March 2015 Dr Gary Michelson bought an award. This is straight from Gary Michelson's website. He wrote this about himself.

"On March 26th 2015, renowned orthopedic spinal surgeon and inventor Dr. Gary K. Michelson was awarded the Albert B. (sic) Sabine Humanitarian Award by the SABIN Vaccine Institute in acknowledgement of the significant, continual financial contributions he has made to their research programs."

The award is basically a receipt for money. "Thanks for the money. Here's a piece of plastic." His employees keep posting about this award every week as if it's a new award. It's not even an award but a paid for piece of plastic. This was posted half an hour ago.

What happened to Robert Knowles the Deputy DA from the Gary Michelson case?

He's still listed in the California Bar Association directory as working at the LA County District Attorney office. The only mention of him in their website now is from this press release about the Gary Michelson case. Previously they omitted this result from searches.

Notice they were each charged with 140 counts of fraud. They were found guilty of only one county of fraud which I believe is in a misdemeanor amount. This press release and all this work when they knew these two people were innocent.

I don't think Robert Knowles is working as a prosecutor anymore. I think he may have a desk job somewhere in the DA office. In 2013 he was listed as a Deputy District Attorney IV. The last bit of news I see for him is this case.

Judge Craig Richman should have reduced charge to misdemeanor then dismissed it

This next bit confirms my thoughts about the improper ruling by Judge Craig Richman. It really boggles my mind that the Judge should have reduced it to a misdemeanor then dismissed it based on case law but he chose not to. He had this case to back his decision but decided on his own not to rule. He will now force Neil and Richard to live out three or four years of appeal hell. They can't get a job, Richard can't leave the state... And all for what? So Judge Craig Richman can continue being a judge with the support of the DA. He doesn't want to piss anyone off so he doesn't have to deal with the City Attorney allowing another crazy person to file assault charges against him. I would like to note in that case Judge Craig Richman was not 100% innocent it turns out. The crazy lady threw a bag of dog shit in his car. He then as per his own statement pushed her. He also lied and told her he was a police officer. That is a crime in and of itself. Then she pushed him. During that case he had to step down from the bench during the investigation and trial. Below is an almost identical case to the Powers/Campbell case in which the defendants were convicted of felony charges but the Jurors made no restitution or findings in the amount over $400 so the Appellate Court ruled them misdemeanors from felonies. This is now "CASE LAW."  Jonathan Michaels argued this case after lunch with the Judge saying, "lets forget about prop. 47 for a minute and look at this CASE LAW which makes published findings that you must reduce the count to a misdemeanor as the findings are identical to our case".

Judge Richman basically said, "that's a very good argument Mr. Michaels but I'm sticking with my earlier decision to NOT RULE, I may be wrong and I've been wrong before and you may be right and I invite you to appeal, and I expect you will, however I am letting the Jurors decision on one count of Felony Grand Theft to stand and I will not rule on a presumption of knowing what the Jurors decision would have been as far as restitution."

Jonathan then argued that is exactly the point and said, "Upon the failure of the jury to so determine, the degree of the crime with no stated restitution amount then it shall be deemed to be of the lesser degree, a misdemeanor by the court.”

Since 2008 the amount of petty theft misdemeanor has been raised to $950 from the previous $400.  Still the Judge did not even find a restitution in the amount of over the misdemeanor threshold.

A jury convicted defendant Sumaria Love of 15 counts of various identity theft-based offenses arising from abuse of her position of trust as a dental receptionist.

On appeal, defendant makes four claims:  (1) her conviction in count eight of fraudulently using an access (credit) card was only an attempted offense;  (2) the prohibition upon dual convictions for theft and receipt of the same property bars her from being convicted both of fraudulent use of an access card in count twelve and receiving stolen property in count fifteen;  (3) her felony convictions in counts four, eight, twelve and thirteen must be reduced to misdemeanors because the jury never determined the amount taken;  and (4) the trial court's imposition of an upper-term sentence violated her rights to a jury trial and due process under the Fourteenth and Sixth Amendments.

The published portion of this opinion encompasses defendant's first three claims and we agree with the latter two of them.   Accordingly, we strike defendant's conviction in count fifteen and remand the convictions in counts four, eight, twelve and thirteen for re-sentencing as misdemeanors.   We disagree with defendant's first claim.   In the unpublished portion of this opinion, we reject defendant's fourth claim.

Background
 
 Counts Four, Eight, Twelve, and Thirteen as Misdemeanors Based on Amounts Taken Not Determined⌑ Defendant next contends that her convictions for grand theft in counts four, eight, twelve, and thirteen must be reduced to misdemeanors because the jury did not find that the value of the items obtained exceeded $400.   The People have conceded the merit of this argument, and we agree.

In counts four, eight, and twelve, the jury convicted defendant of grand theft under section 484g, subdivision (a).  Section 484g, subdivision (a) provides, “[I]f the value of all money, goods, services, and other things of value obtained in violation of this section exceeds four hundred dollars ($400) in any consecutive six-month period, then the same shall constitute grand theft.”   Otherwise, the statute dictates the proper conviction as “petty theft,” a misdemeanor.  (See §§ 484g, subd. (a), 488, 490.)

In count thirteen (the postage meter), the jury convicted defendant of embezzlement, a form of theft, under section 508. (§ 490a.)   Embezzlement is punishable as grand theft if the value of the property taken exceeds $400 (§ 487, subd. (a)) or “[w]here the ․ property is taken by a servant, agent, or employee from his or her principal or employer and aggregates four hundred dollars ($400) or more in any 12 consecutive month period.” (§ 487, subd. (b)(3).)   Otherwise, it is punishable only as petty theft. (§ 488.)

In all four of these counts, the jury was required to determine the degree of the offense under section 1157, which provides:  “Whenever a defendant is convicted of a crime or attempt to commit a crime which is distinguished into degrees, the jury ․ must find the degree of the crime or attempted crime of which he is guilty.   Upon the failure of the jury ․ to so determine, the degree of the crime or attempted crime ․ shall be deemed to be of the lesser degree.”   The People acknowledge that section 1157 applies to defendant's case.   The offenses of which defendant was convicted, sections 484g, subdivision (a), and 508, require that the jury make the determination of degree, based upon its finding whether the value of the property taken exceeded $400 or not.

Here, the jury made no findings as to the value of the items obtained.   As for counts eight and twelve, the trial court initially instructed the jury to make a finding as to the value of the property obtained by defendant's fraudulent use of the access card information (CALCRIM No. 3220.)   However, the trial court withdrew this instruction following a question by the jury as to whether the property actually had to be received in order for a value to be placed upon it.   The court gave no instruction to assess a value for count four or count thirteen.

Because the jury did not find that the value of the items obtained exceeded $400 in counts four, eight, twelve, or thirteen, these felony convictions must be reduced to misdemeanors and defendant must be re-sentenced.

The convictions in counts four, eight, twelve, and thirteen are reduced to misdemeanors and the case is remanded for re-sentencing.   Defendant's conviction in count fifteen is stricken.

UPDATED: Two motions today on sentencing, motion to dismiss, motion to make misdemeanor, Dr Gary Michelson

UPDATE: Court was over a couple of hours ago. Gary Michelson got on the stand for a while to make up stories about Neil and Richard. Next thing I know I see Richard back in the sheriff records as out on bond. He previously didn't show up at all. He was in jail from May 23, 2013 to September 20, 2013, four months. I see Neil listed as own recognizance. I assume it means they are both not in jail.  I wonder what Gary Michelson and his paid DA friends did between end of trial and sentencing. If you read the below motions, the one charge should have been dismissed.

I just realized that the Sheriff dept spells Philip like "Phillip" when the LA criminal court shows him as "Philip." The sheriff record is the same. He appears to still be out on bond. It also appears he will be on probation three years total minus time served 1095-120=975? I'm guessing at this point. One count of felony is three years in jail. I called the courts. This is both of their first and only offense.

UPDATE: Sentencing is at 1:30 pm. Motions were heard this morning but one count was not reduced to misdemeanor or dismissed. Judge invites them to appeal because he doesn't know how to rule in this case. It would be one of the first cases ruled upon after the passing of the recent bill. Neil will not go to jail no matter what because of time served. He was in jail about 1.5 years already. There is a small possibility that Richard might have to serve time, be on probation. He was in jail many months already. An appeal would easily take two years if not longer and cost a lot of money. My civil appeal in Texas was briefed, submitted over 14 months ago and still no opinion.

Did the DA get to Judge Craig Richman? Does the Judge fear Dr Gary Michelson and his power, money, political influence with the DA, ex-DA? Does the Judge just not want to be the first to dismiss a misdemeanor? Does the Judge not want to downgrade the felony to a misdemeanor because he doesn't want to piss off the DA office, hurt his chances at re-election as Judge? DA, Judge, politicians, money, power....all inner twined here in LA, in most of the US. Never a good thing. As I read the below motions, know the issue, have seen the evidence in court, watched the preliminary trial, some of the final trial...I don't know how it can't be reduced and dismissed.

Probation, sentencing hearing tomorrow at 8:30 a.m. dept 120. Will all charges be dismissed? Will Dr Gary Michelson be there? Is DA Robert Knowles still alive or did Gary do something to him?

Sentencing hearing tomorrow morning. I think based on law, evidence (or lack thereof), outcome of trial... the one charge should be dismissed. They should be free to go. Of course their lives have been destroyed, they don't have a penny or any assets to their name, they probably won't be able to find work... Dr Gary Michelson the crazed billionaire has destroyed these two men and their families. We still haven't heard from DA Robert Knowles. I hope Gary did not do anything to him. He did the best job anyone could with the lack of evidence and Gary perjuring himself on the stand repeatedly.

All the Kings Money and Humpty Dumpty: One and the same Dr Gary Michelson

For those of you who have been following my blog since I started it September 9, 2013 on the Powers/Campbell case you will remember that from the time Powers and Campbell were arrested I kept saying they were innocent.  I didn't really know for sure but I suspected, knowing Gary Michelson, that this was another one of his revenge treks.  He's been doing this for years in the Civil Courts but I believe this is the first time he's taken it this far in the criminal courts.

So I started doing my own investigation, and by no means do I have the resources that the Los Angeles D.A.'s office has but none the less I began researching this case Gary brought against Richard and Neil on my own with my limited resources.  Before Richard was even out of Jail last Sept. of 2013 I was pretty sure he was innocent. But almost one year ago to the day when this trial started on Oct. 16th 2014 I had written in my blog that I discovered evidence that Richard Powers was innocent.

Michelson had filed the exact claim against Richard in Costa Rica in 2007 and by 2010, 3 years later, they dismissed his case.  They discovered there was no crime and  even suggested that Gary Michelson was a "Liar".  Yes, it was refiled by the Attorney General but evidence points that Michelson had great influence in getting that done, just like he did here with his influence on his good friend, Steve Cooley, the L.A. D.A. at the time.

I've re-posted my blog below so you can review. Then I followed up with more evidence I discovered in future blogs.  I even contacted the D.A., Robert Knowles, and informed him of these facts and they ignored me.  I specifically told Knowles that Gary Michelson has filed false criminal complaints in the past with LAPD. He filed a totally false complaint about his ex-director. The LAPD told me, Mayor...that Gary Michelson was "crazy." There was no crime. I sent this to the DA Robert Knowles. I was alerted to this case via my Google news clipping service for keyword "Gary Michelson."

Below is the email I sent to DA Robert Knowles about this case. I just * out the name of Gary's previous victim. I sent this September 2013. The DA knew Gary was a lying fraud yet they continued with the case wasting tax payers a lot of money.

Can you tell me who is the PD for Neil David Campbell? You are assigned to the case from the DA's office, case # LACBA409225-02. I have some information I need to give to his PD. Gary's "advances" on ****** were refused. Gary sought vengeance by filing a false criminal complaint against him falsely stating he embezzled and stole money. LAPD investigated and stated no crime had been committed. Gary Michelson then contacted Ed Boks and the Mayor's office asking us to tell the LAPD to arrest ******. I worked for both Gary and the City at that time. We spoke with the LAPD. They told us no crime was committed. They stated Gary is a "liar," and "crazy." I gave those emails to Dave ****** who used them when he sued Gary for defamation. Gary settled that case within two months. I'm no attorney but as I view the documents in the civil case upon which the criminal case is based I don't believe a crime was committed. Gary lost no money. He made a lot of money. Courts have ruled you can't sue for "loss of a bargain" when you knowingly agree to purchase something at a specified price. Thanks.

They've known for more than a year that these guys were innocent but they pursued with this case anyway.  You may say, "well they were found guilty of one felony count" from 141 counts filed against them.  But I've done my homework and what I see from the Jurors verdict is that they found "No Amount" for restitution and they found them innocent on the enhancement charges.  Which means this should be a 901.1 or 484(a) violation or a petty theft violation of less than $950 or less than $50. It's still very odd to me they could be found guilty of even one county when the jury stated they didn't take a penny.

I don't know why Powers and Campbell need to have a Probation report when this falls under another code not affected by Prop. 47.  This is an automatic misdemeanor, petty theft violation.  Simple as that. I think the Jurors flipped a coin because one of them wanted a guilty and all of them wanted to go home.  They were sleeping through most of the trial anyway  sometimes three jurors at the same time.

In any case it's a far cry from the alleged $28 Million Dollar theft Jackie Lacey claimed in her press conference last June 2013. What I don't get is that the D.A.'s office must have known these guys were innocent yet the politics of Gary Michelson continued to influence the D.A.'s office.  It makes me wonder how much money did Gary really pay Steve Cooley over and above his campaign contributions or what was he promised.  Cooley has a consulting firm where he "helps people maneuver around the Judicial system".  I'll bet if you start looking at all those companies owned by Michelson, I posted in my last blog, you'll find that one of those companies paid millions to Cooley for advice on something and that something was to insure that Powers and Campbell would spend the rest of their lives in Jail.

Boy I'll bet Gary Michelson is furious right now thinking, he spent $50M to U.S.C. trying to influence Cooley and impressing the Judges of Los Angeles County Court.  He probably spent another $30M pursuing Richard and Neil over the last 7 years and who knows where else he's left money trying to get favor from people whom he wants so desperately to believe his story.  And all that money spent by the D.A.'s office, must be millions as well, all for a conviction on a $50 petty theft charge.

The trial proved two important things. One, Gary Michelson is a liar and a thief. Two, he made between $6M and $12M selling half of his Costa Rican properties and still retaining almost half or approx. 10,000 acres (according to his own CFO) of his lands there and of that approx. 4,000 acres of that are ocean view properties. (according to his own Costa Rican farm manager).

Richard and Neil made him millions, as I've been saying for more than a year, but no one in the D.A.'s office would listen to me.  It could have saved the people of Calif. millions of dollars and the D.A.'s office a big embarrassment.  The D.A. can still save some face.  They should bring charges against Gary Michelson, for Abuse of Process, false testimony, perjury.

Deputy District Attorney Steve Lopez of L.A. is also a USC graduate and was somehow involved in the Powers/Campbell case.  He took over for Knowles last year during the bail hearings for Mr. Powers.  He was the person who got County Council to reject the bail proposal and later with Knowles came up with the phony $3.4 million dollar appraisal with their own appraiser on Gary Ashe's house which the Judge overruled, saying she believed the property was worth North of $10M and several other appraisal's were in the $9M dollar range. There was so much corruption between Michelson and the D.A.'s office. What was that luncheon meeting between Michelson, Cooley and all the high level D.A. personnel really about?  Will we ever know?

There I go, repeating myself again.  "All the Kings men and all the Kings money, couldn't put Humpty Dumpty Gary, back together again".  You LOST again Gary.  Get a life, it's time to move on and be happy with what you have.  Don't you have two kids and a wife to take care of? Or do you pay someone to take care of them as well?

Breaking news!!! Just found documents which prove Philip Powers is innocent!

I've been making calls, emailing trying to get ahold of documents in the civil case Michelson v Campbell, Powers and the criminal cases against those two here in LA and in Costa Rica. Thank god I speak Spanish and know my way around the LA court system a little.

I have uncovered the transcript from the application for acquittal of Philip Richard Powers in Costa Rica. The Costa Rican courts wanted to acquit Powers stating there was no crime. "Application for final acquittal. Case: 07-001578-283-PE. Versus: Phillip Richard Powers. Crime: fraudulent management. Plaintiff: C and M Investment Group Limitada.Messrs.: Pavas Criminal Court. Third Judicial Circuit."

In this document the Court clearly states that there was NEVER an agreement for Powers to get a 6% commission on land sales to Gary Michelson. While Gary Michelson stated many times that there is such a document he was NEVER able to produce it. Obviously, Gary Michelson is lying. I believe that is perjury. He lied in his legal statement about me. He definitely committed perjury here in Los Angeles in my case. Plus, 6% commission on land sales in Costa Rica makes no sense.

The Court ruled that Powers was paid to plant and maintain teak farms which he did. The Court ruled that Powers bought the land as an independent individual. He did not buy the land for Gary Michelson or the C & M Investment group, i.e. Campbell and Michelson. The documents clearly show that Powers bought the land on his own, cleared title, removed squatters, prepared the land for teak farms and then sold the properties to Gary Michelson for a price Gary Michelson agreed upon after consulting his experts.

The document goes on to state that not only did Powers not defraud Gary Michelson but Gary Michelson did not lose any money. It turns out Gary Michelson made a lot of money. On top of this after Gary Michelson complained about the deals Powers offered to buy the properties back for what Gary Michelson paid. Gary Michelson refused because the properties were worth more. Powers then offered double what Michelson paid for the properties and Gary Michelson again refused.

The Costa Rican Court has clearly showed that Gary Michelson is a liar. Over the course of a few years Gary Michelson could NEVER produce a contract which stated 6% commission. The Court even stated that 6% commission does not make any sense in land deals in Costa Rica. Court stated no one would broker land deals for 6% commission. Court stated no crime was committed and Powers should be acquitted.

Yesterday's hearing in Gary Michelson criminal case, ex-Forbes billionaire

Powers and Campbell appeared in court on Thursday morning in front of Judge Richman to hear a motion their attorney, Jonathan Michaels, filed to reduce a count of Felony down to a Misdemeanor. This follows on the Proposition that passed a week ago, (Prop. 47) reducing felonies to misdemeanors on first time offenders.

The D.A. in charge, Mr. Robert Knowles, was a no show and filling in for him was Ms. Winetraub.  Though the motion was filed on Wed. the day before, Ms. Winetraub said she had not received it until that morning of the hearing and asked for it to be heard on another day.

The Judge said he thought it was premature to grant a Misdemeanor for Powers and Campbell since he had not seen the Probation report on either of the defendants.  The Probation report is necessary to assure the court that neither Powers or Campbell has a criminal record.

Winetraub tried to argue the motion saying she believed the count should remain a felony and the Judge strongly disagreed with her.  So the sentencing was to be on the 9th of Dec. but it seems that Ms. Winetraub was unable to appear then so she requested a date of the 15th of Dec.  The Judge granted the date of the 15th of Dec. to hear two motions, one, to dismiss the entire count due to "Prejudice" and the second, to reduce the count to a misdemeanor if not dismissed.  Either way, Powers and Campbell would have the option to appeal the count but if it's a misdemeanor the question would be, "is it really worth it"?   It's equivalent to a shoplifting violation, time served and probably no fine as the Jurors found no enhancements and no restitution for the "alleged" victim.  Of course they know that Michelson made millions off this deal with Powers and Campbell.

When is every body going to get it, this is personal and Gary used and manipulated the U.S Judicial system to dole out his vengeance for him against Richard and Neil.  After what Gary said to Knowles after the closing arguments I would say by now Mr. Knowles is figuring out what kind of monster Michelson really is.  He probably has already been demoted or fired at the request of Gary.  Gary has made death threats to many people who he doesn't get his way with so if I were Knowles I'd be looking over my shoulder for strangers lurking in the night.  I know how Gary thinks, just ask Dave his X-partner.  He's another victim of Gary's.  Ask Henry, the Gardner.  Ask Richard and Neil.  There are many more that have yet to be mentioned who have been threatened and sued by him for almost no reason at all.  "Hell hath no fury like a Gay billionaire scorned" hiding behind a phony family life.

I've said this before and it's still true today.  The D.A.'s office should file charges against him for Perjury, false reports, abuse of process and I'm sure they could think of something else.  They came up with plenty for Richard and Neil.  The story is just beginning to get interesting.  Stay Tuned.

Jury verdict is bizarre, doesn't make sense. Thoughts on the verdict, Gary Michelson

This decision against Powers/Campbell is really bizarre.  They started with 140 counts of "Grand Theft" with a maximum of 3 years per count.  That's like 420 years on the Max side or 105 years on the low side. ($32M + $2M he got from Neils' house and millions from sales of timber over the last 8 years that was not allowed in)   Then the counts got reduced to 49 counts, still looking at 150 years.  Then through Prelims it gets reduced to 6 counts, then Knowles adds the count of conspiracy (7 now) because he knows he's got no evidence to support a theft or loss. Powers owned and flipped properties to Michelson and made him Millions of dollars ( not to mention Michelson is still sitting on close to 10,000 acres of Costa Rican property, with approx. 4,000 acres of ocean view lands according to testimony by Andres Marten, his farm manager and David Cohen, his CFO for Karlin Holdings.

Then there's a trial on Aug. 25th and the case is dismissed because Knowles is not ready and he'd doubled up on one of the counts.  So one more count is reduced, back down to 6 counts.  A new trial begins Oct. 16th and on that day the Judge dismisses the "conspiracy" count because it was "timed barred" by the statue of limitations.  Now they are back down to 5 counts of "grand theft".  Remember, grand theft is anything over $400.  Knowles files a new motion to add another count, now of "Maintenance Fraud".  When the Judge asks Knowles if he has any supporting evidence he says, "Yes", but can't support it so the Judge denies the motion.  Knowles then adds enhancements to the "grand theft" charges.  Judge accepts these assuming the Jury will find that monies were in fact stolen in the amount over $500,000 relating to a pattern of theft or for a total loss of over $2.5M.

So the Jury decided that count 1 was timed barred because Michelson admitted on the stand that he had received and paid for this property before the date of March 26th 2006.  Michelson admitted that he had paid and received all of these properties before Jan. 1st 2006 so if the Jury "timed barred" #1 then they would have had to "time bar" all of the counts.  On 3 counts they were found "Not guilty" to the "taking of money" but on count 3 they were guilty?  How is that possible when it was proven that not only was no money taken from Michelson but in fact he had made millions!  Maybe Neil and Richard stole Gary's "I phone", but it wasn't mentioned in the proceedings.  That's worth over $400, right?  Yes, that's what Richard and Neil are basically charged with, a theft of over $400, but what is it?  Where is it??  I hope the Judge investigates this decision and pulls the phone records of Juror # 5 and Michelson's attorneys.  I'm sure they will find some connection there.  Something happened over the weekend.  Knowing the influence of Michelson these Juror's should have been sequestered or at least Juror #5.

Last Friday, after the closing arguments, several people witnessed Michelson barge through to the D.A.'s bench and tell Knowles, "He needs to fix this".  What happened over the weekend?  Did Michelson's people get to Juror # 5?  What was he offered?  Is it possible he was influenced or threatened in any way? Did Knowles help him "fix it"..  Even Knowles seemed shocked with the decision as did his investigator Villasenor, who was sitting in the back row with the rest of the audience and laughed when he heard the verdict "guilty".

I'm sure they will appeal this and hopefully in the meantime it will be investigated.  Something is just not right here.  I smell a big "Rat".  Good news, Neil is free and won't spend any more days in Jail. He's more than done his time for making Michelson a richer man than he already is. Both of them made Michelson a lot of money.  What kind of Justice is this.

"Michelson took the Book, He's the Crook".  He's the one that belongs in Jail. He also perjured himself repeatedly in writing and in court room testimony. He really needs to be charged for filing a false criminal complaint and perjury besides theft.

NEIL IS FREE! Neil and Richard found guilty on only one charge and no enhancements.

Neil was released at 4:12 pm for time served. DA wanted to remand Richard back into custody but Judge said "frankly I am surprised by this verdict. I will not remand him back into custody."

Jury reached the verdict at 3:00 p.m. Of the five counts they were found guilty of count three only. They were found not guilty on count one due to statute of limitations. They were found not guilty on the rest of the counts. There were no enhancements. They wanted to enhance sentencing if found guilty of fraud over $500K or $2.5M.

I am also surprised they could be found guilty on count three. One thing I'm not surprised about is that odd juror number five was indeed the foreman as I predicted. I'm sure he led the vote in the direction it went.

The Judge gave a stern warning to the DA telling him to tell Gary to not contact the jurors in any way, either directly or indirectly.

December 9, 2014 is their sentencing hearing S120 again. The maximum sentence would be three years. Judge Craig Richman already released Neil Campbell on time served. He was in jail for over a year and a half. Judge will most likely give Richard probation as he has no record.

Gary Michelson will probably still be upset that the money he gave to the DA didn't buy him maximum sentences. I personally feel they should appeal. How could they possibly have been found guilty on any charge for any reason? They did not take money or property from Gary Michelson. Gary was the idiot who did not sell before the crash. I think Gary is being taken by David Cohen and Andres Marten. They should have advised Gary to sell if money was his main goal. Of course if he did that David and Andres might not have jobs.

Neil Campbell released from jail

What evil thing will Dr Gary Michelson do next? Will he force the DA to reprimand, demote, fire Robert Knowles? Will he get mad at the DAs for not throwing his friends in prison for years after he gave the DAs money? Will he try to attack Neil and Richard in some other way?

Sentencing is December 9, 2014. They were charged as a felony so maximum sentence is three years in state prison. "Penal Code section 487(a) is grand theft. It's a "wobbler" in California, which means it can be charged either as a felony or a misdemeanor. As a felony, it carries a maximum of 3 years in state prison. As a misdemeanor, it carries up to a year in county jail." As Neil and Richard have no priors, they should get probation. Neil should get nothing because he was in jail for a year and a half already.

Found Animal Foundation's fundraiser with crowdwise is odd. Gary Michelson

Gary Michelson had CrowdRise handle the fundraiser. They have a minimum of 4% plus credit card fees of about $3% plus extra fees. They end up taking about 10% of the donations. I just did a fundraiser on gofundme as a non-profit and they took 9.25%. I will never do that again. They also get all the names, addresses, email addresses of the donors to use and sell. They are a business, not a non-profit helping people. They also make interest on the money they hold. In this case the fundraiser got $1M. Crowdwise made $100K.

Why doesn't Gary just donate the money to the charities directly? 10% more money could have gone to the charities.

Closing arguments today at 10:00 a.m. Dr Gary Michelson criminal trial

The Judge denied the motion to dismiss today so the Jury will hear closing arguments tomorrow at 10 AM. Probably will be Monday before the Jury finishes deliberations but it could happen tomorrow.
It is expected the D.A. will go first for about an hour then the Defense will go for about and hour then lunch then the People will get another rebuttal, probably for 30 minutes or so, then the Jury will go out in deliberation. We should hopefully have a verdict by Monday.

Based on what I saw in court the 28 year old or so man in the middle back row will control the jury. He seems to be the most educated and was interested in the case and paying attention. He was taking notes or drawing, hard to tell from where I sat. I hope he can see the real issues here. We have an eccentric billionaire mad man who is a pathological liar who committed perjury repeatedly. "There is a contract. There isn't a contract. There was an agreement. There was no agreement. I have 2,000 acres. I have 5,400 acres. They stole from me. I lost money. I actually made 80M on a 23M investment but sold after the market crashed."

Said mad man got personally upset because his friend didn't want to be friends anymore. Mad man decides to sue him so he could paper him to death just to be mean and nasty. Gary has done this before. Gary said I think he spent $50M in legal fees fighting Medtronic. He would sue Neil and Richard until they couldn't afford to reply and would then lose by default.

Crazy Gary wins the civil case but does not have the pound of flesh that he desires. He decides to file a criminal complaint in Costa Rica. Costa Rica DA says no crime was committed. No money was stolen or lost. Gary then decides to bribe the California DAs with money so they will go after his ex-friend in criminal court. His DA friends oblige and file criminal complaints. Gary takes them out to lunch to personally thank them for being his henchmen. DA lets Gary stand next to him in a DA press conference about dog fighting. Gary gives DA Cooley an award with a pic of his dead dog's head on a platter.

And here we are today. The verdict will be interesting. I wish they'd reach a verdict by this afternoon. I see the case as pretty simple. Neil, Richard offered Gary land for a price. Gary agreed and bought the land for the agreed price. Gary received the land. The land went way up in value. A $23M investment became an $80M investment. The market crashed. Gary ended up selling part of the land for $36M I think. No money was lost or stolen. Gary recently said he put more money into the land after he bought it. That was his decision. Neil and Richard didn't tell him to do that. Gary put that money in when Andres Marten was in charge after Neil and Richard were gone. Maybe Marten should have advised Gary not to put more money into the land. I have a feeling Marten is making beaucoup bucks off of Gary by pretending to be the honest guy who has his back. I didn't believe all of his testimony. You could see he was lying at times. Neil and Richard couldn't respond to his assessments of the land as they had no records. I would bet that Marten might have made up the story of the land and trees being crappy just to garner Gary's trust so he could milk him for salary and seedling fees. "Estos arboles son malos. Tu tienes que comprar MIS arboles. La tierra es terrible. Tu tienes que darme dinero para trabajar a mejorar la tierra o yo puedo venderte mi tierra buena." Translated, "These trees are bad. You have to buy my trees (seedlings). The land is terrible. You have to give me money to work to improve the land or I can sell you my good land."

Monday trial summary. Dr Gary Michelson on the stand.

The morning started off with the DA continuing to lay the foundation of his case by presenting the exhibits. Michelson told his story of being "deceived by his best friend who stole his money and wouldn't pay it back. So he sued him."  He went on about the 6% theory but still no proof and admitted that there was no document memorializing that. If you recall earlier he stated there was a written agreement for the 6%. Later he admitted there was never any such document. And again in CR there is no 6% commission. It sometimes takes two years just to clear the title not to mention all the other work involved.

The afternoon started off with the Defense attorney also laying out the exhibits when Michelson admitted to having sold some of his properties for $32M but now he claims he's invested $36M but in four previous declarations he admitted to different numbers ranging from $25M all the way to $42M.  He admitted to having at least 2,000 acres still in his possession.  He was asked about his plantations in Panama and he said that he didn't remember how many acres he had there.  At least more than 20,000 acres he said but he told Forbes Magazine he had more than 60,000 acres of teak in Panama.   Then the defense attorney dropped out a big bomb on Michelson.  He said, "did you walk out of court last Wednesday with the defense's exhibit book?"  "Yes I did" Gary said.  "So you had it for five days?" attorney he asked.  "Yes" said Michelson.  "And you brought it back today?"  "Yes" said Gary. Then the defense attorney stopped and let that information hang in the air.  The Jury's faces must have been frozen to realize that Michelson basically just committed a felony.  Evidence tampering etc.  This will probably come up later.

Then the defense attorney asked about the appraisals of the C.R. teak properties.  He admitted to several appraisals being made by Andres Marten who is C & M's and Michelson's farm manager in Costa Rica. From $41 Million dollars all the way up to nearly $80M.  Now remember from the prelim he had denied having ever gotten any appraisals on his farms.  Check back in the blog here about the prelim. He was asked this several times and he denied it.  Then the Judge, Mr. Pastor from the prelim, advised him that he needed a lawyer before he impeached himself and three days later he came with his lawyer and admitted that he had indeed gotten an appraisal on his farms.  When asked for how much, he said for $32 million dollars. Looks like he's about to be caught in another lie.  Then the defense attorney asked Michelson on every count of Fraud, from 1 to 5, if he knew how much money was stolen from him on each count.  The answer was that "he had no personal knowledge on how much was stolen". The D.A. has not shown any evidence yet as to how much Powers paid for these properties or to how much he actually made off each one of these.

Then the defense attorney brought up the many criminal and civil suits he filed against the defendants, both in the U.S. and in C.R.  There were like six of them all together.  The issue with Mr. Powers Costa Rican dismissal came up but the D.A. objected to that and it was laid to rest for now, only to conclude that it had been refiled and was still active in Costa Rica.  The very last question the defense attorney asked Michelson was, "did Powers offer you $10 Million dollars over and above your investment to buy back your properties"?  The D.A. objected and the Judge said he consider the question overnight.  Trial continues with Michelson on the stand at 10:30 AM Tuesday.

Trial update from Friday. Trial continues tomorrow with Gary Michelson on the stand.

Thursday 10/23 was another boring day with the Costa Rican witnesses on the stand.  They started off with a Costa Rican D.A. official that spoke about the “Rogatory Letter” process which is the request for evidence from an international judicial body.  The Jury was lost as Knowles continued on.  Defendants' lawyer got up and asked her “who was paying for the entire trip."   The U.S. D.A.’s office was the answer.  How many people came up with you?  Just one more and my kids.  Who was the other?  The other D.A. from C.R.   How many more from the judicial office?  Approximately eight more came.  Pretty expensive.  The next witness got up and testified about  raiding Powers' house.  So did the next investigator then they had the Forensic Computer expert friend of Michelson’s, Scott Cooper, up there and that took over an hour.  He was the one who copied the hard drives and was supposed to be neutral.  He was the last person on the stand Thursday.

Friday 10/24 continued with the Costa Rican witnesses which included 2 D.A.'s from Costa Rica.  It appears a total of ten witnesses from CR were brought here on the state of California's dime simply to talk about the taking of the Defendants computers from his house.  They are trying to establish a chain of custody but the defendants' lawyer on cross asked all the witnesses, who packaged the computers, if any of them took the computers to the D.A.'s office to the evidence room and none of them had.  Apparently a Judge was involved in the raid and was the one who personally took the computers to the warehouse where they were apparently stored for the next five months before they were extracted to be copied.  Interestingly the Judge who took the computers did not appear as a witness and none of the witnesses showed any proof that those computers were stored in a locked evidence room.  Then more Costa Ricans testified to their copying the hard drives. Then a guy up there who said he worked for Stewart Title of Costa Rica and was put in charge of delivering the sealed package of hard drives from the D.A.'s office to the Fedex store.  I mean really, they couldn't use an official police official? They used an employee from a Real Estate office.   Then Gary Michelson's friend the computer expert who copied the hard drives in the U.S., testified again basically appearing to agitate the defense attorney and the Judge with his non-responsive answers.

The last 30 minutes saw Gary Michelson get up on the stand with the D.A. asking questions.  It was basically laying more ground work for their foundation of their evidence.  Gary Michelson is expected to testify on Monday and be cross examined by the defense attorney.

As I see it the chain of custody is only as strong as the weakest link. The chain appears to have been broken repeatedly. The Judge who took the computers did not testify. When I went through the police academy we talked about chain of custody of evidence. Every second had to be accounted for. Too many non-official people have touched the evidence. It could have very well been tampered with.

Today's trial update Gary Michelson criminal case, Forbes, billionaire, eccentric pathological liar

Trial began at 1:30 p.m. with five counts of "Grand Theft".  The D.A. started off his with opening statement with a power point presentation.  He outlined the issues talking about trust and theft.  The defense was next slamming all of the D.A.'s presentation and preparing the audience for what they can expect to hear from the alleged victim.  He outlined the relationship between the D.A. and the alleged victim then he presented the evidence that the defense actually tried to reconcile the relationship after they were sued by offering to buy back the properties for a premium.

The alleged victim was next and began his testimony pretty much as the defense lawyer predicted he would.  Court will resume at 10:30 AM continuing with the alleged victims statements.

Crazy day. Hearing began at 9 a.m. DA Knowles not ready to proceed. DA wants to refile all 50 counts which would mean new prelim and another trial date. Count 4 dropped as is duplicate of count 6. Back to Dept 121 Judge Kemalyan for reassignment to new court and judge on September 10. I believe the DA is stalling because they know they have no case. I need to talk to some lawyer friends to try to decipher this. I know the DA has no case as I watched the prelim and other hearings. There was no fraud, no broken contract, no contract in fact, no money lost. Dr Gary Michelson the billionaire made money. Crazy court system. DA needs to shake off Gary Michelson or they will go down with him. DAs have already been reported to Attorney General and the ethics committee. They are under investigation.

Neil has been in LA County jail over a year. I personally feel he's being denied his rights. Yes, he agreed to postpone some things but this is ridiculous. I think they want to keep Neil in LA County jail because it is one of the worst jails in the nation. Maybe they want to break him? If they haven't by now, they never will. The prelim has shown there was no fraud. All but seven counts dismissed. His case is looking better and better every day. I feel the DA, State are abusing their power for the safe of the ex-DA, current DA getting campaign contributions. Maybe the DAs actually believed Gary had a claim in the beginning? The LAPD didn't believe Gary Michelson and previously stated in an almost identical case that there was no crime, no fraud, no embezzlement. LAPD stated Gary is "crazy, liar." Even after the LAPD called Gary a liar Gary continued the lie and said the LAPD were going to arrest his ex-director any day. Gary kept calling me up asking me where he was and I told him. I didn't think a billionaire public figure would lie. I was wrong. Gary lies all the time. I know this from personal experience.

Dr Gary Michelson has previously lost cases where he claimed fraud when he actually lost money

Recently Dr Gary Michelson lost a lost a lawsuit against Proskauer. In that suit he claimed he invested in tax shelters recommended by Proskauer which were not legal. The IRS stated that Gary Michelson owed $48,000,000 in unpaid taxes. Gary Michelson sued Proskauer for a $20,000,000.

Gary Michelson lost the lawsuit because Proskauer stated they offered to help defend a lawsuit from the SEC if there were a lawsuit. There was no lawsuit. Gary Michelson just gave the SEC the money they requested. Proskauer stated they gave no other promises. In this case Gary Michelson "lost" $48,000,000 and lost the case. There was no malpractice.

In another lawsuit Gary Michelson sued an appraiser who incorrectly valued a property higher than what it was worth. Gary Michelson gave a second on the property based on that value. The owner defaulted and the property went to foreclosure sale. Gary Michelson for some crazy reason bid the price of the first and his second. He then went to sell the property and could only get the price of the first.

Gary Michelson lost that lawsuit even though he lost money. He lost because Gary didn't have to bid the price of the first and second. He could have bid the price of the first and more than likely would have then owned the property. Or he didn't have to bid at all. Had he not bid and it sold for only the price of the first, Gary might have had a case if he could prove the initial appraisal was wrong.

Back in 2007 there was a third false claim of fraud involving Gary Michelson. Gary claimed his ex-director embezzled money. Gary Michelson reported this to the LAPD. LAPD stated there was no evidence whatsoever of any crime. They refused to press charges. After this Gary Michelson kept telling people the LAPD would be arresting his ex-director any day for fraud. The ex-director then sued Gary Michelson for defamation and received an instant settlement.Gary Michelson has so far cried "wolf" three times that I know of and there was never a wolf.

This brings up to the civil case against Neil Campbell and Richard Powers. Gary sued Campbell and Powers for fraud stating he lost money. Gary Michelson didn't lose any money. The only reason he won the civil lawsuit was because I believe he committed motion abuse to the point the defendants could not respond and lost by default.

Today is the beginning of the criminal trial dealing with the same issues as the civil case. In this case no money was lost or stolen. No property was stolen. There was no agreement for a six percent commission. There was an agreement for cost to plant trees only. There was no signed contract guaranteeing a specific return on investment. Gary Michelson merely bought and received land for a price. There was no fraud.

It will be interesting to see how things play out in this trial. One major issue is the inappropriate and most likely ethics violation caused by the personal relationship between Gary Michelson and DA/ex-DA Steve Cooley and DA candidate/current DA Jackie Lacey. There were very suspicious campaign donations which were given right before action was taken on this case. There was a private "thank you" lunch with the DA's office and Gary Michelson.

It will be interesting to see if there will be justice in light of Gary Michelson's history of crying "fraud" when there was no fraud. It'll be even more interesting to see if Gary's relationship with the DA will influence this case. Fortunately there is a jury trial so it won't be up to a Judge.
