UPDATE: I was hoping they'd update Pacer so I could just post that but no. The below is what happened at the hearing.
Powers granted bail pending the posting of a $750K property bond on his behalf. Could be out of jail in a week but after all the games the DA played in the criminal case with bail it may be longer.
At the hearing Judge Sagar listed the following "special circumstances" for bail release.
1. There is cause to believe this is a case of double jeopardy and would be in Richard's favor to overturn an extradition claim by Costa Rica.
2. There is an apparent lack of "diplomatic necessity" from Costa Rica based on the facts presented which show it was nearly ten years since the original criminal complaint was filed in Costa Rica to the time that a request was officially made from the Costa Rican government in April, 2017.
3. Based on all the letters received from family and friends, as well as the strong showing of support in the courtroom, the court finds that Richard has strong family support and ties to the community, which has been ruled in other cases as a "special circumstance." Thanks to everyone who showed up at the hearing!
4. The last "special circumstance" cited by the judge was that it is clear from the record that Richard never attempted to flee and even when on bail during the criminal case for nearly four years (he was released on bail Sept 5, 2013), demonstrated that he was abiding by the law, and therefore should not be considered a flight risk.
The US attorney made a pretty desperate plea to the Judge as to why Richard should not be allowed bail. Judge didn't budge. Gary will probably be fuming, ranting and raving at his "justice consultant" Steve Cooley and the US Attorney. For the US attorney to make a desperate plea when he knows he's in the wrong shows the level of corruption. Same happened in the US criminal case.
This of course means nothing at the moment. Previous Judges acted fair for a hearing or two only to cave later to political pressure.
Another friend of Richard's sent in a glowing letter for him. It was filed with Pacer.

Justice Richard Mosk retires from this case and the bench after medical leave - Gary Michelson lawsuit
January 22, 2016 Justice Richard Mosk left the bench for medical leave in this case right before they were about to release the opinion. Oral argument had already been done. They had to get another Justice then parties waived oral argument.

I assume Richard Mosk must really be very sick to take medical leave and then retire. I hope he just decided to retire when he was out ill. I hope he's okay.
LOS ANGELES—Associate Justice Richard M. Mosk of the Court of Appeal, Second Appellate District, Division Five (Los Angeles), will retire on March 31, 2016, after nearly 15 years on the bench.
In his March 18, 2016 letter to Governor Edmund G. Brown Jr., announcing his intent to retire, Associate Justice Mosk wrote, “It has been an honor and a privilege for me to serve as a Justice of this Court.”
Justice Mosk was appointed by Governor Gray Davis to the Court of Appeal in 2001, and was subsequently retained by vote of the people in 2002 and again in 2006. Before his appointment, he was in private practice in Los Angeles for 23 years as an associate, partner, and principal. During this time he also served as a Special Deputy Federal Public Defender, a judge and substitute judge on the Iran – U.S. Claims Tribunal, and as chair and co-chair of the Classification and Rating Administration of the Motion Picture Association of America.
Administrative Presiding Justice Roger Boren commented, “Justice Mosk was a very talented justice, with considerable experiences that made him a very interested and high energy judge. I was very fond of Richard. He often arrived early at the court—even after he became burdened with age—and we sometimes engaged in morning conversations on the topics of the day, which I shall personally miss.”
Justice Mosk was a member of staff to the President’s Commission on the Assassination of President Kennedy (Warren Commission), and a law clerk to Supreme Court of California Associate Justice Mathew O. Tobriner. He served on active duty in the air police unit of the California Air National Guard and as an officer in the United States Naval Reserve. Justice Mosk was a member of the Independent Commission on The Los Angeles Police Department (Christopher Commission), Los Angeles City-County Board of Inquiry on Brush Fires, Los Angeles Commission on Judicial Procedures, Board of Trustees of Los Angeles County Law Library, Board of Directors of the California Museum of Science and Industry, Board of Directors of Town Hall California, and Stanford Athletic Board. He has taught course and given lectures in law schools and universities in the United States and internationally, and has published numerous articles for law reviews and newspapers.
Justice Paul Turner, the presiding justice of Division Five of the Court of Appeal, Second Appellate District who served with Associate Justice Mosk for 15 years said, “This concludes nearly seven decades of service by the Mosk family as members of the judicial branch of government. No other California family has given so much of their lives in sustained service to people of California as members the California judiciary.”

Request for letter response from Appellate Court Judges - Gary Michelson case
I don't know why I didn't receive notification of this as I'm signed up to this case. Fortunately I happened to check the docket manually.
I think the Appeals Court wants to give Appellees i.e. DA, absolutely every chance to prove that there was theft. If I remember, the deeds the DA wanted to submit to the court were all in Spanish. The Judge refused them as they had not been transcribed into English by an independent translator. There was no other proof of what Defendants paid for the land. The DA only had proof of what Gary Michelson paid Defendants for the land.
Another thing to consider is let's say Defendants paid $100 for the land. They still had to pay to clear title, clear squatters, escrow, title, remove liens.... After the land met all of Gary Michelson's requirements then Gary would buy it. If they paid $100 for the land then spent $100 to clear it, Defendants would have been in the land $200. If Gary Michelson paid $200 for it, there would be no net gain to defendants.
Even if Defendants paid $100 for the land, invested another $100 to clear it over the course of a year, then they sold it for $1,000, that still would not be theft. They used their own money to buy the land and clear it. The most important thing would be what the land was worth. If Gary paid $1,000 for a piece of land worth $1,000, he lost no money. In this case Gary made a huge profit on the land. I would gladly pay $200 for a piece of land worth $1,000 any day of the week.
As the request is due 12/18, I will assume there will be no opinion until after the new year with holiday recess.

The People's theory of the case was that the amount of money that defendants stole in count 46-i.e., the gravamen of the offense-was the difference between the price at which defendants arranged for the properties specified in count 46 to be acquired and the sales price they presented to and was paid by Dr. Michelson. Defendants contend that insufficient evidence supports their convictions because there is no evidence of the original price for the count 46 properties. [...]

What happened to Robert Knowles the Deputy DA from the Gary Michelson case?
He's still listed in the California Bar Association directory as working at the LA County District Attorney office. The only mention of him in their website now is from this press release about the Gary Michelson case. Previously they omitted this result from searches.

Politics of the judicial system - Gary Michelson, Forbes billionaire, patent, spine
After sitting here for the past week mulling over the sentencing hearing I think I'm finally getting my head around it. Perhaps all is not what it seems. I am thankful that Neil and Richard are out of jail and will never be going back to jail. Previously they were looking at life in prison based on all the charges and related charges that could up the time. Gary Michelson is of course extremely upset that he couldn't throw them in prison for life even after paying off the DA. While I still feel the Judge did not rule properly on sentencing I think I understand why.
Our judicial system here in Los Angeles is corrupt. There is no doubt about that. I worked for the City of Los Angeles. I saw it first hand. I saw employees lie, cheat, steal, commit perjury, fraud....The fact that the DA hired a real estate appraiser to appraiser an easily $10 million home for a measly $3.5 million is factual proof. To see the DA get up there and try to argue that the $3.5M appraisal was accurate was truly pathetic. Robert Knowles is a smart man. There's no way he believed his argument or that appraisal. He was intentionally lying to the court. He was committing fraud upon the court by giving the judge a fraudulent appraisal. Fortunately Judge Rene Korn realized this and ruled that the property was more likely worth $10 million. Richard was then allowed out on bond.
Here in LA and in most cities and countries a wealthy person will give money to a politician. The wealthy person wants a favor from the politician. In this case Gary Michelson gave money to DAs Steve Cooley and Jackie Lacey. I believe Gary also gave Cooley money in the form of "consulting fees." In exchange the DAs used their influence to charge Gary's ex-friends with a non-existent crime. Gary intentionally went to the DA because the last time he tried to file a fraudulent criminal report with the LAPD he was denied.
The DAs used their influence to falsely charge Neil and Richard with crimes. They instructed their Deputy DAs Robert Knowles and his partner to pursue the case. They instructed their detectives to investigate. They allowed them to use vast sums of money to fly LA DAs to Costa Rica. They also used city and county funds to bring "witnesses" from CR to LA. I may do an info act request to find out just how much money was wasted in this fraudulent investigation.
The DA used their powers along with the state attorney general and federal government to arrest and extradite Neil and Richard from Idaho and Texas respectively. The DA threw them in LA County jail one of the worst in the nation. The DA dragged their feet in the investigation to intentionally keep them in jail in horrible conditions. Perhaps they hoped they'd cop a plea, lie about each other, break them down. Or perhaps they were just following Gary's instructions to torment, punish, abuse them as much as possible.
The DA finally present their case at the preliminary hearing. Almost all of the charges are dropped due to statute of limitations, lack of evidence. The charges are whittled down from I think 140 to five. At the end of the trial defendants were only found guilty of one charge. It makes no sense as that one charge was barred by statute of limitations. I personally believe that one of the jurors was a plant. He was very different than the other jurors. The second I saw him I knew he'd be the lead juror and he was. None of the other jurors cared at all. I saw three of them sleeping at the same time.
Finally the case is at the sentencing phase. Jonathan Michaels did a wonderful job with this case. He argued that the one charge should be reduced from a felony to a misdemeanor and dismissed. Based on case precedent and law it should have been dismissed. Richard and Neil would have been exonerated. That is what should have happened. Instead Judge Craig Richman made some very questionable and appealable decisions. He refused to rule on restitution. He refused to reduce the charge or dismiss it. He stated paraphrased "I've been wrong in the past. I invite you to appeal the decision."
I believe Judge Craig Richman did not want to rule because his job, livelihood would have been in jeopardy. He probably would have been demoted, transferred to traffic court in a horrible area miles from his home. I've seen this happen many times in Animal Services. I think he previously must have done something to piss off the city attorney. That battery case should have never been filed against him. When someone hit me LAPD said they'd only file charges if I had broken bones or profuse bleeding which caused me to go to the emergency room. The LAPD detective told me "it's legal to hit someone."
The DA filed a frivolous criminal case against Neil and Richard as a personal favor to Gary Michelson in exchange for money. Deputy DA Robert Knowles was forced to put forth a shamble of a case just to appease the DA so he also doesn't get a bad assignment. In the end Judge Craig Richman did not rule according to evidence, case precedent or the law. The case will be appealed and reversed by three appellate judges. Hopefully by then enough time would have passed so Gary Michelson will not want to continue to destroy Neil and Richard. If Judge Craig Richman had dismissed the one charge Gary would have been irate and would have continued to destroy them, DA, Judge. There would have been heaps of negative media and other attention on the DA's office. As it is the civil case is still open and perhaps a criminal case in Costa Rica. Gary has taken absolutely everything from these two people. They are penniless, homeless, jobless. Knowing Gary he will soon find someone else who is "profoundly cheating" him and he will try to destroy that person. He's been doing this his entire adult life. Who will be his next victim? David Cohen?

Judge Craig Richman should have reduced charge to misdemeanor then dismissed it
This next bit confirms my thoughts about the improper ruling by Judge Craig Richman. It really boggles my mind that the Judge should have reduced it to a misdemeanor then dismissed it based on case law but he chose not to. He had this case to back his decision but decided on his own not to rule. He will now force Neil and Richard to live out three or four years of appeal hell. They can't get a job, Richard can't leave the state... And all for what? So Judge Craig Richman can continue being a judge with the support of the DA. He doesn't want to piss anyone off so he doesn't have to deal with the City Attorney allowing another crazy person to file assault charges against him. I would like to note in that case Judge Craig Richman was not 100% innocent it turns out. The crazy lady threw a bag of dog shit in his car. He then as per his own statement pushed her. He also lied and told her he was a police officer. That is a crime in and of itself. Then she pushed him. During that case he had to step down from the bench during the investigation and trial. Below is an almost identical case to the Powers/Campbell case in which the defendants were convicted of felony charges but the Jurors made no restitution or findings in the amount over $400 so the Appellate Court ruled them misdemeanors from felonies. This is now "CASE LAW." Jonathan Michaels argued this case after lunch with the Judge saying, "lets forget about prop. 47 for a minute and look at this CASE LAW which makes published findings that you must reduce the count to a misdemeanor as the findings are identical to our case".
Judge Richman basically said, "that's a very good argument Mr. Michaels but I'm sticking with my earlier decision to NOT RULE, I may be wrong and I've been wrong before and you may be right and I invite you to appeal, and I expect you will, however I am letting the Jurors decision on one count of Felony Grand Theft to stand and I will not rule on a presumption of knowing what the Jurors decision would have been as far as restitution."
Jonathan then argued that is exactly the point and said, "Upon the failure of the jury to so determine, the degree of the crime with no stated restitution amount then it shall be deemed to be of the lesser degree, a misdemeanor by the court.”

Since 2008 the amount of petty theft misdemeanor has been raised to $950 from the previous $400. Still the Judge did not even find a restitution in the amount of over the misdemeanor threshold.

A jury convicted defendant Sumaria Love of 15 counts of various identity theft-based offenses arising from abuse of her position of trust as a dental receptionist.
On appeal, defendant makes four claims: (1) her conviction in count eight of fraudulently using an access (credit) card was only an attempted offense; (2) the prohibition upon dual convictions for theft and receipt of the same property bars her from being convicted both of fraudulent use of an access card in count twelve and receiving stolen property in count fifteen; (3) her felony convictions in counts four, eight, twelve and thirteen must be reduced to misdemeanors because the jury never determined the amount taken; and (4) the trial court's imposition of an upper-term sentence violated her rights to a jury trial and due process under the Fourteenth and Sixth Amendments.
The published portion of this opinion encompasses defendant's first three claims and we agree with the latter two of them. Accordingly, we strike defendant's conviction in count fifteen and remand the convictions in counts four, eight, twelve and thirteen for re-sentencing as misdemeanors. We disagree with defendant's first claim. In the unpublished portion of this opinion, we reject defendant's fourth claim.
Background
Counts Four, Eight, Twelve, and Thirteen as Misdemeanors Based on Amounts Taken Not Determined⌑ Defendant next contends that her convictions for grand theft in counts four, eight, twelve, and thirteen must be reduced to misdemeanors because the jury did not find that the value of the items obtained exceeded $400. The People have conceded the merit of this argument, and we agree.
In counts four, eight, and twelve, the jury convicted defendant of grand theft under section 484g, subdivision (a). Section 484g, subdivision (a) provides, “[I]f the value of all money, goods, services, and other things of value obtained in violation of this section exceeds four hundred dollars ($400) in any consecutive six-month period, then the same shall constitute grand theft.” Otherwise, the statute dictates the proper conviction as “petty theft,” a misdemeanor. (See §§ 484g, subd. (a), 488, 490.)
In count thirteen (the postage meter), the jury convicted defendant of embezzlement, a form of theft, under section 508. (§ 490a.) Embezzlement is punishable as grand theft if the value of the property taken exceeds $400 (§ 487, subd. (a)) or “[w]here the ․ property is taken by a servant, agent, or employee from his or her principal or employer and aggregates four hundred dollars ($400) or more in any 12 consecutive month period.” (§ 487, subd. (b)(3).) Otherwise, it is punishable only as petty theft. (§ 488.)
In all four of these counts, the jury was required to determine the degree of the offense under section 1157, which provides: “Whenever a defendant is convicted of a crime or attempt to commit a crime which is distinguished into degrees, the jury ․ must find the degree of the crime or attempted crime of which he is guilty. Upon the failure of the jury ․ to so determine, the degree of the crime or attempted crime ․ shall be deemed to be of the lesser degree.” The People acknowledge that section 1157 applies to defendant's case. Below is an almost identical case to the Powers/Campbell case in which the defendants were convicted of felony charges but the Jurors made no restitution or findings in the amount over $400 so the Appellate Court ruled them misdemeanors from felonies. This is now "CASE LAW." Jonathan Michaels argued this case after lunch with the Judge saying, "lets forget about prop. 47 for a minute and look at this CASE LAW which makes published findings that you must reduce the count to a misdemeanor as the findings are identical to our case".
Judge Richman basically said, "that's a very good argument Mr. Michaels but I'm sticking with my earlier decision to NOT RULE, I may be wrong and I've been wrong before and you may be right and I invite you to appeal, and I expect you will, however I am letting the Jurors decision on one count of Felony Grand Theft to stand and I will not rule on a presumption of knowing what the Jurors decision would have been as far as restitution."
Jonathan then argued that is exactly the point and said, "Upon the failure of the jury to so determine, the degree of the crime with no stated restitution amount then it shall be deemed to be of the lesser degree, a misdemeanor by the court.”

Since 2008 the amount of petty theft misdemeanor has been raised to $950 from the previous $400. Still the Judge did not even find a restitution in the amount of over the misdemeanor threshold.

A jury convicted defendant Sumaria Love of 15 counts of various identity theft-based offenses arising from abuse of her position of trust as a dental receptionist.
On appeal, defendant makes four claims: (1) her conviction in count eight of fraudulently using an access (credit) card was only an attempted offense; (2) the prohibition upon dual convictions for theft and receipt of the same property bars her from being convicted both of fraudulent use of an access card in count twelve and receiving stolen property in count fifteen; (3) her felony convictions in counts four, eight, twelve and thirteen must be reduced to misdemeanors because the jury never determined the amount taken; and (4) the trial court's imposition of an upper-term sentence violated her rights to a jury trial and due process under the Fourteenth and Sixth Amendments.
The published portion of this opinion encompasses defendant's first three claims and we agree with the latter two of them. Accordingly, we strike defendant's conviction in count fifteen and remand the convictions in counts four, eight, twelve and thirteen for re-sentencing as misdemeanors. We disagree with defendant's first claim. In the unpublished portion of this opinion, we reject defendant's fourth claim.
Background
Counts Four, Eight, Twelve, and Thirteen as Misdemeanors Based on Amounts Taken Not Determined⌑ Defendant next contends that her convictions for grand theft in counts four, eight, twelve, and thirteen must be reduced to misdemeanors because the jury did not find that the value of the items obtained exceeded $400. The People have conceded the merit of this argument, and we agree.
In counts four, eight, and twelve, the jury convicted defendant of grand theft under section 484g, subdivision (a). Section 484g, subdivision (a) provides, “[I]f the value of all money, goods, services, and other things of value obtained in violation of this section exceeds four hundred dollars ($400) in any consecutive six-month period, then the same shall constitute grand theft.” Otherwise, the statute dictates the proper conviction as “petty theft,” a misdemeanor. (See §§ 484g, subd. (a), 488, 490.)
In count thirteen (the postage meter), the jury convicted defendant of embezzlement, a form of theft, under section 508. (§ 490a.) Embezzlement is punishable as grand theft if the value of the property taken exceeds $400 (§ 487, subd. (a)) or “[w]here the ․ property is taken by a servant, agent, or employee from his or her principal or employer and aggregates four hundred dollars ($400) or more in any 12 consecutive month period.” (§ 487, subd. (b)(3).) Otherwise, it is punishable only as petty theft. (§ 488.)

Final sentencing results today in Dr Gary Michelson criminal trial, ex-Forbes billionaire, crazy person extraordinaire
UPDATE: Judge Craig Robert Richman seemed fair and just at trial until the very end. Of course the very end of the trial is all that matters. I just realized that he and Gary Michelson are major water skiers and both own water ski homes in Arvin, California minutes from each other. Craig's son competes in water skiing. So did Gary, Neil and Gary's ex-wife. Gary's ex-wife's family are major water skiers in that area. I would think Richman would have run into Gary's ex-wife's family up there.
Craig Richman also worked for the DA's office for 19 years. Of course most criminal court Judges probably worked for the DA but Richman worked directly under Steve Cooley "Richman, 47, a Republican from Chatsworth, worked most recently as a calendar trial deputy at the downtown criminal courthouse. He also served as an assistant head deputy and a supervisor of the Target Crimes Division under Dist. Atty. Steve Cooley. Richman prosecuted crimes against police officers and hundreds of felony trials." Seems Judge Richman endorses and supports the same people Steve Cooley and Jackie Lacey endorse.
Richman went to Arizona State for undergrad and McGeorge law school in Sacramento. Those are odd schools to go to if you are going to be a lawyer in Los Angeles, California. He started with the DA straight out of law school in 1986. 19 years in the DA office he should really know what's going on in this case. I'm sure he understands the politics involved in LAPD, DA, political candidates, Judges, campaign donations, money, favors....He worked for the DA under Steve Cooley and now under the new DA Jackie Lacey. In 2005 he was appointed by Schwarzenegger as judge for LA Superior Court. Perhaps it's just a really small world. All I know is Robert Knowles and Craig Richman obviously picked the short straws to get stuck with this case. Gary will try to ruin Knowles who did the best job he could with no evidence and his one witness committed perjury repeatedly. That's probably why Judge Richman refused to rule on the motion to dismiss the one charge. He doesn't want to be a target or have an issue being re-elected as Judge. He doesn't want to end up like Judge Goodson only hearing restraining order cases. He will gladly hand this mess over to three appellate judges who will hopefully be more distanced from the politics involved. He saw Gary go after Knowles in the court room. He knows from this case how low, vindictive, crazy and evil Gary Michelson can be. Gary probably would have tried to destroy Judge Craig Richman if he reduced and dismissed the one count. Now Neil and Richard have years of hell waiting for the appeal. They can't get a job, have a bank account, rent a place, lease a car, have a life....

I finally was able to gather some information and piece things together. They were each found guilty of one count of fraud by trickery. Neil got two years suspended sentence because he was in jail for one year and four months. Richard got three years suspended sentence to probation. Some was suspended because he was in jail four months. Neither is going back to jail unless they violate probation. Richard's probation is in California. He can't go home. In fact because of this ruling they can never get a job again unless they win on appeal. You can't sell real estate or cars, the only jobs they've ever known, if you've been convicted of felony fraud.
The count should have been reduced to misdemeanor then dismissed based on prop 47 and they have no priors. Plus, count was barred by statute of limitations and jury did not find that one penny was stolen. I think felony is $900, misdemeanor is $450 or less. They both have perfect probation records, i.e. no priors. See the motions in the previous post.

I used to think I'd like to be a judge so I could rule fairly based on law and evidence. I know, incredibly naive. I have since realized that being a judge has NOTHING to do with fair rulings, law or evidence. It has to do with campaign donations, endorsements by the DA, LAPD, other Judges, politicians and being elected. Actually being elected comes in dead last. Most Judge's in LA don't even have to campaign because they run unopposed. No one wants their job. If you're a good attorney, you will make much more than a Judge. I think some Judges are appointed in appeal and supreme court.
A criminal appeal can be fast tracked. It should be in this case as these people are stuck in California away from their homes and families. They can't get a job. They will have to sign up for welfare, food stamps and medi-cal. The appeal could take two years easily. They should get a free attorney for the appeal I believe. It's just so sad that this Judge could have settled this fairly today but chose not to. He now forces these two people into two to three years of hardship, poverty, seclusion from their family, inability to work, get a job, provide for their family...not to mention mental and physical stress.
Dr Gary Michelson is extremely evil and mentally ill. I'm going to try to get the minutes from today. He got up there and lied about everyone and everything. He perjured himself in my case as well. I wish I could have gotten up there and told the Judge that Gary has a very long history of lying, perjury and fraud though I'm sure the Judge realizes this.
It is a horrible miscarriage of justice what has happened in this case. Gary Michelson using his money, power and connections to get people to do what he wants. I remember the day when he said he wanted the Mayor to do such and such. I said "well, you're going to have to give the mayor a lot of money." He said "okay, do it." I said "it has to be legal campaign contributions. You can't just give them money, bribe them!" What do I know.
I guess Neil and Richard should be lucky that the 140+ charges were reduced to seven, six were dismissed and they were only found guilty of one charge. They could have been looking at life in prison. Still, no money was stolen, taken. Gary Michelson made a lot of money from Richard and Neil. Let this be a lesson to all. NEVER EVER do business with Gary Michelson. It's not worth it. I wish I never worked for him. He is an evil, nasty, little man.

You can be a billionaire. You can bribe the ex and current DAs with money, money, money. You can take them out to lunch to thank them for taking your bribe in exchange for filing false criminal charges against your ex-boyfriend. You can even admit to that in a court of law. You can give USC $50 million dollars to try to help your shitty and crazed reputation. You can pay people to write false positive articles about you. But, if you get up on the stand in public court with live jurors and the media watching and reporting, swear to tell the truth, lie and commit perjury...

Tuesday morning started with testimony from Michelson defending his position for bringing the lawsuit to his "good Friend" Steve Cooley, the then head D.A. of Los Angeles. He explained his role with the Found Animal Foundation and why he was at the press conference for animal cruelty. He said he was trying to save animals and at that particular meeting they had arrested a "really bad guy", who abused a dog and also had cocaine and guns. When questioned about the D.A.'s luncheon in the letter shown to the Jury, the D.A. objected, which was overruled. Michelson and many high level officials were invited and he paid for the luncheon. He then began with a completely unsupported story about Campbell paying Powers a $1,000 a month salary for years as manager of C & M, even though it was already proven, by amended contract, that Michelson was the actual manager, not Powers. Another new story out of the blue from Michelson.
He then told the story of meeting Andres Marten who became his new farm manager and how the properties were only planted to 30%. Again this didn't prove anything or have anything to do with the five counts of "grand theft".
He's now trying to cover his mistake he made in his testimony yesterday so he changes his story to the Defense lawyer. Originally he claimed he sent all the money in advance to purchase the properties from Powers but now he realized this might go against his issue with the statue of limitations so today he began stating that he only wired deposits and paid for the properties in whole much later. So here he impeaches himself again.
The defense lawyer asks him again how many acres he had sold and again he says most of the properties. When asked how much he has left he says he has 2,000 acres left. Yesterday he claimed he had invested $36M into all these properties. Today he was asked the same question and he now says he's invested, $43.8M into this plantation.
Defense lawyer asks him, "did you pay for all these properties", yes was the answer. "Did you receive all the titles to these properties", yes was also the answer. Asked again on how many acres he owns still he says, "Less than 2,000 acres".
Next witness is David Cohen his business manager since 2005. He says he met Michelson in 2000 but started working for him full time until 2005 advising him and running and managing all his businesses including his accounting. Started trying to get Powers to give him his records but said Powers was disorganized and so he at one point yelled on the phone at Mr. Powers saying he was going to sue Powers for $20M if he didn't give him the bank records. Michelson couldn't figure out how much profits Powers was making and he wanted to know because he didn't want Powers to make any money. This is typical Gary. Only he can make money. Everyone else has to work for free. Then he said he participated in hiring the farm manager, Andres Marten, in C.R.
On cross the defense attorney asked him about how long he worked for Michelson. A: 9 years. Q: did you run the financial business and accounting of C & M and the teak farms in Central America and Costa Rica? A: Yes. Q: How much was invested totally in the Costa Rican Teak farms?" A: $20 Million dollars, Q: Michelson is the largest teak plantation owner in the world?", A: NO, Q: He's not at least one of the largest plantation owners in the world?", "No". Q: Please turn to exhibit 114. You gave an interview to the magazine, "Financial Adviser" (which I posted here) where you state and claim that Michelson is the largest teak plantation owner in the world, isn't that correct?", A: well that's what it says here, but I didn't write that". Q: "But you gave the interview didn't you so did you say that?", A. Yes, but that was in 2011". Q: So in 2011 it was the largest plantation in the world but not now?"A: That's right. Q: you recently sold some of the teak farms correct?", A: Not in Panama only in Costa Rica.Q: How much of that land did you sell in Costa Rica?", A: about half. Q: about half, so does that mean Michelson still owns the other half of his farms in Costa Rica?", A: That's correct, he owns about half of them, we sold off just the half in C.R. but kept all the farms in Panama. NO further questions was the response from the Defense lawyer.
So here his own adviser has finally spoken the truth to the actual amount invested in the teak farms, $20M and Michelson claims he sold them for $32M and he still has half of his properties. Let's see, that's a $12M dollar profit from the sale of half of the properties so can we assume he might be able to get another $32M dollars from the rest? That would make him a profit of at least $44M. Bottom line here is, there is no loss, the D.A. has not reached the burden of proof for the People to show that a crime of "grand theft" occurred or that it isn't time barred or the fact that Michelson has just impeached himself so technically the Judge should strike his entire testimony and dismiss this case.
Wednesday will be a big day with the People resting their case. Then the Defense can really go after Michelson and his constant lies. What a JOKE, Powers being paid a $1,000 salary by his friend Campbell. Really??? With no proof Michelson expects people to believe that? I heard that Andres Marten was making over $30,000 per month salary and had a side business selling Michelson clone teak seedlings from his own farms owned by Marten, making even more money on the side off of Michelson.
I would bet by the time this lawsuit is over, David Cohen will be looking for a new Job as well as Marten. Hopefully they have saved up all their money because Michelson will be suing them next for not lying to the court, like Cooper. Well maybe Cooper didn't really lie, but he was trying really hard to protect Michelson, his good buddy. Cooper will probably get to keep his Job. If the D.A. loses, Michelson will probably sue them too that's why they are so afraid. Michelson will probably demand that Robert Knowles he fired or at least demoted.

UPDATED: Trial began yesterday with jury selection. Judge is Honorable Craig Richman.
UPDATE: Jury selection will continue on Monday rm 120 13th floor at 10:30 a.m. Opening arguments could being on Monday or Tuesday. Judge Richman is in "short court" as he has another schedule seeing other defendants before the trial.

MAJOR UPDATE! Case dismissed! DA not ready to proceed. Jury not selected. Case continued?
Crazy day. Hearing began at 9 a.m. DA Knowles not ready to proceed. DA wants to refile all 50 counts which would mean new prelim and another trial date. Count 4 dropped as is duplicate of count 6. Back to Dept 121 Judge Kemalyan for reassignment to new court and judge on September 10. I believe the DA is stalling because they know they have no case. I need to talk to some lawyer friends to try to decipher this. I know the DA has no case as I watched the prelim and other hearings. There was no fraud, no broken contract, no contract in fact, no money lost. Dr Gary Michelson the billionaire made money. Crazy court system. DA needs to shake off Gary Michelson or they will go down with him. DAs have already been reported to Attorney General and the ethics committee. They are under investigation.

Neil has been in LA County jail over a year. I personally feel he's being denied his rights. Yes, he agreed to postpone some things but this is ridiculous. I think they want to keep Neil in LA County jail because it is one of the worst jails in the nation. Maybe they want to break him? If they haven't by now, they never will. The prelim has shown there was no fraud. All but seven counts dismissed. His case is looking better and better every day. I feel the DA, State are abusing their power for the safe of the ex-DA, current DA getting campaign contributions. Maybe the DAs actually believed Gary had a claim in the beginning? The LAPD didn't believe Gary Michelson and previously stated in an almost identical case that there was no crime, no fraud, no embezzlement. LAPD stated Gary is "crazy, liar." Even after the LAPD called Gary a liar Gary continued the lie and said the LAPD were going to arrest his ex-director any day. Gary kept calling me up asking me where he was and I told him. I didn't think a billionaire public figure would lie. I was wrong. Gary lies all the time. I know this from personal experience.

Neil has been in LA County jail over a year. I personally feel he's being denied his rights. Yes, he agreed to postpone some things but this is ridiculous. I think they want to keep Neil in LA County jail because it is one of the worst jails in the nation. Maybe they want to break him? If they haven't by now, they never will. The prelim has shown there was no fraud. All but seven counts dismissed. His case is looking better and better every day. I feel the DA, State are abusing their power for the safe of the ex-DA, current DA getting campaign contributions. Maybe the DAs actually believed Gary had a claim in the beginning? The LAPD didn't believe Gary Michelson and previously stated in an almost identical case that there was no crime, no fraud, no embezzlement. LAPD stated Gary is "crazy, liar." Even after the LAPD called Gary a liar Gary continued the lie and said the LAPD were going to arrest his ex-director any day. Gary kept calling me up asking me where he was and I told him. I didn't think a billionaire public figure would lie. I was wrong. Gary lies all the time. I know this from personal experience.

Dr Gary Michelson has previously lost cases where he claimed fraud when he actually lost money
Recently Dr Gary Michelson lost a lost a lawsuit against Proskauer. In that suit he claimed he invested in tax shelters recommended by Proskauer which were not legal. The IRS stated that Gary Michelson owed $48,000,000 in unpaid taxes. Gary Michelson sued Proskauer for a $20,000,000.
Gary Michelson lost the lawsuit because Proskauer stated they offered to help defend a lawsuit from the SEC if there were a lawsuit. There was no lawsuit. Gary Michelson just gave the SEC the money they requested. Proskauer stated they gave no other promises. In this case Gary Michelson "lost" $48,000,000 and lost the case. There was no malpractice.
In another lawsuit Gary Michelson sued an appraiser who incorrectly valued a property higher than what it was worth. Gary Michelson gave a second on the property based on that value. The owner defaulted and the property went to foreclosure sale. Gary Michelson for some crazy reason bid the price of the first and his second. He then went to sell the property and could only get the price of the first.
Gary Michelson lost that lawsuit even though he lost money. He lost because Gary didn't have to bid the price of the first and second. He could have bid the price of the first and more than likely would have then owned the property. Or he didn't have to bid at all. Had he not bid and it sold for only the price of the first, Gary might have had a case if he could prove the initial appraisal was wrong.
Back in 2007 there was a third false claim of fraud involving Gary Michelson. Gary claimed his ex-director embezzled money. Gary Michelson reported this to the LAPD. LAPD stated there was no evidence whatsoever of any crime. They refused to press charges. After this Gary Michelson kept telling people the LAPD would be arresting his ex-director any day for fraud. The ex-director then sued Gary Michelson for defamation and received an instant settlement.Gary Michelson has so far cried "wolf" three times that I know of and there was never a wolf.
This brings up to the civil case against Neil Campbell and Richard Powers. Gary sued Campbell and Powers for fraud stating he lost money. Gary Michelson didn't lose any money. The only reason he won the civil lawsuit was because I believe he committed motion abuse to the point the defendants could not respond and lost by default.
Today is the beginning of the criminal trial dealing with the same issues as the civil case. In this case no money was lost or stolen. No property was stolen. There was no agreement for a six percent commission. There was an agreement for cost to plant trees only. There was no signed contract guaranteeing a specific return on investment. Gary Michelson merely bought and received land for a price. There was no fraud.
It will be interesting to see how things play out in this trial. One major issue is the inappropriate and most likely ethics violation caused by the personal relationship between Gary Michelson and DA/ex-DA Steve Cooley and DA candidate/current DA Jackie Lacey. There were very suspicious campaign donations which were given right before action was taken on this case. There was a private "thank you" lunch with the DA's office and Gary Michelson.
It will be interesting to see if there will be justice in light of Gary Michelson's history of crying "fraud" when there was no fraud. It'll be even more interesting to see if Gary's relationship with the DA will influence this case. Fortunately there is a jury trial so it won't be up to a Judge.

Gary Michelson loses another lawsuit where someone "cheated" him - Crazy Forbes billionaire

The main issue is this case is "Dr Gary Michelson cannot prove that he relied on Proskauer" when he bought the tax shelter. In this case Gary Michelson contradicts her own testimony again. He first states he never communicated with Proskauer. His attorneys communicated with Proskauer. Later he says Proskauer sent letters to his home. Gary then refuses to prove what his attorney related to him stating the conversations were privileged. The Judge even warned Gary that if he claims this privilege, there will be no evidence to decide who said what to whom when. Gary kept going down the stupid path anyway.
In this motion to reconsider there was no new evidence or law. The Judge still considered it even though he should have denied it outright.
Gary Michelson has said many, many, many times that he's a bad business man. He said that's why he hired David Cohen to manage all his investments in 2005. Then how did Gary Michelson continue to make mistakes since 2005? Gary Michelson must think he's smarter, wiser, more experienced than David Cohen which is not so. Gary Michelson is his own worst enemy. Gary keeps "cheating" himself with his poor judgment, lack of due diligence, complete lack of ability to judge people and investments. That's why I think he's mentally ill. He's making HUGE mistakes. He has hired great advisors, managers then he doesn't listen to them.
I think this case will be huge ammo for Neil and Richard. This shows Gary contradicts his own testimony and files frivolous complaints. It also shows Gary Michelson is indeed a very poor business man. Gary has stated this at least 20 times that I know of. David Cohen needs to take away Gary's checkbooks and credit cards before he makes even bigger mistakes.
The crux of the Proskauer case was when did Gary know what he relied upon about the tax shelters and from whom? I think that is a similar issue to the Costa Rican case. When did Gary know what about the land that he bought and from whom? Did Gary ever read the faxes Richard sent? I doubt Gary read all the faxes I sent. Just because I sent them doesn't guarantee he read them. So far all we know is that Gary saved the faxes. David Cohen was supposed to be in charge of all investments from mid 2005 and on. The current charges are only from December 2005 to the present. Then it was Cohen's responsibility to investigate the land purchases. Then it wouldn't matter what Richard sent to Gary unless Gary sent that to Cohen. Even then it was Cohen's job to properly investigate things. Maybe Gary should sue Cohen? Marten? Himself? Everyone?
From the transcript, pg 340 pdf, 234 txt, lines 5 - 18. Gary is answering Robert Knowles. Yes, Knowles asked these damning questions. If you read the section, Gary has many of his own advisors, accountants, business managers at this time reviewing, investigating his investments. Cohen tells Gary something is up with the land deals yet Gary continues. Cohen said he's not getting documents from Richard. Then Cohen should have investigated the records himself which he eventually did. Was Gary willing to turn a blind eye just to keep being friends with Neil? Neil is probably the only friend Gary has ever had in his entire life.

It appears then David Cohen is the one who did not properly investigate the land deals just like Gary's attorney did not properly investigate the tax shelters. Gary said David Cohen handled all of that from mid 2005 and on. The remaining charges are from December 2005 and on. That is when Cohen told Gary he is concerned about the land deals. Oddly enough David Cohen brags to everyone that Gary did so great in the Costa Rican land deals even until very recently! This case is beyond silly to the point of being surreal. I'm pretty sure Robert Knowles wants to add back the pre December 2005 charges for this reason. More damning evidence. David Cohen took over mid 2005. David Cohen mid 2011 brags that they did very, very well in teak farms in Costa Rica. I saved all the pages in case they delete them. Gary had 36.4 square miles. Cohen is just rounding up. This is the same exact land where Gary said he lost money. Which is it?

This case was originally filed February 1, 2008. Gary filed a ton of lawsuits in 2007 to 2010 for people "cheating" him. How can they cheat him when he has had a business manager who has handled all his investments, businesses since 2005? You would not believe the number of legal filings in this case! Each side at one point was filing three items per day. Only one winning are lawyers.

New Judge, attorney, motions, trial date in DA criminal case involving Dr Gary Michelson Forbes billionaire crazy
Yesterday was the post pre-trial arraignment in room 100. Lots of activity. I had to call the court to get information. I wish they'd post this online like they do with civil cases.
At the arraignment they were assigned Judge Richard S. Kemalyan div 121 on the 13th Fl.

Kemalyan went to UCLA for undergrad, Loyola for law school. He was accepted to the bar in 1976. He's currently running for re-election unopposed which means he won. He's been a judge since 2006.
Also announced which may come as a shock is Richard Power's attorney Walter Urban substituted out as Richard's attorney. Richard's current attorney is ... Jonathan Michaels. Yes, this attorney also represents Neil Campbell. Keep in mind Jonathan Michaels was brought in when Dyke Huish's co-partner/associated died days before the pre-trial. That is why pre-trial was postponed. Well, at least one reason.
Jonathan Michaels did a wonderful job at the pre-trial. He spoke very well, was animated, persuasive, passionate, had the penal codes memorized to the sub sub sections and already is up to speed on the facts and the matter of the case. In pre-trial Jonathan Michaels stated that everyone knows this is scorched earth litigation. No money was lost. No one was defrauded. Neil and Richard made Gary Michelson millions of dollars.
More shocking news. This is just politics I'm sure. Robert Knowles filed a motion to add the 43 or so dismissed charges back into the case. I doubt Knowles wanted to do this. Kemalyan went to UCLA for undergrad, Loyola for law school. He was accepted to the bar in 1976. He's currently running for re-election unopposed which means he won. He's been a judge since 2006.
Also announced which may come as a shock is Richard Power's attorney Walter Urban substituted out as Richard's attorney. Richard's current attorney is ... Jonathan Michaels. Yes, this attorney also represents Neil Campbell. Keep in mind Jonathan Michaels was brought in when Dyke Huish's co-partner/associated died days before the pre-trial. That is why pre-trial was postponed. Well, at least one reason.
Jonathan Michaels did a wonderful job at the pre-trial. He spoke very well, was animated, persuasive, passionate, had the penal codes memorized to the sub sub sections and already is up to speed on the facts and the matter of the case. Gary is sooooooooooooo cheap at times always trying to save a penny here and there leaving himself open to huge liability and problems. I had a relative who was similar. He was extremely wealthy but kept investing in tax shelters losing his ass and being fined by the IRS. He said he'd be wealthier if he just paid all the taxes and put his money in his mattress making no interest. My relative was a brilliant inventor but a shitty business person. I'd say just like Gary Michelson but Gary stole the main invention which he merely patented first. While Gary has many patents, only a very few number made any money. Gary sold the rest of his patents to Medtronic in a package deal. His paper clip patent did not make a cent.
Anyway in the above case Gary's accountant had a caveat, disclaimer in his recommendation of the tax shelter. I read it and the accountant is in the right. Gary is again in the wrong.
This is how Gary Michelson the shitty business man operates. He agrees to do business, buy something, invest somewhere with someone. The other person gives disclaimers. They generally have a written agreement. Gary does not do his due diligence. He just dives in blindly. He either loses money or he thinks someone else might have also made money on the deal or he just gets buyer/seller's remorse. In Gary's mind only he can make money. This makes him furious. He then claims the people "cheated" him. In actuality Gary actually did well on the deal and just doesn't realize it because he's not all there psychologically. In the alternative he did not do well and it's his own fault for not doing his proper due diligence or reading the disclaimers. In the further alternative Gary has just changed his mind like when he bought pet kiosks and microchips.
Of course in order for Gary to not feel like an idiot he must claim "they cheated me! I'm not an idiot. They are criminals!" All his brown nosing friends, employees of course agree with him which makes him even more determined to get his pound of flesh. He then sues, files charges and generally loses. This is the first time Gary has made a charge against someone and they ended up in jail. That probably would not have happened if it were not for Gary giving specific campaign donations at a specific time. The DA investigated the current criminal case immediately after receiving funds. The funds that Gary donated at least legally would never cost what this investigation and trial will cost. This is your tax dollar at work, chasing non-existent criminals in other countries over business which happened in another part of the world.
