Monday trial summary. Dr Gary Michelson on the stand.

The morning started off with the DA continuing to lay the foundation of his case by presenting the exhibits. Michelson told his story of being "deceived by his best friend who stole his money and wouldn't pay it back. So he sued him."  He went on about the 6% theory but still no proof and admitted that there was no document memorializing that. If you recall earlier he stated there was a written agreement for the 6%. Later he admitted there was never any such document. And again in CR there is no 6% commission. It sometimes takes two years just to clear the title not to mention all the other work involved.

The afternoon started off with the Defense attorney also laying out the exhibits when Michelson admitted to having sold some of his properties for $32M but now he claims he's invested $36M but in four previous declarations he admitted to different numbers ranging from $25M all the way to $42M.  He admitted to having at least 2,000 acres still in his possession.  He was asked about his plantations in Panama and he said that he didn't remember how many acres he had there.  At least more than 20,000 acres he said but he told Forbes Magazine he had more than 60,000 acres of teak in Panama.   Then the defense attorney dropped out a big bomb on Michelson.  He said, "did you walk out of court last Wednesday with the defense's exhibit book?"  "Yes I did" Gary said.  "So you had it for five days?" attorney he asked.  "Yes" said Michelson.  "And you brought it back today?"  "Yes" said Gary. Then the defense attorney stopped and let that information hang in the air.  The Jury's faces must have been frozen to realize that Michelson basically just committed a felony.  Evidence tampering etc.  This will probably come up later.

Then the defense attorney asked about the appraisals of the C.R. teak properties.  He admitted to several appraisals being made by Andres Marten who is C & M's and Michelson's farm manager in Costa Rica. From $41 Million dollars all the way up to nearly $80M.  Now remember from the prelim he had denied having ever gotten any appraisals on his farms.  Check back in the blog here about the prelim. He was asked this several times and he denied it.  Then the Judge, Mr. Pastor from the prelim, advised him that he needed a lawyer before he impeached himself and three days later he came with his lawyer and admitted that he had indeed gotten an appraisal on his farms.  When asked for how much, he said for $32 million dollars. Looks like he's about to be caught in another lie.  Then the defense attorney asked Michelson on every count of Fraud, from 1 to 5, if he knew how much money was stolen from him on each count.  The answer was that "he had no personal knowledge on how much was stolen". The D.A. has not shown any evidence yet as to how much Powers paid for these properties or to how much he actually made off each one of these.

Then the defense attorney brought up the many criminal and civil suits he filed against the defendants, both in the U.S. and in C.R.  There were like six of them all together.  The issue with Mr. Powers Costa Rican dismissal came up but the D.A. objected to that and it was laid to rest for now, only to conclude that it had been refiled and was still active in Costa Rica.  The very last question the defense attorney asked Michelson was, "did Powers offer you $10 Million dollars over and above your investment to buy back your properties"?  The D.A. objected and the Judge said he consider the question overnight.  Trial continues with Michelson on the stand at 10:30 AM Tuesday.
