Oral Argument in Appeal B261156 - Gary Michelson - Justice Richard Mosk, Los Angeles, California - Corruption in the Courts

Below are snippets from the 29 minute oral argument in case B261156. Justice Richard Mosk, Justice Paul Turner, Justice Sandy Kriegler were at the oral argument. I'll try to name the speakers. Suffice it to say Justice Richard Mosk appeared to be of the opinion that if you don't know how much Appellants paid for the property before Gary Michelson bought it, how can one tell if Gary made or lost money?

Justice Richard Mosk as all know requested "medical leave" after oral argument. Chief of the Supreme Court Justice Tani G. Cantil-Sakauy then appointed her long time friend pro tem Judge Sanjay Kumar to the position to sit until April 11, 2016. This means Justice Cantil knew the opinion would be released April 8, 2016 a Friday. Days before the opinion was to be released March 31, 2016 Justice Richard Mosk decided to retire. That was a good move on his part so his name won't be associated with this incredibly unjust ruling. This ruling shows the extreme corruption in our judicial system. No money was lost or stolen. Powers made Gary Michelson millions of dollar. I wish Powers could "defraud" me so I could also make millions of dollars.

If you listen to these audio snippets, you can see that Justice Richard Mosk is frustrated and upset with this ridiculous, frivolous case. No money was lost. Millions in profits were made. There was no written or oral contract as to commission. You can also hear the Deputy AG act like a deer in headlights. He has no case and he knows it. It's obviously tough for him make up stories and fake arguments on the spot.

1. AG David Voet can't answer question posed by Justice Richard Mosk.

RM: Look, we're talking about count three. That's the only count, right?

AG: Yes

RM: Michelson testified that he acquired those properties for $759K. Right?

AG: Correct

RM: And he testifies that Powers was to receive no more compensation on that transaction other than the 6 % commission, right?

AG: Yes

RM: On cross he was asked how much of the $759K was taken from him, right?

AG: Ahm

RM: And he responded "I don't have personal knowledge as I sit here."

AG: That's right

RM: and there was no evidence to the property's original purchase, right?

AG: Well, I guess the only evidence is the fact that this amount of money was sent.

RM: That was the theory in count 3 which was, I paid $759K. I was tricked because they bought it for less. Isn't that count three?

AG: Wuh, uh

RM: It either is or it isn't

2. AG continues to stumble on a simple question

RM: Do you have any evidence for the price for the land as it pertains to this one count?

AG: You mean in terms of receipts?

RM: (do you have) any evidence at all? Is there any evidence in the record as to what defendant Powers paid for the land down in Costa Rica?

AG: Uh, the position we take is Dr Michelson said this is how much he was asked for and this is how much he sent and I think that is evidence of the amount paid for the property

RM: Say that again, a little louder.

AG: Sorry your honor. Dr Michelson is the one who came up with these figures who testified to these figures . I was asked for this amount. I sent $150K right away and then ...

RM: That's not the question. The question is how much did Powers pay for the property. Is there any evidence to that? I could find not.

AG: I'm not understanding your question, your honor. Please repeat.

RM: It's the same question Justice Steilger (sp?)asked. How much did Powers pay for the property for which Dr Michelson paid $759K? Is there any evidence as to how much the property was actually purchased not by Michelson but by Powers?


AG: I can't represent any particular number on that for what I remember about the case (AG was not at the trial)

3. AG submits.

Justice Richard Mosk: "The question was under count three what evidence was presented that he was being defrauded? I thought it had to do with they were only to get 6% but they were actually buying this property much cheaper and reselling it to me so they were getting more than 6%. Wasn't that the theory?"

DAG Voet: "Uh, that may have been the prosecution theory but I would submit that you have to look at the this case much more broadly not just that single transaction. In the sense that would Dr Michleson have continued to have done this had he known about everything that was going on, that these two people who posed as friends were trying to trick him. I think because of that he would have said 'I'm not sending you any more money. Why would I send you any more money because your intent is to defraud me."

Under this premise Gary Michelson believes that if he does business with someone and they make one penny profit, they have tricked and defrauded him.

4. AG, where's the evidence

RM: If we don't know what they paid for it, how do we know where the trick was here?

AG: The trick was uh, mm, they engaged in this comprehensive scheme to defraud Dr Michelson

RM: Well, you can keep saying that over and over again. I'm asking what was the evidence and the theory of the prosecutor? Just to say there was a scheme, there was a trick or device, tell me how, what, exactly what, where's the evidence .

AG: Well, here's some evidence. Powers, you know, kept these properties in his own entity and in fact refused to do anything to them until he extorted Dr Michelson to purchase them back

RM: I don't follow that. That doesn't even answer, that doesn't even get close to answering my quetion

AG: Okay, well Dr Michelson never would have sent that money had he known about everything that was going on. I think, I don't want to over simplify it

Other Judge: Whichever your position is, misrepresentation was made concerning, with the land, with the usable floor, and it turns out that the land could not be used for which the purpose for which it was (Justice feeding argument on behalf of  AG)

AG: Not fully used. Some of the property even though it wasn't really suitable for an investment, might have had some trees on it

Other Judge: The entirety of the property, was not suit.., you couldn't grow teak on all of it. Is that correct?

AG: or there was no teak already there.

RM: It sold for $32 million.

AG: Loss is not the issue (If loss is not the issue, then there is no dollar loss. Must be misdemeanor)


RM: I understand but it wasn't like it was swamp land. There must have been some value to it.

What happened to Robert Knowles the Deputy DA from the Gary Michelson case?

He's still listed in the California Bar Association directory as working at the LA County District Attorney office. The only mention of him in their website now is from this press release about the Gary Michelson case. Previously they omitted this result from searches.

Notice they were each charged with 140 counts of fraud. They were found guilty of only one county of fraud which I believe is in a misdemeanor amount. This press release and all this work when they knew these two people were innocent.

I don't think Robert Knowles is working as a prosecutor anymore. I think he may have a desk job somewhere in the DA office. In 2013 he was listed as a Deputy District Attorney IV. The last bit of news I see for him is this case.

Closing arguments of defense in Gary Michelson criminal fraud trial - Forbes, billionaire, USC

Jonathan Michaels is a wonderful lawyer. He was able to take these important and complex issues of law and translate them for the laymen jury in an easy to understand manner. As I read them I can clearly tell there was no crime, no fraud just a disgruntled ex-friend of a defendant. For the District Attorney to use a supposed computer expert Scott Cooper who is a personal friend of the supposed victim Gary Michelson is absurd. Scott Cooper was hired by Gary Michelson as a computer forensic expert for his legal cases. For now here are the minutes of Jonathan Michaels closing argument for the defendants.

Page 12 Gary's own employee Andre Martin admits the land is worth "50 MILLION TO 70 MILLION DOLLARS." Then he obviously didn't lose any money.

Page 13 Gary's own employee David Cohen admits the land is a great investment ""WE ALSO HAVE A MEANINGFUL TIMBER INVESTMENT IN CENTRAL AMERICAN HARD WOODS. THIS INCLUDES BUILDING ONE OF THE WORLD'S LARGEST TEAK PLANTATIONS WHICH WILL BE AN EXCELLENT INVESTMENT."

Page 16 is the crux of this entire case. This proves there was no crime and Gary was fully aware of all facts. This is from Gary's own employee to Gary. "THE DIFFERENCE BETWEEN THE PURCHASE PRICE THAT THE COSTA RICAN COMPANY PAYS FOR THE PROPERTY AND THE  PRICE THAT C & M PAYS TO THE OFF SHORE COMPANY IS A PORTION OF MR. POWERS COMPENSATION AND IS PAID BY C & M TO THE OFF SHORE CORPORATION."

Page 26 all counts are time barred. "SO DID THE LAWSUIT BEGIN WITHIN SEVEN YEARS OF SEPTEMBER 2005? NO, NO. THAT WOULD HAVE BEEN SEPTEMBER 2012. IT WAS FILED MARCH 2013."

I sat through quite a few proceedings in this case. I did research of my own in English and Spanish. I can tell there was no crime. No money was taken. Gary agreed to the purchase prices, gave money and received the property. Gary sold the property for a profit. Gary was aware that Powers' company took a markup. There was never a six percent commission agreement anywhere. Gary was aware of how much of the land was planted. Gary committed perjury many times on the stand and in sworn statements. All of these events, purchase transactions happened long before the statute of limitations. They should have been found innocent of all counts. They should be vindicated in appeals court.

Comment made on LA Times article on DA's prosecutorial misconduct - Dr Gary Michelson

I have seen first hand evidence of prosecutorial misconduct and corruption in the DA's office. The case is The People vs Philip Powers, Neil Campbell. LA Superior Court Case BA409225 heard by Judge Craig Richman, now in Court of Appeal Case B261156, Second Court of Appeals.

In this case Forbes billionaire Dr Gary Michelson admitted on the stand he donated the maximum to then DA Steve Cooley and current DA Jackie Lacey. He admitted he asked them to charge his ex "best friend" Neil Campbell with the crime of fraud even though he had no evidence of any crime at all. He most likely also gave heavily to Steve Cooley's new "Justice Consulting" company. On the stand Michelson admitted he took the top leaders of the DA out to lunch to thank them for arresting his ex "best friend" in Idaho for a crime that was not committed in Costa Rica. The alleged crime was not even in the jurisdiction of the Los Angeles DA office. LA probably wasted millions flying people back and forth to Costa Rica for two years.

The Defendants were investigated for the same non crime in Costa Rica. Costa Rica DA said they were innocent. No money or land was stolen. Instead Defendants made billionaire Gary Michelson over $50,000,000 in profits. Michelson just did not decide to sell until after the market crashed. He still made a profit.

There were originally 140 counts of fraud. After the preliminary hearing it was reduced to I believe five. All of those causes were after the statute of limitations. The jury found them guilty of one count of fraud for no dollar amount which should then be misdemeanor and dismissed. Judge admitted he made mistakes in the case on the record on the stand. Politics of the judicial system - Gary Michelson, Forbes billionaire, patent, spine

After sitting here for the past week mulling over the sentencing hearing I think I'm finally getting my head around it. Perhaps all is not what it seems. I am thankful that Neil and Richard are out of jail and will never be going back to jail. Previously they were looking at life in prison based on all the charges and related charges that could up the time. Gary Michelson is of course extremely upset that he couldn't throw them in prison for life even after paying off the DA. While I still feel the Judge did not rule properly on sentencing I think I understand why.

Our judicial system here in Los Angeles is corrupt. There is no doubt about that. I worked for the City of Los Angeles. I saw it first hand. I saw employees lie, cheat, steal, commit perjury, fraud....The fact that the DA hired a real estate appraiser to appraiser an easily $10 million home for a measly $3.5 million is factual proof. To see the DA get up there and try to argue that the $3.5M appraisal was accurate was truly pathetic. Robert Knowles is a smart man. There's no way he believed his argument or that appraisal. He was intentionally lying to the court. He was committing fraud upon the court by giving the judge a fraudulent appraisal. Fortunately Judge Rene Korn realized this and ruled that the property was more likely worth $10 million. Richard was then allowed out on bond.

Here in LA and in most cities and countries a wealthy person will give money to a politician. The wealthy person wants a favor from the politician. In this case Gary Michelson gave money to DAs Steve Cooley and Jackie Lacey. I believe Gary also gave Cooley money in the form of "consulting fees." In exchange the DAs used their influence to charge Gary's ex-friends with a non-existent crime. Gary intentionally went to the DA because the last time he tried to file a fraudulent criminal report with the LAPD he was denied.

The DAs used their influence to falsely charge Neil and Richard with crimes. They instructed their Deputy DAs Robert Knowles and his partner to pursue the case. They instructed their detectives to investigate. They allowed them to use vast sums of money to fly LA DAs to Costa Rica. They also used city and county funds to bring "witnesses" from CR to LA. I may do an info act request to find out just how much money was wasted in this fraudulent investigation.

The DA used their powers along with the state attorney general and federal government to arrest and extradite Neil and Richard from Idaho and Texas respectively. The DA threw them in LA County jail one of the worst in the nation. The DA dragged their feet in the investigation to intentionally keep them in jail in horrible conditions. Perhaps they hoped they'd cop a plea, lie about each other, break them down. Or perhaps they were just following Gary's instructions to torment, punish, abuse them as much as possible.

The DA finally present their case at the preliminary hearing. Almost all of the charges are dropped due to statute of limitations, lack of evidence. The charges are whittled down from I think 140 to five. At the end of the trial defendants were only found guilty of one charge. It makes no sense as that one charge was barred by statute of limitations. I personally believe that one of the jurors was a plant. He was very different than the other jurors. The second I saw him I knew he'd be the lead juror and he was. None of the other jurors cared at all. I saw three of them sleeping at the same time.

Finally the case is at the sentencing phase. Jonathan Michaels did a wonderful job with this case. He argued that the one charge should be reduced from a felony to a misdemeanor and dismissed. Based on case precedent and law it should have been dismissed. Richard and Neil would have been exonerated. That is what should have happened. Instead Judge Craig Richman made some very questionable and appealable decisions. He refused to rule on restitution. He refused to reduce the charge or dismiss it. He stated paraphrased "I've been wrong in the past. I invite you to appeal the decision."

I believe Judge Craig Richman did not want to rule because his job, livelihood would have been in jeopardy. He probably would have been demoted, transferred to traffic court in a horrible area miles from his home. I've seen this happen many times in Animal Services. I think he previously must have done something to piss off the city attorney. That battery case should have never been filed against him. When someone hit me LAPD said they'd only file charges if I had broken bones or profuse bleeding which caused me to go to the emergency room. The LAPD detective told me "it's legal to hit someone."

The DA filed a frivolous criminal case against Neil and Richard as a personal favor to Gary Michelson in exchange for money. Deputy DA Robert Knowles was forced to put forth a shamble of a case just to appease the DA so he also doesn't get a bad assignment. In the end Judge Craig Richman did not rule according to evidence, case precedent or the law. The case will be appealed and reversed by three appellate judges. Hopefully by then enough time would have passed so Gary Michelson will not want to continue to destroy Neil and Richard. If Judge Craig Richman had dismissed the one charge Gary would have been irate and would have continued to destroy them, DA, Judge. There would have been heaps of negative media and other attention on the DA's office. As it is the civil case is still open and perhaps a criminal case in Costa Rica. Gary has taken absolutely everything from these two people. They are penniless, homeless, jobless. Knowing Gary he will soon find someone else who is "profoundly cheating" him and he will try to destroy that person. He's been doing this his entire adult life. Who will be his next victim? David Cohen?

UPDATED: Two motions today on sentencing, motion to dismiss, motion to make misdemeanor, Dr Gary Michelson

UPDATE: Court was over a couple of hours ago. Gary Michelson got on the stand for a while to make up stories about Neil and Richard. Next thing I know I see Richard back in the sheriff records as out on bond. He previously didn't show up at all. He was in jail from May 23, 2013 to September 20, 2013, four months. I see Neil listed as own recognizance. I assume it means they are both not in jail.  I wonder what Gary Michelson and his paid DA friends did between end of trial and sentencing. If you read the below motions, the one charge should have been dismissed.

I just realized that the Sheriff dept spells Philip like "Phillip" when the LA criminal court shows him as "Philip." The sheriff record is the same. He appears to still be out on bond. It also appears he will be on probation three years total minus time served 1095-120=975? I'm guessing at this point. One count of felony is three years in jail. I called the courts. This is both of their first and only offense.

UPDATE: Sentencing is at 1:30 pm. Motions were heard this morning but one count was not reduced to misdemeanor or dismissed. Judge invites them to appeal because he doesn't know how to rule in this case. It would be one of the first cases ruled upon after the passing of the recent bill. Neil will not go to jail no matter what because of time served. He was in jail about 1.5 years already. There is a small possibility that Richard might have to serve time, be on probation. He was in jail many months already. An appeal would easily take two years if not longer and cost a lot of money. My civil appeal in Texas was briefed, submitted over 14 months ago and still no opinion.

Did the DA get to Judge Craig Richman? Does the Judge fear Dr Gary Michelson and his power, money, political influence with the DA, ex-DA? Does the Judge just not want to be the first to dismiss a misdemeanor? Does the Judge not want to downgrade the felony to a misdemeanor because he doesn't want to piss off the DA office, hurt his chances at re-election as Judge? DA, Judge, politicians, money, power....all inner twined here in LA, in most of the US. Never a good thing. As I read the below motions, know the issue, have seen the evidence in court, watched the preliminary trial, some of the final trial...I don't know how it can't be reduced and dismissed.

Where is DA Robert Knowles? Dr Gary Michelson case, ex-Forbes billionaire

Where is the DA Robert Knowles who handled this criminal case? He is still listed as hanging his law license with the DA office. His email still works. His system receives it but no one opens it.  There is no vacation notice or auto-reply. There is no notice to contact someone else because he no longer works there. He doesn't seem to be responding to email. I hope Dr Gary Michelson did not do anything to Robert Knowles. Robert Knowles did the best job he could with the case considering no crime was committed, there was no evidence of any crime and Dr Gary Michelson is a pathological liar who perjured himself repeatedly.

District Attorney Steve Cooley and Dr Gary Michelson, corruption, bribes

The below is the meta content tag for ex District Attorney of Los Angeles Steve Cooley's website. This is obviously just a euphemism for corruption and bribes. What better way to "navigate today's justice system" than by giving Steve Cooley a nice fat consulting fee over lunch, wink, wink.

Let us again read between the lines. He's stating that he's made a lot of connections over the years in the Los Angeles County criminal system with judges, officers, criminals. He's willing to use his connections to help you say get away with murder or throwing your ex friend in jail for no reason. It's just a matter of you paying his consulting fee. 

While we know Dr Gary Michelson donated to Steve Cooley and his replacement current DA Jackie Lacey, I'm pretty sure Gary gave a few million in "consulting" fees to Steve Cooley. Cooley may have even had a hand in the USC donation as Cooley went to USC law school.

I wonder if Dr Gary Michelson will be taking Steve Cooley, Jackie Lacey and the entire District Attorney's office to lunch again to thank them for the fantastic job they did charging Gary's innocent ex-friend with felony fraud, keeping him in LA County jail for almost a year and a half, taking all of his money, his home and all of his personal possessions? I think Gary may make Steve pay this time since the DA basically lost their frivolous criminal complaint.

All the Kings Money and Humpty Dumpty: One and the same Dr Gary Michelson

For those of you who have been following my blog since I started it September 9, 2013 on the Powers/Campbell case you will remember that from the time Powers and Campbell were arrested I kept saying they were innocent.  I didn't really know for sure but I suspected, knowing Gary Michelson, that this was another one of his revenge treks.  He's been doing this for years in the Civil Courts but I believe this is the first time he's taken it this far in the criminal courts.

So I started doing my own investigation, and by no means do I have the resources that the Los Angeles D.A.'s office has but none the less I began researching this case Gary brought against Richard and Neil on my own with my limited resources.  Before Richard was even out of Jail last Sept. of 2013 I was pretty sure he was innocent. But almost one year ago to the day when this trial started on Oct. 16th 2014 I had written in my blog that I discovered evidence that Richard Powers was innocent.

Michelson had filed the exact claim against Richard in Costa Rica in 2007 and by 2010, 3 years later, they dismissed his case.  They discovered there was no crime and  even suggested that Gary Michelson was a "Liar".  Yes, it was refiled by the Attorney General but evidence points that Michelson had great influence in getting that done, just like he did here with his influence on his good friend, Steve Cooley, the L.A. D.A. at the time.

I've re-posted my blog below so you can review. Then I followed up with more evidence I discovered in future blogs.  I even contacted the D.A., Robert Knowles, and informed him of these facts and they ignored me.  I specifically told Knowles that Gary Michelson has filed false criminal complaints in the past with LAPD. He filed a totally false complaint about his ex-director. The LAPD told me, Mayor...that Gary Michelson was "crazy." There was no crime. I sent this to the DA Robert Knowles. I was alerted to this case via my Google news clipping service for keyword "Gary Michelson."

Below is the email I sent to DA Robert Knowles about this case. I just * out the name of Gary's previous victim. I sent this September 2013. The DA knew Gary was a lying fraud yet they continued with the case wasting tax payers a lot of money.

LAPD investigated and stated no crime had been committed. Gary Michelson then contacted Ed Boks and the Mayor's office asking us to tell the LAPD to arrest ******. I worked for both Gary and the City at that time. We spoke with the LAPD. They told us no crime was committed. They stated Gary is a "liar," and "crazy." I gave those emails to Dave ****** who used them when he sued Gary for defamation. Gary settled that case within two months. I'm no attorney but as I view the documents in the civil case upon which the criminal case is based I don't believe a crime was committed. Gary lost no money. He made a lot of money. Courts have ruled you can't sue for "loss of a bargain" when you knowingly agree to purchase something at a specified price. Thanks.

They've known for more than a year that these guys were innocent but they pursued with this case anyway.  You may say, "well they were found guilty of one felony count" from 141 counts filed against them.  But I've done my homework and what I see from the Jurors verdict is that they found "No Amount" for restitution and they found them innocent on the enhancement charges.  Which means this should be a 901.1 or 484(a) violation or a petty theft violation of less than $950 or less than $50. It's still very odd to me they could be found guilty of even one county when the jury stated they didn't take a penny.

I don't know why Powers and Campbell need to have a Probation report when this falls under another code not affected by Prop. 47.  This is an automatic misdemeanor, petty theft violation.  Simple as that. I think the Jurors flipped a coin because one of them wanted a guilty and all of them wanted to go home.  They were sleeping through most of the trial anyway  sometimes three jurors at the same time.

In any case it's a far cry from the alleged $28 Million Dollar theft Jackie Lacey claimed in her press conference last June 2013. What I don't get is that the D.A.'s office must have known these guys were innocent yet the politics of Gary Michelson continued to influence the D.A.'s office.  It makes me wonder how much money did Gary really pay Steve Cooley over and above his campaign contributions or what was he promised.  Cooley has a consulting firm where he "helps people maneuver around the Judicial system".  I'll bet if you start looking at all those companies owned by Michelson, I posted in my last blog, you'll find that one of those companies paid millions to Cooley for advice on something and that something was to insure that Powers and Campbell would spend the rest of their lives in Jail.

Boy I'll bet Gary Michelson is furious right now thinking, he spent $50M to U.S.C. trying to influence Cooley and impressing the Judges of Los Angeles County Court.  He probably spent another $30M pursuing Richard and Neil over the last 7 years and who knows where else he's left money trying to get favor from people whom he wants so desperately to believe his story.  And all that money spent by the D.A.'s office, must be millions as well, all for a conviction on a $50 petty theft charge.

The trial proved two important things. One, Gary Michelson is a liar and a thief. Two, he made between $6M and $12M selling half of his Costa Rican properties and still retaining almost half or approx. 10,000 acres (according to his own CFO) of his lands there and of that approx. 4,000 acres of that are ocean view properties. (according to his own Costa Rican farm manager).

Richard and Neil made him millions, as I've been saying for more than a year, but no one in the D.A.'s office would listen to me.  It could have saved the people of Calif. millions of dollars and the D.A.'s office a big embarrassment.  The D.A. can still save some face.  They should bring charges against Gary Michelson, for Abuse of Process, false testimony, perjury.

Deputy District Attorney Steve Lopez of L.A. is also a USC graduate and was somehow involved in the Powers/Campbell case.  He took over for Knowles last year during the bail hearings for Mr. Powers.  He was the person who got County Council to reject the bail proposal and later with Knowles came up with the phony $3.4 million dollar appraisal with their own appraiser on Gary Ashe's house which the Judge overruled, saying she believed the property was worth North of $10M and several other appraisal's were in the $9M dollar range. There was so much corruption between Michelson and the D.A.'s office. What was that luncheon meeting between Michelson, Cooley and all the high level D.A. personnel really about?  Will we ever know?

There I go, repeating myself again.  "All the Kings men and all the Kings money, couldn't put Humpty Dumpty Gary, back together again".  You LOST again Gary.  Get a life, it's time to move on and be happy with what you have.  Don't you have two kids and a wife to take care of? Or do you pay someone to take care of them as well?

Breaking news!!! Just found documents which prove Philip Powers is innocent!

I've been making calls, emailing trying to get ahold of documents in the civil case Michelson v Campbell, Powers and the criminal cases against those two here in LA and in Costa Rica. Thank god I speak Spanish and know my way around the LA court system a little.

I have uncovered the transcript from the application for acquittal of Philip Richard Powers in Costa Rica. The Costa Rican courts wanted to acquit Powers stating there was no crime. "Application for final acquittal. Case: 07-001578-283-PE. Versus: Phillip Richard Powers. Crime: fraudulent management. Plaintiff: C and M Investment Group Limitada.Messrs.: Pavas Criminal Court. Third Judicial Circuit."

In this document the Court clearly states that there was NEVER an agreement for Powers to get a 6% commission on land sales to Gary Michelson. While Gary Michelson stated many times that there is such a document he was NEVER able to produce it. Obviously, Gary Michelson is lying. I believe that is perjury. He lied in his legal statement about me. He definitely committed perjury here in Los Angeles in my case. Plus, 6% commission on land sales in Costa Rica makes no sense.

The Court ruled that Powers was paid to plant and maintain teak farms which he did. The Court ruled that Powers bought the land as an independent individual. He did not buy the land for Gary Michelson or the C & M Investment group, i.e. Campbell and Michelson. The documents clearly show that Powers bought the land on his own, cleared title, removed squatters, prepared the land for teak farms and then sold the properties to Gary Michelson for a price Gary Michelson agreed upon after consulting his experts.

The document goes on to state that not only did Powers not defraud Gary Michelson but Gary Michelson did not lose any money. It turns out Gary Michelson made a lot of money. On top of this after Gary Michelson complained about the deals Powers offered to buy the properties back for what Gary Michelson paid. Gary Michelson refused because the properties were worth more. Powers then offered double what Michelson paid for the properties and Gary Michelson again refused.

The Costa Rican Court has clearly showed that Gary Michelson is a liar. Over the course of a few years Gary Michelson could NEVER produce a contract which stated 6% commission. The Court even stated that 6% commission does not make any sense in land deals in Costa Rica. Court stated no one would broker land deals for 6% commission. Court stated no crime was committed and Powers should be acquitted.

I've put together a time line. This is to show the "coincidence" in the timing of the campaign donations, awards, press conference and charges being filed against Gary's ex-friend Neil.

• April 2005 Gary gets $1.3 billion settlement from Medtronic
• December 22, 2005 Gary tells everyone at Riordan's house that Dave is his Director and his Found Animals Foundation will use spayneuter to make LA nokill for animals
• December 25, 2005 David Cohen tells Gary something is wrong in Costa Rica

• February 2006 Gary sees my "Boks meet and greet" presentation and hires me as consultant.
• June 2006 I'm let go from Found Animals as Dave is taking it in another "direction"
• June 2006 Gary did not honor the contract he had with Dave. Dave threatened to quit if he didn't. Gary said he'd "ruin" Dave if Dave quit. Dave quit. Gary always threatens to "ruin," "destroy" people.
• June 2006 Gary went to the LAPD and tried to file a false criminal complaint against Dave. LAPD refused to do anything because no crime was committed, not one penny was taken.
• July 31, 2006 Gary is telling everyone including Ed Boks that Dave embezzled money and the LAPD won't do anything about it. Gary asks me, Boks, Mayor to help him get the LAPD after Dave.
• August 2006 Gary calls me and tells me LAPD filed charges, have an arrest warrant and just need to find Dave. He asks me where he is and I tell him. He tells me I was not fired.
• September 2006 Gary again asks me where is Dave and I tell him via fax.
• September 2006 Gary calls up Dave's vendors, defames Dave which causes vendors to stop doing business with Dave.

• January 1, 2007 Andre Marten tells Gary the land and trees don't add up
• March 21, 2007 Dave finds out about Gary's defamation and calls me up yelling that he will sue Gary. City asks LAPD if charges were filed and they said no because there was no crime. LAPD states Gary is a "liar," "crazy" and "no money" was taken. I verified that charges were not filed against Dave and started apologizing and letting people know the truth.
• September 2007 Gary files criminal complaint against Powers in Costa Rica

I searched a few more people and their charges are still listed. I saved a print out of their previous charges. It's not a computer, browser or website issue.

June 10, 2014 pre-trial hearing notes. DA Knowles makes a big mistake. Gary Michelson, Forbes, billionaire, perjury

Scott Cooper a forensic computer expert testified as to the computers taken in the raid of Richard's house in Costa Rica. For some reason the first copy of the hard drive was corrupted so they had to ask the Costa Rican DA for another copy. This is where I believe they may have retrieved some emails. The second copy of the hard drive was readable.

This next bit is pretty big. Robert Knowles forgot to translate the Costa Rican land deeds from Spanish into English. He tried to submit them in original Spanish but was denied. Knowles stated he thought he could submit these in the prelim then translate them for the trial. Judge told Knowles he had a year to translate them and should have done it. Judge refused to accept the Spanish deeds.

Without the deeds, I don't think there is a case. While Knowles was rather methodical submitting the wire transfers and faxes, he made a big mistake here. The Defense had no problem getting the Costa Rican hearing minutes properly transcribed from Spanish to English. Why couldn't the prosecution with all their money, translators get the deeds translated? I will say that Costa Rican Spanish is very different than American Spanish, Mexican Spanish, or Spain Spanish. I had difficulty searching the Costa Rican real estate website and I speak American, Mexican and Spain Spanish though I have difficulties with Catalan Spanish.

All in all the DA's case so far is getting weaker by the day though prosecution has not yet finished. Defense will soon start their presentation of witnesses and evidence. I wish I could see Neil's contract so I could see if his actions violated a fiduciary duty or not. As to Richard Powers he looks innocent to me. There was never a 6% commission and no money was lost. Gary Michelson made money. As Gary made money I don't know how Neil could be guilty either.

Again the purpose of the pre-trial is to determine if there is enough evidence of a crime to proceed to a full trial. So far I don't see it but I don't know what level of proof is needed. Below is the outline of the pretrial.

"The government must demonstrate to a judge or magistrate that there is sufficient evidence, or probable cause, to believe the suspect committed the crime with which he or she is charged.

Defendants usually must be present at this hearing, although they do not commonly offer evidence in their defense. This procedure has a similar function to grand jury proceedings, in that it is a safeguard against unfettered government action.

If the court finds there is no probable cause, the matter is dismissed (this would be the equivalent of a grand jury declining to press charges). If this happens, defendants are released.

If the court finds there is probable cause, the matter is transferred to trial court. Many courts use the term bound over, as "the defendant is bound over to the district or circuit court for trial."

UPDATE: I posted about ex-DA Steve Cooley's private consulting business he started in 2012 http://stevecooley.com/index He consults about the justice system. Lord only knows how much money Gary gave to Cooley to "consult." Gary Michelson is listed as a top donor to Steve Cooley in 2010 and 2011 giving the max $13,000 twice. Gary also stood next to Cooley in a government press conference. Gary also held an award banquet for Cooley.

May 2012 a mere week or so after she got her donation she launched an investigation. March 21, 2013 the DA filed charges for 140 counts of fraud against each of them now reduced to seven counts each. August 27, 2013 Steve Cooley asks Gary Michelson out to lunch. The main big brass from the DAs office are also at that lunch. Supposedly ex-DA Steve Cooley used his contacts and influence to arrange this lunch to thank the big brass for their help on this case. Oddly enough the two people who actually did all the work on the case are not at the lunch, i.e. Deputy DA Robert Knowles and DA Senior Investigator William Villasenor. Steve Cooley used his past connections to arrange the lunch. August 27, 2013 was a Tuesday. That would be during work hours for the people from the DA's office. This seems improper.

Seems a documentary was made called "Crime after Crime" about DA Steve Cooley and corruption. From an article about the documentary which debuted at the Sundance film festival in 2011.

"According to her lawyers, the district attorney should have disclosed an internal memorandum that concluded a key witness against her had perjured himself and that they never intended to seek the death penalty against her."

DA Robert Knowles knows for a fact that Gary Michelson has perjured himself many times even in an almost identical situation with Gary's ex director here in LA. He knows this because I told him this as soon as I saw his name mentioned in regard to this case. How can they possibly believe Gary's stories? Gary Michelson even perjured himself in my lawsuit against the City of LA. I asked him to recant, retract his statement and he refused. I even stated at that time that if he is ever in a court case in the future, they can strike his testimony as unreliable because he has previously perjured himself. The DA only has three witnesses and only one real witness which is Gary Michelson. The bank witness admitted that she can't tell if the bank docs are real. She only recognized her signature. The DA's investigator merely interviewed Gary and others. He didn't witness anything.

Quite a few investigative reporters made reports about Steve Cooley and corruption. I realize Steve Cooley is the ex-DA and Jackie Lacey is the current DA. Jackie Lacey was basically Steve Cooley's right hand person when he was the DA. Steve Cooley basically named her for the job when she ran. They are of course very closely related. They also both received campaign contributions from Gary Michelson during this exact time period.

I worked for the City of LA for a while. Yes, it's corrupt, so is County. I saw numbers juggled, girlfriends get contracts with no approval of commission, employees illegally using city time/supplies for their personal use, refusal to properly reply to state info act requests, employees/volunteers being harassed, false reports filed by one employee against another, the hiring of convicted felons, employees driving city cars drunk out of their mind, employees drunk on the job, City Attorney stealing my glasses at a campaign fundraiser so he could have an excuse to ask me out....I told him to just throw away my glasses or leave them in Antonio Villaraigosa's office. The City Attorney was upset by that so he made up a fake story about me in retaliation. I'm happy he finally retired. I've even had people in government offer me favors without my asking. I of course said "no."

The timing of the donations to DAs Steve Cooley and Jackie Lacey is just way too coincidental. The DA's office started it's investigation into Neil Campbell and Philip Powers a week after DA Jackie Lacey received a campaign contribution from Gary Michelson at a party. Gary Michelson previously also gave the max to Steve Cooley. I should not be surprised because Gary asked me how he can get the politicians to do what he wanted. I point blank told him to give them money and he did.

I just realized that C&M Investments was a Nevada corporation. It was not in California. The C&M Limitada in Costa Rica was in Costa Rica.

Gary Michelson, pre-trial hearing for Neil Campbell is June 3, 2014 - Forbes, billionaire

UPDATE: Thank god I called. It's now June 3, 2014. I will keep updating this page or you can call the court yourself. Media and I will be reporting from the trial.

So far the pre-trial hearing is still set for June 2, 2014. This trial should last about five days. The Judge can then rule if there is enough evidence to proceed to trial. The DA Robert Knowles is still the lead prosecutor in the case. Defendants Neil Campbell, Philip Powers have lawyers. I will be attending the trial and reporting here. People in the media will also be there. Hopefully there will be justice and the Judge will realize that Dr Gary Michelson filed a false report for a non-existent crime. Gary Michelson made money on the teak farms. He did not lose money. No one stole from him. No one committed fraud.

Ton of hits on the post which proves Richard is innocent and Dr. Gary Michelson is a lying evil billionaire

This is the post getting a ton of hits, linked below. Please, retweet, repost, share this post. I hope the underlying documents are admitted into evidence. It would save the court a lot of time to read this. This is the case. There is no case for fraud. No crime was committed. The DA in Costa Rica stated in final summary "In like manner this prosecutorial agency dismisses entirely the existence of the crime of fraud, since the objective elements that constitute this type of crime as such were not proven; deception by the accused was not proven; no proof is provided to calculate financial damages."

The only crime committed was by Gary Michelson. It is a crime to file a false criminal report against someone. The DA needs to go after Dr Gary Michelson for perjury, fraud upon the court and filing a false criminal complaint. This is not the first time Dr Gary Michelson has done this. He tried to file a false criminal report against his ex-director. The LAPD specifically said "Gary Michelson" is "crazy," a "flake," "no crime was committed," "there was no embezzlement." Even after the LAPD told Gary there was no crime, we will not go after the ex-director Gary still told everyone that LAPD would arrest the ex-director "any day." That never happened.

Gary Michelson, 20 Million Minds, Forbes, billionaire, crazy, liar - Basic information

I've been writing about Dr. Gary Michelson publicly since 2005. I first met him in person December 2005 at Kathleen Riordan's house when everyone met Ed Boks for the first time. He said he was going to use his money, mind and influence to make Los Angeles the first true nokill city. I wanted to believe him and I did. I supported him.

February 2006 he saw my website, SEO presentation for the new LA Animal Services website that I made for free. He liked my presentation then hired me to work for him. He would call me on the phone and talk for hours about his ideas. He'd give me different duties which I did. I would fax him what he requested. I still have all of those faxes. I posted some here.

I ended up being hired to work for the City under a grant under written by Dr. Gary Michelson's Found Animals Foundation. I ended up getting fired through no fault of my own. I didn't get my last check and no one was getting back to me so I called Gary. Gary said "I didn't fire you. I didn't even know you were fired. I loved your work."

Gary told me to drop off a report to his house and I did. Then he said he requested a report on the economics of animal control meaning every single program. He previously just asked for spay and neuter. I redid the report and gave it to him. He sent me my check. This is around June 2006.

July 2007 I sued the City for causing me to be fired. My attorney told me to also sue Gary Michelson and Found Animals because they were the entity who under wrote my job and paid me. I didn't want to because I thought Gary was a good guy who would help animals. I didn't want him to stop helping LA's animals. I wish I could kick myself in the head for that stupid move.

I sued the City and produced a ton of evidence of harassment, sexual harassment, unlawful termination. When the City saw my evidence they immediately offered to settle. We're in mediation and the mediator said "but your boss wrote a statement saying he fired you because you did a bad job. I said "What? No way!" I called up Loftus and he said he made no statement. I finally had to go and get the statement. My shitty attorney Solomon Gresen of LA didn't bother to give me a copy of anything he filed or received. He did not even read the City's reply to my lawsuit which was filed months earlier. In there was a totally false statement by Gary Michelson. He didn't even spell the name of his foundation properly. This leads me to believe attorney for City wrote it.

I think about that time I found out that Gary's ex-Director sued him for defamation and got a quick settlement. I contacted that attorney who said I had a great case but he didn't want to go up against Michelson again because his lawyers are nasty. I was a witness and gave documents in the that case as ordered. The LAPD said that Gary was "crazy," a "liar" and a "flake." LAPD said there was no crime, no missing money or checks. LAPD said Gary lied and made it all up. I was truly shocked that Gary lied so much. I repeated some of what he said. I retracted my statements (which weren't public) and apologized to Loftus. I called Gary's friends and asked them what I should do about her totally false statement. They told me to first write a polite letter asking him to retract his statement. If he doesn't reply, be more firm about possible legal repercussions. If he doesn't retract, sue him.

I did those things and he refused to retract his statement which was pure perjury. I decided not to sue and just forget about it. By then everyone knew that Gary Michelson was a total fraud and a liar. He'd promise money or programs then later say "I never said that."At that time I thought "well, if Gary is ever in a legal case again, I'll be sure to tell people about his history of perjury." And here we are today.

June of last year I hear about Gary Michelson filing criminal charges against two people. Gary states they ripped him off yet out of the other side of his mouth he's telling everyone how much money he made in the deals. It sounded exactly like the Loftus case. I had a feeling Gary filed false charges yet again. Based on all I've dug up I believe Gary again filed false criminal charges against Campbell and Powers. This is what he does to people he dislikes.
