There are four main points in this writ of mandate. The one charge was actually barred by the statute of limitations. Even then the one charge should have been reduced to a misdemeanor and dismissed.

Finding of a Dollar Amount of Theft, and
Made no Such Finding

Point No.2- Petitioners Were Not Charged with a
Theft in Excess of $950

Point No.3- There Was no Evidence at Trial to
Support a Finding on Count 46 that Petitioners Took
Property in Excess of$950

Point No.4-In Passing Proposition 47, the People
of California Intended to Require Misdemeanors, Rather
than Felonies, in Sentencing Crimes like the One that
Petitioners Were Convicted Of
