Is charging, extraditing, hearing, imprisoning two people Dr. Gary Michelson doesn't like in the best interest of the city, county and state? No.
If one looks at this legal case as a whole, one has to wonder if it makes any sense for Los Angeles County District Attorney Jackie Lacey's office to punish Gary's personal enemies for him. Dr. Gary Michelson was a fool who just gave money to someone without checking out their history or experience. He was an even bigger fool for not asking for any documentation or independent appraisals on the teak farms for years and years. He didn't even ask for an annual portfolio valuation or anything. If one could be prosecuted for being a fool, Gary Michelson would be guilty and should be incarcerated for life for his own good. He is repeatedly involved in these situations. He admits it himself and so does his friend Karl W. Doerstling besides his attorney.
I've worked for banks. They appraise then reappraise their real estate, loan portfolios and assets every few years. They do this to see if it makes financial sense to keep the properties, are the properties being maintained properly, has the market changed... Again, Dr. Gary Michelson did none of this. This story reminds me of the story of the Emperor's new clothes.
I'm sure everyone has heard this. Doctors are the worst investors. They have big egos, a God complex and think they know what they're doing so they don't get independent help. Gary Michelson should have at least asked one of his financial advisors to check out his farms. I'm sure he has them on retainer.
I bet I could easily appraise them from my desk. I do desk appraisals for banks as it is.
When I was in sales, agents loved doctors. If you stroke their ego, you can do anything you like. They will overpay and under sell every single time if you say "wow, you are the smartest client I have ever had. You really know your stuff. You're right, this is a great deal buying/selling at X$." I never did this if I represented that person because I thought it was unethical. On top of this most doctors prefer to work with male agents thinking they have a leg up in commercial real estate.
Back to the issue at hand which is does it make sense for the District Attorney of Los Angeles to go after Dr. Gary Michelson's personal enemies for supposed white crimes committed in Costa Rica by non-California residents? Campbell was a citizen of Florida. Powers was a citizen of Costa Rica. They were arrested in Idaho and Texas respectively. Why is the county wasting money and time to prosecute, extradite, transport, hold, try and then possibly incarcerate these supposed white collar criminals from out of state? The Los Angeles Superior Court is having major financial issues and had to close entire courthouse buildings, let go all of the court reporters and reduce court staff. This is a waste of tax payers' money.
Yesterday was an article in the LA Times which talks about early release for white collar criminals in California. There is a good chance Neil David Campbell and Philip Richard Powers could be released early. They have not committed violent crimes. Now that their name is all over the Internet I doubt they can easily commit white collar crime again (if they did so) without changing their names. I believe the only reason there was a warrant out for their arrest was because they were in contempt of court for not answering discovery. I might be wrong about that. They didn't answer discovery, motion for summary judgment or amended complaints because they had no money for an attorney. I guess I'm lucky I can write my own legal docs and can reply for the cost of paper and ink. Their lawyers quit and they didn't hire new ones. If this criminal case stems from the civil case, there is really something wrong here. If this happened to me, the police and DA's office would say "it's a civil matter. Go sue them."
Dr. Gary Michelson is Jewish. I am orthodox Catholic but grew up in Beverly Hills where almost everyone is Jewish. Jewish people and orthodox Catholics rely on the "old testament" of the bible also known as the Torah to Jewish people. I'm not the best at quoting the bible exactly but this is a main theme of the old testament. It is a sin to steal and cheat. It is also a sin to tempt thy neighbor. If you leave a wad of cash on the table, you are tempting your neighbor. We all have strong instinctual natural desires for money, food..... Dr. Gary Michelson left his checkbook on the table. He is also guilty in this situation. On top of this Gary basically gave them permission to defraud him, if they did. Neil and Philip would ask Gary if he wanted to buy so many acres for X dollars and he said yes without doing any due diligence.
*Everyone is innocent until proven guilty. I don't know if Neil Campbell or Philip Powers are guilty of fraud. In the civil complaint they denied everything in their initial answer. The only thing we have to go by is Gary Michelson's word. As we know he is a liar his word can't be trusted. He committed perjury in my case by lying in a sworn document. The lawsuit agains him by his ex Director also shows that he has a history of lying. Ask anyone who has ever dealt with him and they will tell you the same.
