This web dude has a horrible history. The only thing he's ever managed to get off the Internet are songs made by professionals. He's not been able to get anything else removed. He filed a few lawsuits but lost every single one. Most of the times they were just dismissed. He's not even in the US. He generally loses them due to lack of jurisdiction.

Gary Michelson duped again by someone who is ripping him off. How much did Gary Michelson pay the web dude to send 200+ emails to different blog hosts? This web dude lied and said he had a contract with Gary and Alya to protect his copyrighted photos. He never produced it. Web dude lied and said Gary and Alya owned the photos in question. No, they didn't. Almost all were taken by others and owned by others. Not only that but I can post photos, bits of video for comment under the fair use act of copyright. The blog hosts have sent me emails stating they aren't removing any photos because they are used under the fair use of copyright.

Only one photo from one host was deleted and it was a mistake. It's not a photo of Gary or anything Gary owns. It's a photo I took of a Chrysler Prowler in front of a friend's garage. It's not even Gary's photo or car! His ex-wife owned a Prowler, not Gary. Gary had never even seen the Prowler in the photo. I don't even know what color Gary's Prowler was. Gary pays people to commit perjury and crimes. It is a crime to file a false copyright claim. The photo in question will return within ten days. The photo is above. It was not removed from this blog but another.

I wanted to report the DA Robert Knowles for knowingly lying to the court, for giving the court fraudulent documents, for lying about the Defendants and for allowing Gary Michelson to perjure himself on the stand. I thought, why should I waste the effort when the Bar won't do anything.

This article is very telling. There most certainly was prosecutorial misconduct in this case. In the same case in Costa Rica Powers was found innocent of any and all charges. The same case here after the DAs received a bit of money from the supposed victim and now they're guilty of one charge. They are not guilty of anything except stupidly doing business with a crazy, vindictive, controlling person named Dr Gary Michelson.

Notice they state the Judges realize the evidence, witnesss...are bad but they don't care. They go along with it. Judge Craig Richman most certainly was going along with the DA's shitty case. There is a 39 minute video here which show the Judges and lawyers in this case. The Judge said "it is so fundamentally unfair." Finally Judges admitting to the improper behavior of Judges and DA's in the lower courts. I sat there and witnessed it in trial. I believe Judge Craig Richman knew the defendants were innocent. He just knew that Gary, DAs, would be upset if he didn't at least have them found guilty on one charge. I guess we should be lucky Judge Craig Richman didn't cave all the way and improperly find them guilty on all charges. Still, we have a corrupt judicial system in the United States. You can buy the DA thereby buying the Judges in Los Angeles. Judge Craig Richman needs to get re-elected. He can't rock the boat. He used to work in the DA's office, He has to go along with the misconduct and fraud.

Politics of the judicial system - Gary Michelson, Forbes billionaire, patent, spine

After sitting here for the past week mulling over the sentencing hearing I think I'm finally getting my head around it. Perhaps all is not what it seems. I am thankful that Neil and Richard are out of jail and will never be going back to jail. Previously they were looking at life in prison based on all the charges and related charges that could up the time. Gary Michelson is of course extremely upset that he couldn't throw them in prison for life even after paying off the DA. While I still feel the Judge did not rule properly on sentencing I think I understand why.

Our judicial system here in Los Angeles is corrupt. There is no doubt about that. I worked for the City of Los Angeles. I saw it first hand. I saw employees lie, cheat, steal, commit perjury, fraud....The fact that the DA hired a real estate appraiser to appraiser an easily $10 million home for a measly $3.5 million is factual proof. To see the DA get up there and try to argue that the $3.5M appraisal was accurate was truly pathetic. Robert Knowles is a smart man. There's no way he believed his argument or that appraisal. He was intentionally lying to the court. He was committing fraud upon the court by giving the judge a fraudulent appraisal. Fortunately Judge Rene Korn realized this and ruled that the property was more likely worth $10 million. Richard was then allowed out on bond.

Here in LA and in most cities and countries a wealthy person will give money to a politician. The wealthy person wants a favor from the politician. In this case Gary Michelson gave money to DAs Steve Cooley and Jackie Lacey. I believe Gary also gave Cooley money in the form of "consulting fees." In exchange the DAs used their influence to charge Gary's ex-friends with a non-existent crime. Gary intentionally went to the DA because the last time he tried to file a fraudulent criminal report with the LAPD he was denied.

The DAs used their influence to falsely charge Neil and Richard with crimes. They instructed their Deputy DAs Robert Knowles and his partner to pursue the case. They instructed their detectives to investigate. They allowed them to use vast sums of money to fly LA DAs to Costa Rica. They also used city and county funds to bring "witnesses" from CR to LA. I may do an info act request to find out just how much money was wasted in this fraudulent investigation.

The DA used their powers along with the state attorney general and federal government to arrest and extradite Neil and Richard from Idaho and Texas respectively. The DA threw them in LA County jail one of the worst in the nation. The DA dragged their feet in the investigation to intentionally keep them in jail in horrible conditions. Perhaps they hoped they'd cop a plea, lie about each other, break them down. Or perhaps they were just following Gary's instructions to torment, punish, abuse them as much as possible.

The DA finally present their case at the preliminary hearing. Almost all of the charges are dropped due to statute of limitations, lack of evidence. The charges are whittled down from I think 140 to five. At the end of the trial defendants were only found guilty of one charge. It makes no sense as that one charge was barred by statute of limitations. I personally believe that one of the jurors was a plant. He was very different than the other jurors. The second I saw him I knew he'd be the lead juror and he was. None of the other jurors cared at all. I saw three of them sleeping at the same time.

Finally the case is at the sentencing phase. Jonathan Michaels did a wonderful job with this case. He argued that the one charge should be reduced from a felony to a misdemeanor and dismissed. Based on case precedent and law it should have been dismissed. Richard and Neil would have been exonerated. That is what should have happened. Instead Judge Craig Richman made some very questionable and appealable decisions. He refused to rule on restitution. He refused to reduce the charge or dismiss it. He stated paraphrased "I've been wrong in the past. I invite you to appeal the decision."

I believe Judge Craig Richman did not want to rule because his job, livelihood would have been in jeopardy. He probably would have been demoted, transferred to traffic court in a horrible area miles from his home. I've seen this happen many times in Animal Services. I think he previously must have done something to piss off the city attorney. That battery case should have never been filed against him. When someone hit me LAPD said they'd only file charges if I had broken bones or profuse bleeding which caused me to go to the emergency room. The LAPD detective told me "it's legal to hit someone."

The DA filed a frivolous criminal case against Neil and Richard as a personal favor to Gary Michelson in exchange for money. Deputy DA Robert Knowles was forced to put forth a shamble of a case just to appease the DA so he also doesn't get a bad assignment. In the end Judge Craig Richman did not rule according to evidence, case precedent or the law. The case will be appealed and reversed by three appellate judges. Hopefully by then enough time would have passed so Gary Michelson will not want to continue to destroy Neil and Richard. If Judge Craig Richman had dismissed the one charge Gary would have been irate and would have continued to destroy them, DA, Judge. There would have been heaps of negative media and other attention on the DA's office. As it is the civil case is still open and perhaps a criminal case in Costa Rica. Gary has taken absolutely everything from these two people. They are penniless, homeless, jobless. Knowing Gary he will soon find someone else who is "profoundly cheating" him and he will try to destroy that person. He's been doing this his entire adult life. Who will be his next victim? David Cohen?

DA's sentencing motion. Gary Michelson, Forbes, billionaire, spine, patent, Los Angeles

I have located the motion that was filed by the D.A. late last Friday before the sentencing was heard on the following Monday the 15th. What's interesting here is the D.A. makes several mistakes here in his filing. First he talks about Prop. 46 which has nothing to do with the issue here. He must have meant Prop. 47. Then at the bottom he refers to count 47 where he must have meant count 46, as count 46 was referred to as count #3 for the Jurors. He refers to Prop. 46 as relating to theft of Guns, Fowls and Avocados. Again he meant Prop. 47. Here is the motion.

On page 2 line 9 and 10 Knowles even admits to the facts here. By lines 11 and 12 he makes assumptions that the Jury must have meant to charge $759K as the theft. You can't do that, not even the Judge would make that assumption as neither a theft or for restitution. By line 25-28 Knowles requests the high prison term of 3 years because the amount he believes was stolen to be over $100K.

On Page 3 line 13, Knowles says, "the court must make an order regarding restitution" The Judge would not.

Line 14-19 the D.A. makes all this stuff up even to the point that he believes that he can guess what the Jurors must have meant to award an new arbitrary number of $375K and by line 20 he once again makes the statement, "therefore that is the amount the people recommend to the court as restitution in this case". The Judge did not and would not, therefore he must have ruled it a misdemeanor and dismissed the case due to the statue of limitations of petty theft of 1 year. As such he made several "Reversal Errors" here. This should be an easy appeal for the Judges in the Appellate Court. A first year law student wouldn't have gotten it so wrong.

Judge Richman doesn't get demoted to Traffic Court in Inglewood, the D.A. and the Judge don't get sued by Michelson and everybody is happy, except the defendants who made Gary Millions of dollars despite his continued statements of being cheated out of millions of dollars. Look up Love vs People again. He can't do that, it's case law.

Judge Craig Richman should have reduced charge to misdemeanor then dismissed it

This next bit confirms my thoughts about the improper ruling by Judge Craig Richman. It really boggles my mind that the Judge should have reduced it to a misdemeanor then dismissed it based on case law but he chose not to. He had this case to back his decision but decided on his own not to rule. He will now force Neil and Richard to live out three or four years of appeal hell. They can't get a job, Richard can't leave the state... And all for what? So Judge Craig Richman can continue being a judge with the support of the DA. He doesn't want to piss anyone off so he doesn't have to deal with the City Attorney allowing another crazy person to file assault charges against him. I would like to note in that case Judge Craig Richman was not 100% innocent it turns out. The crazy lady threw a bag of dog shit in his car. He then as per his own statement pushed her. He also lied and told her he was a police officer. That is a crime in and of itself. Then she pushed him. During that case he had to step down from the bench during the investigation and trial. Below is an almost identical case to the Powers/Campbell case in which the defendants were convicted of felony charges but the Jurors made no restitution or findings in the amount over $400 so the Appellate Court ruled them misdemeanors from felonies. This is now "CASE LAW." Jonathan Michaels argued this case after lunch with the Judge saying, "lets forget about prop. 47 for a minute and look at this CASE LAW which makes published findings that you must reduce the count to a misdemeanor as the findings are identical to our case".

Judge Richman basically said, "that's a very good argument Mr. Michaels but I'm sticking with my earlier decision to NOT RULE, I may be wrong and I've been wrong before and you may be right and I invite you to appeal, and I expect you will, however I am letting the Jurors decision on one count of Felony Grand Theft to stand and I will not rule on a presumption of knowing what the Jurors decision would have been as far as restitution."

Jonathan then argued that is exactly the point and said, "Upon the failure of the jury to so determine, the degree of the crime with no stated restitution amount then it shall be deemed to be of the lesser degree, a misdemeanor by the court.”

Since 2008 the amount of petty theft misdemeanor has been raised to $950 from the previous $400. Still the Judge did not even find a restitution in the amount of over the misdemeanor threshold.

A jury convicted defendant Sumaria Love of 15 counts of various identity theft-based offenses arising from abuse of her position of trust as a dental receptionist.

On appeal, defendant makes four claims: (1) her conviction in count eight of fraudulently using an access (credit) card was only an attempted offense; (2) the prohibition upon dual convictions for theft and receipt of the same property bars her from being convicted both of fraudulent use of an access card in count twelve and receiving stolen property in count fifteen; (3) her felony convictions in counts four, eight, twelve and thirteen must be reduced to misdemeanors because the jury never determined the amount taken; and (4) the trial court's imposition of an upper-term sentence violated her rights to a jury trial and due process under the Fourteenth and Sixth Amendments.

The published portion of this opinion encompasses defendant's first three claims and we agree with the latter two of them. Accordingly, we strike defendant's conviction in count fifteen and remand the convictions in counts four, eight, twelve and thirteen for re-sentencing as misdemeanors. We disagree with defendant's first claim. In the unpublished portion of this opinion, we reject defendant's fourth claim.

Background

Counts Four, Eight, Twelve, and Thirteen as Misdemeanors Based on Amounts Taken Not Determined⌑ Defendant next contends that her convictions for grand theft in counts four, eight, twelve, and thirteen must be reduced to misdemeanors because the jury did not find that the value of the items obtained exceeded $400. The People have conceded the merit of this argument, and we agree.

In counts four, eight, and twelve, the jury convicted defendant of grand theft under section 484g, subdivision (a). Section 484g, subdivision (a) provides, “[I]f the value of all money, goods, services, and other things of value obtained in violation of this section exceeds four hundred dollars ($400) in any consecutive six-month period, then the same shall constitute grand theft.” Otherwise, the statute dictates the proper conviction as “petty theft,” a misdemeanor. (See §§ 484g, subd. (a), 488, 490.)

In count thirteen (the postage meter), the jury convicted defendant of embezzlement, a form of theft, under section 508. (§ 490a.) Embezzlement is punishable as grand theft if the value of the property taken exceeds $400 (§ 487, subd. (a)) or “[w]here the ․ property is taken by a servant, agent, or employee from his or her principal or employer and aggregates four hundred dollars ($400) or more in any 12 consecutive month period.” (§ 487, subd. (b)(3).) Otherwise, it is punishable only as petty theft. (§ 488.)

In all four of these counts, the jury was required to determine the degree of the offense under section 1157, which provides: “Whenever a defendant is convicted of a crime or attempt to commit a crime which is distinguished into degrees, the jury ․ must find the degree of the crime or attempted crime of which he is guilty. Upon the failure of the jury ․ to so determine, the degree of the crime or attempted crime ․ shall be deemed to be of the lesser degree.” The People acknowledge that section 1157 applies to defendant's case. The offenses of which defendant was convicted, sections 484g, subdivision (a), and 508, require that the jury make the determination of degree, based upon its finding whether the value of the property taken exceeded $400 or not.

Here, the jury made no findings as to the value of the items obtained. As for counts eight and twelve, the trial court initially instructed the jury to make a finding as to the value of the property obtained by defendant's fraudulent use of the access card information (CALCRIM No. 3220.) However, the trial court withdrew this instruction following a question by the jury as to whether the property actually had to be received in order for a value to be placed upon it. The court gave no instruction to assess a value for count four or count thirteen.

Because the jury did not find that the value of the items obtained exceeded $400 in counts four, eight, twelve, or thirteen, these felony convictions must be reduced to misdemeanors and defendant must be re-sentenced.

The convictions in counts four, eight, twelve, and thirteen are reduced to misdemeanors and the case is remanded for re-sentencing. Defendant's conviction in count fifteen is stricken.

David Cohen, Dr Gary Michelson, very close buddies - Forbes ex-billionaire patent

David Cohen wasn't making much money before he landed Dr Gary Michelson. Since then he bought a huge house, takes vacations all over the world with his entire family, drives nice cars, goes to expensive restaurants, gives paid talks on how to make money, all on Gary Michelson's money. In the above pic David Cohen took his entire family to London for Thanksgiving.

Gary Michelson has been parading David Cohen around as his new "close friend." Notice they both shovel dirt together at USC. While other men, i.e. Neil, Director, Gardener...have left Gary, David has stayed right by his side. Gary is happy to have a friend even though he has to pay him a lot of money to stay with him. David is also supposed to tell everyone that Gary Michelson has a lot of money and lobster claw hands, wink wink.

I've posted warnings to other male employees of Gary Michelson previously. He doesn't care if you have a boyfriend, wife, straight, gay... Everyone knows Gary Michelson is a homosexual. He doesn't try to hide it except a little with his Russian mail order beard Alya Michelson.

Who was really behind this eight year lawsuit against Neil and Richard? Gary Michelson, his lawyers who wanted money...? The lawsuit made no sense as it was legally abusive. Time will eventually tell as things unravel in the coming months.

Halloween, last day of Gary Michelson trial. Update. It's now in the hands of the jury.

Closing arguments began today in the Michelson/Powers/Campbell trial. The court room was fairly full, mostly with Powers' friends and family. Then there was Michelson, sitting front row and center with each of his attorneys, from Kirkland and Ellis, sandwiching him from the crowd. His only friends, who are paid approx. $1,000 an hour each to hold his hand in his time of need.

Before the Jurors came in the Judge said the Jury will decide first on the "statue of limitations" before going on to the points of the counts. If they decide that the prosecution brought the case too, late then it would be time barred and the case would be dismissed. If not, then the Jury will read the instructions to decide on each count for each defendant.

They started at 10 am sharp with Knowles, the D.A., presenting his closing argument. He started slow and methodical. His first quote was, "we are not going to victimize one another, we learn this as children" then he said, "The charges are not about Money" Wow, of course not. I can't believe he actually finally said it. It's personal. We've known that all along, for years. He feels he was used by his best friend, Neil, to get a free ride and that Neil never really liked him, only pretended to like him. I doubt that. A friend doesn't stick around for 15 years if he doesn't like you or is pretending to be a friend. No one can keep up a ruse like that for that long. But Gary is so insecure that's the only thing he wants to believe. That is his justification for crucifying people who he can't control. What I think is Gary was secretly in love with Neil and Neil really liked Gary as well but finally he just got tired of Gary's bullshit and started to drift off, met a woman, fell in love, got married, had a baby and that's when Gary realized he was not in control anymore of Neil. This drove him crazy, so he began his plan of vengeance. This has only been going on for eight years against these two guys.

If you recall from previous blog entries, when Neil found a woman he wanted to marry, Gary decided to find a wife and get married in 2007. Gary gave a ring to a woman, promised her a big house and she still rejected him. Then he demanded the ring back and he even sued her for the ring. When Neil had a baby, Gary wanted a baby.

Anyway, so Knowles makes another statement, "Larson by Trick" is his slogan. In the opening statement it was "They hid what they did." So Knowles starts again by reading Powers' emails, between him and Campbell building up to something, something but nothing criminal, maybe civil but not criminal. It sounded conspiratorial and bad but nothing came close to showing cause that money was stolen from those counts they were charged with. Oh, Mr. Knowles tried and selected many paragraphs from many pages of emails, taking every thing out of context and pasting it where he wanted it to look like a real crime had been committed. You only had to read the "elmo" or overhead projector's image quickly to see there were several explanations for what was written but he would switch pages so one couldn't really get a clear picture of what was going on. It really sounded bad the way he went on for over 1 hour like this, painting a picture of Powers and Campbell teamed up to "scheme" the Poor Dr. out of $2.5M dollars from several properties he bought. Knowles used his Power Point presentation, like he did in his opening statement, to demonstrate exactly how the money was siphoned off from Michelson's purchases. Except Knowles unknowingly highlighted areas which showed "Powers Profits" and purchases but then says, Michelson sent all the money down first. Still he showed "No Proof" of how much Powers paid for the properties or how much profit he earned from the sales. He tried to show a timeline of purchases that went past the time barred date of March 26th 2013 but his evidence just didn't support it as fact. He attempted to show that these 5 counts actually had properties that were not completed as a sale in 2005 but that contradicted Michelson's own sworn statements in court. Then he tried to make a big deal out of the fact that Mr. Powers wired $32,000 to Mr. Campbell for an Augusta Motorcycle as a gift. Who's to say that Mr. Powers is NOT allowed to give anyone gifts with his money. By this time an hour has passed and most of the Jurors are again sleeping. He then gets into Powers Professional Services Agreement where it clearly states that Mr. Powers is an independent contractor, saying nothing about a 6% agreement. This 6% idea was all made up by Michelson by the way. Nothing was ever found memorializing this in a contract. The only paper they had showing Powers making a commission was one paper where Powers reports that "Powers Investments Inc." for the year 2005 paid "Richard" various commissions ranging from 1% to 25% for an average of 5.6% but nothing from C & M or Michelson. Knowles talked about Powers' salary but never was there a check stub or receipt showing Powers ever had a salary. No evidence at all supporting any of this. This was all made up by Michelson and his civil attorneys then packaged and given to the D.A. Basically Knowles was trying to show that the discovery date that a crime might have occurred was Dec. 06, when Powers' signed a trust agreement finalizing their business relationship. It was an amicable "Trust Agreement" where they agreed to exchange Michelson's money for Powers' properties. Mr. Powers owned them with his own money and they never could prove that he didn't own them. Mr. Marten testified on Wednesday that Powers' sold Michelson about half of his 43 properties and Michelson rejected the rest, or approx. 20 properties which Powers eventually sold to someone else.

Then Knowles get's into the testimony of Marten that the properties sold to Michelson were less than 30% planted. So what! Jonathan, the defense attorney, showed a letter several times during this trial that Michelson knew as early as 2002 and 2003 that he had a very low planted area. Michelson testified in the prelims that he wanted to preserve "nature" so he purchased all kinds of properties including almost 4,000 acres of Ocean View properties, of which he probably still retains. Knowles continued with this for a while before the Judge interrupted him for calling out the counts as numbers 44-49 instead of 1-5. In any case it was at this point Knowles had used up about an hour and a half and the Judge decided to break early for lunch and return at 1 PM for Jonathan Michael's closing arguments. The Jury was all but sleeping. Only one appeared to be taking notes.

Defense arguments started at 1 PM sharp with Super Lawyer Jonathan Michael's. He had his easel and poster boards ready for presentation to the Jury. The Judge looked interested. The Jury looked interested. The audience looked interested. Michelson looked scared. Not sure why but he seemed very angry as he positioned himself right behind Mr. Knowles and you could feel the darts coming from his eyes, straight to the back of Knowles head. Knowles looked very nervous as Jonathan prepared for his opening statement. "Those e-mails? All made up". "Lies, manufactured by Dr. Michelson and his team of lawyers and forensic scientists" That was his first statement. So Powerfully delivered that the Jury were all on the edge of their seats taking notes for the first time of the day. "All those emails Mr. Knowles read to you this morning, fabricated, total lies, and I'm going to prove it to you."

So Jonathan began a very detailed account of the timeline when Mr. Powers' computers were seized by the Costa Rican D.A.'s office back in Dec. 2008. He recounted the testimony of 8 of the 12 Costa Rican Police and D.A.'s officials who seized the computers. But they didn't bring the one guy who all of them testified took the computers to the evidence locker at the station. So for 5 months those computers had no log in or log out date into evidence. There was the first broken chain of custody. Then he followed the timeline to when, in May 2009, the hard drives were copied onto an external hard drive and sent to Mr. Scott Cooper, a forensic expert who copied all the hard drives onto approx. 43 discs with over a million pages of data, supposedly. But Jonathan attacked this idea because this Forensic Expert had in his possession for almost 5 years these hard drives with copies to Michelson's lawyers, the very lawyers who were in court today, who then packaged them neatly then delivered them personally to Michelson's good friend Steven Cooley, the then Head District Attorney in 2012 and said, "we want you to arrest these two criminals, Powers and Campbell, put a $10 M bail on their heads with 140 counts so that they will never see the light of day again in their lives". This quote can only be imagined on what was said because I'm sure Michelson also said, "don't worry, I've already sued these guys so they have no money to defend themselves and the retention period for them to get bank records that would ever prove their innocence does no longer exist". We can only imagine what was really said behind those closed doors, however back to Mr. Michael's.

He then takes this a step further. The day before he cross examined Villasenor, the D.A.'s head investigator. He asked him why did they accept only copies from Mr. Cooper and not ask him for the hard drive for their own Forensic Investigation team to copy them selves? There may have been some evidence that was left out or even doctored. Mr. Villasenor's answer was that his boss would not let him. His Boss, Steve Cooley (who's also Michelson's friend) wouldn't let him because Michelson's best friend, Scott Cooper, was "More than qualified" to do so and the emails were to be trusted. To take it even further, Jonathan recounted testimony from the Investigator that Mr. Powers was arrested in Houston and there was found in his possession his computer, which their own Forensic Department, (by the way, known as one of the best in the world) copied the hard drive from Mr. Powers' computer. When asked if any of the emails from Powers' computer was being used in this case, the answer was "NO". So why not?? Because Mr. Powers didn't write those emails or if he did they were possibly altered when the computers went missing for those 5 months. In any case it was compelling that the "chain of custody" was broken and the evidence was mishandled. Then he went another step further stating that "they could have subpoenaed the servers, aol. gmail, cox.net,etc. and gotten the emails directly or they could have gotten the emails from Campbell's computer but they didn't, why not?"

Then Jonathan asked the Jury if they remembered last Monday when Michelson testified to taking the evidence out of the court room. Some of the Jurors nodded their heads. Jonathan said, "Dr. Michelson walked out of this courtroom with the evidence, took it home for 5 days and brought it back, and when asked if he took it he said Yes, with a laugh" "he stole court evidence, in my 20 years of trials I've never had anyone steal the evidence out of our courtroom", "what was he looking for?" "what did he do to the evidence, we'll never know for sure". One thing is for sure though, not only is Dr. Michelson a liar but now we know he's a thief, was the implication Jonathan had inferred with his statements. "He took the Book", He took the Book" he must be the crook, he took the book sounds better. Jonathan then picks up the large binder holding all the evidence and thumbs through the pages showing the Jury the immense amount of evidence inside this book, saying, "who know's what he was doing for 5 days with this book". "he took the book". The Jury was riveted at this point. So the Jury was left with great doubt at this point on weather they could trust anything that was presented in those emails which supposedly came from his supposed computers. Great doubt indeed. Then Jonathan switched gears and began reviewing all the testimony of all the witnesses from the People. First he presented his poster showing the various numbers used on the value of the investment Michelson claimed he had in the C & M farms in C.R. The first number came from his financial adviser who said, "$20 Million" was the number, then from Michelson's sworn declaration in Costa Rica that he had invested $25M, then another declaration where he said his investment was $28M, then another at $32M then another at $36M and finally another at $42M. Jonathan just ripped into this saying, "we don't know what number to believe." This guy just lies all over the place. Then came the number of acres of properties he owns. He states under testimony he has less than 2,000 acres, then his financial manager David Cohen says they own still half or about 10,000 acres but when his farm manager, Andres Marten, is flown up from Costa Rica he testifies that they own about 6,000 acres. "Who are we to believe" "Then Dr. Michelson testifies that he sold his properties for $32M, which was confirmed by his farm manager, Mr. Marten". "So he has back $32M and still has maybe 4,000 acres of ocean view land and 2,000 acres of trees"? Not bad. To top that off Marten admits that the properties appraised in 2008-2009 from $40M to $80M dollars. I wish someone would treat me like that. Then Michelson is impeached but again when testifying that Bill Capps, (his Century City attorney) had the role of only drafting the C&M partnership agreement, when in fact he was involved from day one in looking out for Michelson’s investment.

Then Jonathan shifts gears again focusing on the 3410: statue of limitations: This is simple math and Jonathan makes it even more simple by providing the Jury with a big billboard chart showing the time barred date of March 26th, 2013 stating that all the discovery of an alleged crime had to be discovered by March 26th, 2006 to fall within that 7 year period. Michelson testified he had received and paid for all the properties in counts 1-5 by the end of December of 2005. This happens to be direct testimony from the witness and should stick if he can be believed. If the Jury does get it then the case will be dismissed before any of the charges are deliberated on. The other thing Mr. Michael's demonstrates here is the great value and profit Michelson made from these few properties, regardless of whether or not they have 70% or 10% planted with trees. They are simply valuable and he already made a huge profit. Again he reiterates that Michelson is just upset because he didn't sell at the right time before the market crashed.

In the meantime Knowles is looking visibly shaken and it's hard to tell if it's because Jonathan is ripping his case apart or because he knows Michelson is watching and judging every move he makes and every word he speaks. Even deputy D.A. Ms Weintraub is there looking very nervous, doodling on her paper. By the way, she never said a word the entire day. It was Knowles' case and she was letting him sink the ship all by himself.

Then Jonathan comes back to the big binder and say's, "what did he take??"", "the book" came the answer from one of the Jurors'. "he took the book". Jonathan finished it up with that statement hanging in the air for the Jurors to really get it. Jonathan had raised doubt in Michelson's testimony, he raised doubt in the chain of custody and the validity of the emails, the amount of acres owned, the value invested and presented the hard evidence to the Jury to look at and instructed them on how to fill out the "verdict forms". If he took the Book he must be the Crook. This isn't the OJ case but this will be remembered as another good catch slogan. The Jury seemed convinced of the evidence or lack there of. Jonathan rests his case and did it in less than one hour.

By this time you could see steam coming off the head of Michelson. His lawyers were restraining him from jumping over the wall. A witness sitting right behind him reportedly heard his lawyer lean over to him and said, "did you really take evidence out of the courtroom"? Michelson had no response, only stared straight at the Judge with steam coming out of his ears. Maybe he was staring at Knowles, it was hard to tell. Steam for sure though.

Then Knowles got his final rebuttal: It was awful. It was obvious he was exhausted. He probably didn't sleep at all the night before. He didn't address any of Jonathan's points. He only repeated himself from earlier but in a very soft voice and he was shaking looking very ill at one point. He could have had 30 minutes to re-direct but after 15 minutes he seemed to be lost and didn't know where to go from there and simply said, "thank you" and sat down. How nervous he must have been knowing that his entire career could be in the hands of the "man behind the curtain" in this case 'the man behind the wall, Michelson'. The Judge swore in the deputy to address the Jury as the Jury was led out to the Jury room to deliberate. it was about 3PM now. When the Jury had left, Michelson rushes forward and sits next to Knowles. He was overheard yelling, "you got to do something Knowles, that was all lies, you got to fix it". (of course it was all lies, it was his lies) It sounded like Knowles said "it's all over, go home" or something like that. Knowles never looked at him and basically ignored him. Michelson left the court very abruptly obviously angry with his two high priced friends following close behind. However they took separate elevators down. Interesting.
Later someone reported Michelson coming out of the Janitors closet. Was he hiding? Was he afraid of something, someone? Jonathan Michaels, founder of MLG law firm was the STAR today.

Jonathan went on about how much the state of Calif. had to pay for 13 Costa Rican's to be flown up here to testify. "On your money", he said, "the people". Round trip tickets, hotels and meals. They even flew up some of their families and sent them to Disney land. And Andres Marten? "they flew him up twice so he could go back to Costa Rica for the weekend. Twice", "think about that for a minute, how much that must have cost". How much this entire case must have cost, just because Michelson wants his pound of flesh from these guys."

Knowles did address this and said, "when we have a crime that has been committed we don't say, hey this is going to cost us a lot of money, we better not go after them. Now you wouldn't want us to say that to you if you were the victim, now would you?".

Jury deliberated for an hour then recessed at 4PM to return Monday to continue deliberation at 9AM

DA Steve Cooley history of corruption - Gary Michelson, Forbes billionaire Los Angeles, California

Lord only knows how much money Gary gave to Cooley to "consult." Gary Michelson is listed as a top donor to Steve Cooley in 2010 and 2011 giving the max $13,000 twice. Gary also stood next to Cooley in a government press conference. Gary also held an award banquet for Cooley.

May 2012 a mere week or so after she got her donation she launched an investigation. March 21, 2013 the DA filed charges for 140 counts of fraud against each of them now reduced to seven counts each. August 27, 2013 Steve Cooley asks Gary Michelson out to lunch. The main big brass from the DAs office are also at that lunch. Supposedly ex-DA Steve Cooley used his contacts and influence to arrange this lunch to thank the big brass for their help on this case. Oddly enough the two people who actually did all the work on the case are not at the lunch, i.e. Deputy DA Robert Knowles and DA Senior Investigator William Villasenor. Steve Cooley used his past connections to arrange the lunch. August 27, 2013 was a Tuesday. That would be during work hours for the people from the DA's office. This seems improper.

Seems a documentary was made called "Crime after Crime" about DA Steve Cooley and corruption. From an article about the documentary which debuted at the Sundance film festival in 2011.

"According to her lawyers, the district attorney should have disclosed an internal memorandum that concluded a key witness against her had perjured himself and that they never intended to seek the death penalty against her."

DA Robert Knowles knows for a fact that Gary Michelson has perjured himself many times even in an almost identical situation with Gary's ex director here in LA. He knows this because I told him this as soon as I saw his name mentioned in regard to this case. How can they possibly believe Gary's stories? Gary Michelson even perjured himself in my lawsuit against the City of LA. I asked him to recant, retract his statement and he refused. I even stated at that time that if he is ever in a court case in the future, they can strike his testimony as unreliable because he has previously perjured himself. The DA only has three witnesses and only one real witness which is Gary Michelson. The bank witness admitted that she can't tell if the bank docs are real. She only recognized her signature. The DA's investigator merely interviewed Gary and others. He didn't witness anything.

Quite a few investigative reporters made reports about Steve Cooley and corruption. I realize Steve Cooley is the ex-DA and Jackie Lacey is the current DA. Jackie Lacey was basically Steve Cooley's right hand person when he was the DA. Steve Cooley basically named her for the job when she ran. They are of course very closely related. They also both received campaign contributions from Gary Michelson during this exact time period.

I worked for the City of LA for a while. Yes, it's corrupt, so is County. I saw numbers juggled, girlfriends get contracts with no approval of commission, employees illegally using city time/supplies for their personal use, refusal to properly reply to state info act requests, employees/volunteers being harassed, false reports filed by one employee against another, the hiring of convicted felons, employees driving city cars drunk out of their mind, employees drunk on the job, City Attorney stealing my glasses at a campaign fundraiser so he could have an excuse to ask me out....I told him to just throw away my glasses or leave them in Antonio Villaraigosa's office. The City Attorney was upset by that so he made up a fake story about me in retaliation. I'm happy he finally retired. I've even had people in government offer me favors without my asking. I of course said "no."

The timing of the donations to DAs Steve Cooley and Jackie Lacey is just way too coincidental. The DA's office started it's investigation into Neil Campbell and Philip Powers a week after DA Jackie Lacey received a campaign contribution from Gary Michelson at a party. Gary Michelson previously also gave the max to Steve Cooley. I should not be surprised because Gary asked me how he can get the politicians to do what he wanted. I point blank told him to give them money and he did.

I just realized that C&M Investments was a Nevada corporation. It was not in California. The C&M Limitada in Costa Rica was in Costa Rica.

Gary Michelson v Neil Campbell - Preliminary hearing in criminal fraud case BA40922502

~~I'm shocked that the Los Angeles Police Department was willing to file the original charges against Philip and Neil based on the evidence or lack thereof~~. Turns out the LAPD did not file the original charges. This case went straight to the DA from Gary Michelson. I believe Gary Michelson did this because the last time he filed a false police report with the LAPD, they refused to do anything because no crime was committed. LAPD told me, Boks, Mayor's office that Gary Michelson is "crazy," "no crime was committed." Notice Gary donated to the DA. He didn't donate to the LAPD as far as I can tell.

They seem to have filed the case based on what Gary Michelson told them alone. There was no fraud or loss of any money. I of course have no idea what evidence was submitted as there's no way I can access it. I'm going based on what I've seen in civil case documents and the case in Costa Rica.

~~Nevertheless LAPD took the case then forwarded it to the District Attorney.~~ Gary Michelson contacted the DA directly. The DA Jackie Lacey and previous DA Steve Cooley both took campaign contributions from Gary Michelson. I documented that here in this blog. Gary Michelson also gave an award to Steve Cooley in October. I posted that here as well. After they received the contributions they agreed to prosecute the case. This is why I feel there is some corruption going on here. Again, there was no crime of fraud or theft. No land or money was stolen. Gary Michelson made money in this case.

In order for this case to go beyond a preliminary hearing to a full criminal trial the prosecutor Robert Knowles (?) will have to show the Judge there is enough evidence to require a trial. In the United States, the judge must find there is probable cause that a crime was committed.

Even though I went through the police academy I know very little about criminal law so I had to look this up. "Preliminary hearings, often referred to as "prelims," require the prosecutor to show enough credible evidence to a judge to convince that judge to send the case on to trial." More info here

I can't access the criminal docket or motions filed like I can with civil. I'm still trying to figure this out. I only know when there are hearing for Neil because it's on his inmate page here.

Put in name "Neil Campbell" and you can see his hearings. Unfortunately it doesn't say what the hearings are for so I have to go to the actual hearing. I try to time it so I can get my mail at the same time so I don't waste gas.

The question now is if the DA will be able to show the judge there is enough evidence to show that a crime may have been committed and the evidence could withstand a trial. I believe if a Judge were fair the Judge would realize there is no evidence of a crime. Judge can't just believe Gary Michelson who is a known pathological liar who has committed perjury. He perjured himself like crazy in my case and I have proof. He also lied about Dave L and filed a false criminal complaint against him. LAPD told me, Boks, Dave, Gary... that there was no fraud, theft or embezzlement. LAPD detectives said Gary was just crazy and made it all up. Even after LAPD told Gary there was no crime Gary kept telling everyone the LAPD would arrest Dave any day. That is really mental illness.

Of course if the Judge is corrupt which happens all the time Neil and Philip could lose the preliminary trial even if their lawyers showed there is not enough evidence of any fraud or theft. I believe the DA has been changing judges in this case. Judge Korn was fair with Philip in his bail hearing. Now she's gone. The DA of course has ins with the Judges. They both work for the County and are basically on the same side. This of course makes justice somewhat difficult for people. It makes it even more difficult when you have billionaire Gary Michelson giving money to the DAs office and County. Gary Michelson gave 1,000,000 microchips to Los Angeles County Animal Control. He gave $160,000 to the City of Los Angeles animal services. As I look at it Gary Michelson ONLY gave a total of $160,000 to the City of LA. Any donation over $20,000 must be approved and that is the only approved donation.
