Jury verdict is bizarre, doesn't make sense. Thoughts on the verdict, Gary Michelson

This decision against Powers/Campbell is really bizarre.  They started with 140 counts of "Grand Theft" with a maximum of 3 years per count.  That's like 420 years on the Max side or 105 years on the low side. ($32M + $2M he got from Neils' house and millions from sales of timber over the last 8 years that was not allowed in)   Then the counts got reduced to 49 counts, still looking at 150 years.  Then through Prelims it gets reduced to 6 counts, then Knowles adds the count of conspiracy (7 now) because he knows he's got no evidence to support a theft or loss. Powers owned and flipped properties to Michelson and made him Millions of dollars ( not to mention Michelson is still sitting on close to 10,000 acres of Costa Rican property, with approx. 4,000 acres of ocean view lands according to testimony by Andres Marten, his farm manager and David Cohen, his CFO for Karlin Holdings.

Then there's a trial on Aug. 25th and the case is dismissed because Knowles is not ready and he'd doubled up on one of the counts.  So one more count is reduced, back down to 6 counts.  A new trial begins Oct. 16th and on that day the Judge dismisses the "conspiracy" count because it was "timed barred" by the statue of limitations.  Now they are back down to 5 counts of "grand theft".  Remember, grand theft is anything over $400.  Knowles files a new motion to add another count, now of "Maintenance Fraud".  When the Judge asks Knowles if he has any supporting evidence he says, "Yes", but can't support it so the Judge denies the motion.  Knowles then adds enhancements to the "grand theft" charges.  Judge accepts these assuming the Jury will find that monies were in fact stolen in the amount over $500,000 relating to a pattern of theft or for a total loss of over $2.5M.

So the Jury decided that count 1 was timed barred because Michelson admitted on the stand that he had received and paid for this property before the date of March 26th 2006.  Michelson admitted that he had paid and received all of these properties before Jan. 1st 2006 so if the Jury "timed barred" #1 then they would have had to "time bar" all of the counts.  On 3 counts they were found "Not guilty" to the "taking of money" but on count 3 they were guilty?  How is that possible when it was proven that not only was no money taken from Michelson but in fact he had made millions!  Maybe Neil and Richard stole Gary's "I phone", but it wasn't mentioned in the proceedings.  That's worth over $400, right?  Yes, that's what Richard and Neil are basically charged with, a theft of over $400, but what is it?  Where is it??  I hope the Judge investigates this decision and pulls the phone records of Juror # 5 and Michelson's attorneys.  I'm sure they will find some connection there.  Something happened over the weekend.  Knowing the influence of Michelson these Juror's should have been sequestered or at least Juror #5.

Last Friday, after the closing arguments, several people witnessed Michelson barge through to the D.A.'s bench and tell Knowles, "He needs to fix this".  What happened over the weekend?  Did Michelson's people get to Juror # 5?  What was he offered?  Is it possible he was influenced or threatened in any way? Did Knowles help him "fix it"..  Even Knowles seemed shocked with the decision as did his investigator Villasenor, who was sitting in the back row with the rest of the audience and laughed when he heard the verdict "guilty".

I'm sure they will appeal this and hopefully in the meantime it will be investigated.  Something is just not right here.  I smell a big "Rat".  Good news, Neil is free and won't spend any more days in Jail. He's more than done his time for making Michelson a richer man than he already is. Both of them made Michelson a lot of money.  What kind of Justice is this.

"Michelson took the Book, He's the Crook".  He's the one that belongs in Jail. He also perjured himself repeatedly in writing and in court room testimony. He really needs to be charged for filing a false criminal complaint and perjury besides theft.

NEIL IS FREE! Neil and Richard found guilty on only one charge and no enhancements.

Neil was released at 4:12 pm for time served. DA wanted to remand Richard back into custody but Judge said "frankly I am surprised by this verdict. I will not remand him back into custody."

Jury reached the verdict at 3:00 p.m. Of the five counts they were found guilty of count three only. They were found not guilty on count one due to statute of limitations. They were found not guilty on the rest of the counts. There were no enhancements. They wanted to enhance sentencing if found guilty of fraud over $500K or $2.5M.

I am also surprised they could be found guilty on count three. One thing I'm not surprised about is that odd juror number five was indeed the foreman as I predicted. I'm sure he led the vote in the direction it went.

The Judge gave a stern warning to the DA telling him to tell Gary to not contact the jurors in any way, either directly or indirectly.

December 9, 2014 is their sentencing hearing S120 again. The maximum sentence would be three years. Judge Craig Richman already released Neil Campbell on time served. He was in jail for over a year and a half. Judge will most likely give Richard probation as he has no record.

Gary Michelson will probably still be upset that the money he gave to the DA didn't buy him maximum sentences. I personally feel they should appeal. How could they possibly have been found guilty on any charge for any reason? They did not take money or property from Gary Michelson. Gary was the idiot who did not sell before the crash. I think Gary is being taken by David Cohen and Andres Marten. They should have advised Gary to sell if money was his main goal. Of course if he did that David and Andres might not have jobs.

What evil thing will Dr Gary Michelson do next? Will he force the DA to reprimand, demote, fire Robert Knowles? Will he get mad at the DAs for not throwing his friends in prison for years after he gave the DAs money? Will he try to attack Neil and Richard in some other way?

Sentencing is December 9, 2014. They were charged as a felony so maximum sentence is three years in state prison. "Penal Code section 487(a) is grand theft. It's a "wobbler" in California, which means it can be charged either as a felony or a misdemeanor. As a felony, it carries a maximum of 3 years in state prison. As a misdemeanor, it carries up to a year in county jail." As Neil and Richard have no priors, they should get probation. Neil should get nothing because he was in jail for a year and a half already.

Jury resumes Monday 11/3 at 9:00 a.m. We could have verdict by 12 noon. Gary Michelson

I have some concerns about the main young white male juror. The other jurors look to him. He gave advice to other jurors before the hearing about unrelated things. He seemed to be taking notes or drawing. I could not tell from my seat. I would bet he would be the foreperson. I think the other jurors who were sleeping don't care about the case. They will go with the majority or foreperson.

Closing arguments today at 10:00 a.m. Dr Gary Michelson criminal trial

The Judge denied the motion to dismiss today so the Jury will hear closing arguments tomorrow at 10 AM. Probably will be Monday before the Jury finishes deliberations but it could happen tomorrow.
It is expected the D.A. will go first for about an hour then the Defense will go for about and hour then lunch then the People will get another rebuttal, probably for 30 minutes or so, then the Jury will go out in deliberation. We should hopefully have a verdict by Monday.

Based on what I saw in court the 28 year old or so man in the middle back row will control the jury. He seems to be the most educated and was interested in the case and paying attention. He was taking notes or drawing, hard to tell from where I sat. I hope he can see the real issues here. We have an eccentric billionaire mad man who is a pathological liar who committed perjury repeatedly. "There is a contract. There isn't a contract. There was an agreement. There was no agreement. I have 2,000 acres. I have 5,400 acres. They stole from me. I lost money. I actually made 80M on a 23M investment but sold after the market crashed."

Said mad man got personally upset because his friend didn't want to be friends anymore. Mad man decides to sue him so he could paper him to death just to be mean and nasty. Gary has done this before. Gary said I think he spent $50M in legal fees fighting Medtronic. He would sue Neil and Richard until they couldn't afford to reply and would then lose by default.

Crazy Gary wins the civil case but does not have the pound of flesh that he desires. He decides to file a criminal complaint in Costa Rica. Costa Rica DA says no crime was committed. No money was stolen or lost. Gary then decides to bribe the California DAs with money so they will go after his ex-friend in criminal court. His DA friends oblige and file criminal complaints. Gary takes them out to lunch to personally thank them for being his henchmen. DA lets Gary stand next to him in a DA press conference about dog fighting. Gary gives DA Cooley an award with a pic of his dead dog's head on a platter.

And here we are today. The verdict will be interesting. I wish they'd reach a verdict by this afternoon. I see the case as pretty simple. Neil, Richard offered Gary land for a price. Gary agreed and bought the land for the agreed price. Gary received the land. The land went way up in value. A $23M investment became an $80M investment. The market crashed. Gary ended up selling part of the land for $36M I think. No money was lost or stolen. Gary recently said he put more money into the land after he bought it. That was his decision. Neil and Richard didn't tell him to do that. Gary put that money in when Andres Marten was in charge after Neil and Richard were gone. Maybe Marten should have advised Gary not to put more money into the land. I have a feeling Marten is making beaucoup bucks off of Gary by pretending to be the honest guy who has his back. I didn't believe all of his testimony. You could see he was lying at times. Neil and Richard couldn't respond to his assessments of the land as they had no records. I would bet that Marten might have made up the story of the land and trees being crappy just to garner Gary's trust so he could milk him for salary and seedling fees. "Estos arboles son malos. Tu tienes que comprar MIS arboles. La tierra es terrible. Tu tienes que darme dinero para trabajar a mejorar la tierra o yo puedo venderte mi tierra buena." Translated, "These trees are bad. You have to buy my trees (seedlings). The land is terrible. You have to give me money to work to improve the land or I can sell you my good land."
