After sitting here for the past week mulling over the sentencing hearing I think I'm finally getting my head around it. Perhaps all is not what it seems. I am thankful that Neil and Richard are out of jail and will never be going back to jail. Previously they were looking at life in prison based on all the charges and related charges that could up the time. Gary Michelson is of course extremely upset that he couldn't throw them in prison for life even after paying off the DA. While I still feel the Judge did not rule properly on sentencing I think I understand why.
Our judicial system here in Los Angeles is corrupt. There is no doubt about that. I worked for the City of Los Angeles. I saw it first hand. I saw employees lie, cheat, steal, commit perjury, fraud....The fact that the DA hired a real estate appraiser to appraiser an easily $10 million home for a measly $3.5 million is factual proof. To see the DA get up there and try to argue that the $3.5M appraisal was accurate was truly pathetic. Robert Knowles is a smart man. There's no way he believed his argument or that appraisal. He was intentionally lying to the court. He was committing fraud upon the court by giving the judge a fraudulent appraisal. Fortunately Judge Rene Korn realized this and ruled that the property was more likely worth $10 million. Richard was then allowed out on bond.
Here in LA and in most cities and countries a wealthy person will give money to a politician. The wealthy person wants a favor from the politician. In this case Gary Michelson gave money to DAs Steve Cooley and Jackie Lacey. I believe Gary also gave Cooley money in the form of "consulting fees." In exchange the DAs used their influence to charge Gary's ex-friends with a non-existent crime. Gary intentionally went to the DA because the last time he tried to file a fraudulent criminal report with the LAPD he was denied.
The DAs used their influence to falsely charge Neil and Richard with crimes. They instructed their Deputy DAs Robert Knowles and his partner to pursue the case. They instructed their detectives to investigate. They allowed them to use vast sums of money to fly LA DAs to Costa Rica. They also used city and county funds to bring "witnesses" from CR to LA. I may do an info act request to find out just how much money was wasted in this fraudulent investigation.
The DA used their powers along with the state attorney general and federal government to arrest and extradite Neil and Richard from Idaho and Texas respectively. The DA threw them in LA County jail one of the worst in the nation. The DA dragged their feet in the investigation to intentionally keep them in jail in horrible conditions. Perhaps they hoped they'd cop a plea, lie about each other, break them down. Or perhaps they were just following Gary's instructions to torment, punish, abuse them as much as possible.
The DA finally present their case at the preliminary hearing. Almost all of the charges are dropped due to statute of limitations, lack of evidence. The charges are whittled down from I think 140 to five. At the end of the trial defendants were only found guilty of one charge. It makes no sense as that one charge was barred by statute of limitations. I personally believe that one of the jurors was a plant. He was very different than the other jurors. The second I saw him I knew he'd be the lead juror and he was. None of the other jurors cared at all. I saw three of them sleeping at the same time.
Finally the case is at the sentencing phase. Jonathan Michaels did a wonderful job with this case. He argued that the one charge should be reduced from a felony to a misdemeanor and dismissed. Based on case precedent and law it should have been dismissed. Richard and Neil would have been exonerated. That is what should have happened. Instead Judge Craig Richman made some very questionable and appealable decisions. He refused to rule on restitution. He refused to reduce the charge or dismiss it. He stated paraphrased "I've been wrong in the past. I invite you to appeal the decision."
I believe Judge Craig Richman did not want to rule because his job, livelihood would have been in jeopardy. He probably would have been demoted, transferred to traffic court in a horrible area miles from his home. I've seen this happen many times in Animal Services. I think he previously must have done something to piss off the city attorney. That battery case should have never been filed against him. When someone hit me LAPD said they'd only file charges if I had broken bones or profuse bleeding which caused me to go to the emergency room. The LAPD detective told me "it's legal to hit someone."
The DA filed a frivolous criminal case against Neil and Richard as a personal favor to Gary Michelson in exchange for money. Deputy DA Robert Knowles was forced to put forth a shamble of a case just to appease the DA so he also doesn't get a bad assignment. In the end Judge Craig Richman did not rule according to evidence, case precedent or the law. The case will be appealed and reversed by three appellate judges. Hopefully by then enough time would have passed so Gary Michelson will not want to continue to destroy Neil and Richard. If Judge Craig Richman had dismissed the one charge Gary would have been irate and would have continued to destroy them, DA, Judge. There would have been heaps of negative media and other attention on the DA's office. As it is the civil case is still open and perhaps a criminal case in Costa Rica. Gary has taken absolutely everything from these two people. They are penniless, homeless, jobless. Knowing Gary he will soon find someone else who is "profoundly cheating" him and he will try to destroy that person. He's been doing this his entire adult life. Who will be his next victim? David Cohen?

Judge Craig Richman should have reduced charge to misdemeanor then dismissed it
This next bit confirms my thoughts about the improper ruling by Judge Craig Richman. It really boggles my mind that the Judge should have reduced it to a misdemeanor then dismissed it based on case law but he chose not to. He had this case to back his decision but decided on his own not to rule. He will now force Neil and Richard to live out three or four years of appeal hell. They can't get a job, Richard can't leave the state... And all for what? So Judge Craig Richman can continue being a judge with the support of the DA. He doesn't want to piss anyone off so he doesn't have to deal with the City Attorney allowing another crazy person to file assault charges against him. I would like to note in that case Judge Craig Richman was not 100% innocent it turns out. The crazy lady threw a bag of dog shit in his car. He then as per his own statement pushed her. He also lied and told her he was a police officer. That is a crime in and of itself. Then she pushed him. During that case he had to step down from the bench during the investigation and trial. Below is an almost identical case to the Powers/Campbell case in which the defendants were convicted of felony charges but the Jurors made no restitution or findings in the amount over $400 so the Appellate Court ruled them misdemeanors from felonies. This is now "CASE LAW." Jonathan Michaels argued this case after lunch with the Judge saying, "lets forget about prop. 47 for a minute and look at this CASE LAW which makes published findings that you must reduce the count to a misdemeanor as the findings are identical to our case".
Judge Richman basically said, "that's a very good argument Mr. Michaels but I'm sticking with my earlier decision to NOT RULE, I may be wrong and I've been wrong before and you may be right and I invite you to appeal, and I expect you will, however I am letting the Jurors decision on one count of Felony Grand Theft to stand and I will not rule on a presumption of knowing what the Jurors decision would have been as far as restitution."
Jonathan then argued that is exactly the point and said, "Upon the failure of the jury to so determine, the degree of the crime with no stated restitution amount then it shall be deemed to be of the lesser degree, a misdemeanor by the court.”
"This is the published findings of the Appellate Court."
Since 2008 the amount of petty theft misdemeanor has been raised to $950 from the previous $400. Still the Judge did not even find a restitution in the amount of over the misdemeanor threshold.

A jury convicted defendant Sumaria Love of 15 counts of various identity theft-based offenses arising from abuse of her position of trust as a dental receptionist.
On appeal, defendant makes four claims: (1) her conviction in count eight of fraudulently using an access (credit) card was only an attempted offense; (2) the prohibition upon dual convictions for theft and receipt of the same property bars her from being convicted both of fraudulent use of an access card in count twelve and receiving stolen property in count fifteen; (3) her felony convictions in counts four, eight, twelve and thirteen must be reduced to misdemeanors because the jury never determined the amount taken; and (4) the trial court's imposition of an upper-term sentence violated her rights to a jury trial and due process under the Fourteenth and Sixth Amendments.
The published portion of this opinion encompasses defendant's first three claims and we agree with the latter two of them. Accordingly, we strike defendant's conviction in count fifteen and remand the convictions in counts four, eight, twelve and thirteen for re-sentencing as misdemeanors. We disagree with defendant's first claim. In the unpublished portion of this opinion, we reject defendant's fourth claim.
Background
Counts Four, Eight, Twelve, and Thirteen as Misdemeanors Based on Amounts Taken Not Determined⌑ Defendant next contends that her convictions for grand theft in counts four, eight, twelve, and thirteen must be reduced to misdemeanors because the jury did not find that the value of the items obtained exceeded $400. The People have conceded the merit of this argument, and we agree.
In counts four, eight, and twelve, the jury convicted defendant of grand theft under section 484g, subdivision (a). Section 484g, subdivision (a) provides, “[I]f the value of all money, goods, services, and other things of value obtained in violation of this section exceeds four hundred dollars ($400) in any consecutive six-month period, then the same shall constitute grand theft.” Otherwise, the statute dictates the proper conviction as “petty theft,” a misdemeanor. (See §§ 484g, subd. (a), 488, 490.)
In count thirteen (the postage meter), the jury convicted defendant of embezzlement, a form of theft, under section 508. (§ 490a.) Embezzlement is punishable as grand theft if the value of the property taken exceeds $400 (§ 487, subd. (a)) or “[w]here the ․ property is taken by a servant, agent, or employee from his or her principal or employer and aggregates four hundred dollars ($400) or more in any 12 consecutive month period.” (§ 487, subd. (b)(3).) Otherwise, it is punishable only as petty theft. (§ 488.)
In all four of these counts, the jury was required to determine the degree of the offense under section 1157, which provides: “Whenever a defendant is convicted of a crime or attempt to commit a crime which is distinguished into degrees, the jury ․ must find the degree of the crime or attempted crime of which he is guilty. Upon the failure of the jury ․ to so determine, the degree of the crime or attempted crime ․ shall be deemed to be of the lesser degree.” The People acknowledge that section 1157 applies to defendant's case. The offenses of which defendant was convicted, sections 484g, subdivision (a), and 508, require that the jury make the determination of degree, based upon its finding whether the value of the property taken exceeded $400 or not.
Here, the jury made no findings as to the value of the items obtained. As for counts eight and twelve, the trial court initially instructed the jury to make a finding as to the value of the property obtained by defendant's fraudulent use of the access card information (CALCRIM No. 3220.) However, the trial court withdrew this instruction following a question by the jury as to whether the property actually had to be received in order for a value to be placed upon it. The court gave no instruction to assess a value for count four or count thirteen.
Because the jury did not find that the value of the items obtained exceeded $400 in counts four, eight, twelve, or thirteen, these felony convictions must be reduced to misdemeanors and defendant must be re-sentenced.
The convictions in counts four, eight, twelve, and thirteen are reduced to misdemeanors and the case is remanded for re-sentencing. Defendant's conviction in count fifteen is stricken.

Final sentencing results today in Dr Gary Michelson criminal trial, ex-Forbes billionaire, crazy person extraordinaire
UPDATE: Judge Craig Robert Richman seemed fair and just at trial until the very end. Of course the very end of the trial is all that matters. I just realized that he and Gary Michelson are major water skiers and both own water ski homes in Arvin, California minutes from each other. Craig's son competes in water skiing. So did Gary, Neil and Gary's ex-wife. Gary's ex-wife's family are major water skiers in that area. I would think Richman would have run into Gary's ex-wife's family up there.
Craig Richman also worked for the DA's office for 19 years. Of course most criminal court Judges probably worked for the DA but Richman worked directly under Steve Cooley "Richman, 47, a Republican from Chatsworth, worked most recently as a calendar trial deputy at the downtown criminal courthouse. He also served as an assistant head deputy and a supervisor of the Target Crimes Division under Dist. Atty. Steve Cooley. Richman prosecuted crimes against police officers and hundreds of felony trials." Seems Judge Richman endorses and supports the same people Steve Cooley and Jackie Lacey endorse.
Richman went to Arizona State for undergrad and McGeorge law school in Sacramento. Those are odd schools to go to if you are going to be a lawyer in Los Angeles, California. He started with the DA straight out of law school in 1986. 19 years in the DA office he should really know what's going on in this case. I'm sure he understands the politics involved in LAPD, DA, political candidates, Judges, campaign donations, money, favors....He worked for the DA under Steve Cooley and now under the new DA Jackie Lacey. In 2005 he was appointed by Schwarzenegger as judge for LA Superior Court. Perhaps it's just a really small world. All I know is Robert Knowles and Craig Richman obviously picked the short straws to get stuck with this case. Gary will try to ruin Knowles who did the best job he could with no evidence and his one witness committed perjury repeatedly. That's probably why Judge Richman refused to rule on the motion to dismiss the one charge. He doesn't want to be a target or have an issue being re-elected as Judge. He doesn't want to end up like Judge Goodson only hearing restraining order cases. He will gladly hand this mess over to three appellate judges who will hopefully be more distanced from the politics involved. He saw Gary go after Knowles in the court room. He knows from this case how low, vindictive, crazy and evil Gary Michelson can be. Gary probably would have tried to destroy Judge Craig Richman if he reduced and dismissed the one count. Now Neil and Richard have years of hell waiting for the appeal. They can't get a job, have a bank account, rent a place, lease a car, have a life....

I finally was able to gather some information and piece things together. They were each found guilty of one count of fraud by trickery. Neil got two years suspended sentence because he was in jail for one year and four months. Richard got three years suspended sentence to probation. Some was suspended because he was in jail four months. Neither is going back to jail unless they violate probation. Richard's probation is in California. He can't go home. In fact because of this ruling they can never get a job again unless they win on appeal. You can't sell real estate or cars, the only jobs they've ever known, if you've been convicted of felony fraud.
The count should have been reduced to misdemeanor then dismissed based on prop 47 and they have no priors. Plus, count was barred by statute of limitations and jury did not find that one penny was stolen. I think felony is $900, misdemeanor is $450 or less. They both have perfect probation records, i.e. no priors. See the motions in the previous post.
The Judge did not want to rule on the case. He asked them to appeal. They could appeal by reversible error. Judge Craig Richman did not want to be one of the first Judges to rule on prop 47. MORE IMPORTANTLY i.e. REAL REASON I BELIEVE, he did not want to rule on this case because of Dr Gary Michelson's very strong relationship to the current and ex-DA's. He probably also didn't want to receive the wrath of Gary.
I used to think I'd like to be a judge so I could rule fairly based on law and evidence. I know, incredibly naive. I have since realized that being a judge has NOTHING to do with fair rulings, law or evidence. It has to do with campaign donations, endorsements by the DA, LAPD, other Judges, politicians and being elected. Actually being elected comes in dead last. Most Judge's in LA don't even have to campaign because they run unopposed. No one wants their job. If you're a good attorney, you will make much more than a Judge. I think some Judges are appointed in appeal and supreme court.
A criminal appeal can be fast tracked. It should be in this case as these people are stuck in California away from their homes and families. They can't get a job. They will have to sign up for welfare, food stamps and medi-cal. The appeal could take two years easily. They should get a free attorney for the appeal I believe. It's just so sad that this Judge could have settled this fairly today but chose not to. He now forces these two people into two to three years of hardship, poverty, seclusion from their family, inability to work, get a job, provide for their family...not to mention mental and physical stress.
Dr Gary Michelson is extremely evil and mentally ill. I'm going to try to get the minutes from today. He got up there and lied about everyone and everything. He perjured himself in my case as well. I wish I could have gotten up there and told the Judge that Gary has a very long history of lying, perjury and fraud though I'm sure the Judge realizes this.
It is a horrible miscarriage of justice what has happened in this case. Gary Michelson using his money, power and connections to get people to do what he wants. I remember the day when he said he wanted the Mayor to do such and such. I said "well, you're going to have to give the mayor a lot of money." He said "okay, do it." I said "it has to be legal campaign contributions. You can't just give them money, bribe them!" What do I know.
I guess Neil and Richard should be lucky that the 140+ charges were reduced to seven, six were dismissed and they were only found guilty of one charge. They could have been looking at life in prison. Still, no money was stolen, taken. Gary Michelson made a lot of money from Richard and Neil. Let this be a lesson to all. NEVER EVER do business with Gary Michelson. It's not worth it. I wish I never worked for him. He is an evil, nasty, little man.

UPDATED: Trial began yesterday with jury selection. Judge is Honorable Craig Richman.
UPDATE: Jury selection will continue on Monday rm 120 13th floor at 10:30 a.m. Opening arguments could being on Monday or Tuesday. Judge Richman is in "short court" as he has another schedule seeing other defendants before the trial.
