Happy New Year.
The festivities of the last 2 weeks have made people more relaxed in the courthouse. Bailiffs, clerks, guards, court recorders, lawyers, D.A.'s and Judges all talking about the end of the years cases, what's pending what's finished, vacations, etc.
Two weeks ago Campbell and Powers were sentenced by Judge Richman. Neil Campbell got 2 years but already did his time so he's done, free. Mr. Powers was sentenced to 3 years probation basically with credit, giving him 888 days of probation.
I've reported a lot about the injustice of the system but sometimes things are so obviously unjust that one must speak out. The ruling by the Judge was "Wrong" and he knew it and he even argued in Court on Nov. 12th with Miss Winetraub, the substituting D.A., that this case was going to be reduced to a misdemeanor by the mere fact there was no restitution ordered by the Jurors and to top that off, Prop. 47 came into play which would have insured that a first time offender with no criminal record charged with a felony would have his sentence reduced to a Misdemeanor. It leaves us all scratching our heads, not just our heads here in the audience but the heads of those in the court, the D.A., the Lawyers, the Bailiffs, Clerks, court recorders and even the Judge himself. So what happened?
RUMORS are what's happening now, which are starting to explain what may have happened. For the last couple months since the Jury reached their verdict on Richard and Neil, I've heard a couple of rumors. Not really facts so I didn't report on them as I wasn't sure of the sources. But in the last two weeks the additional rumors and additional sources in the courthouse has confirmed that possibly these rumors are based on some truth. Again, I'm telling you these are only rumors going around the court, by people who may have been a witness directly or indirectly.
The Rumor is that both the D.A., Mr. Knowles, and Judge Richman were indirectly or possibly directly threatened by Gary Michelson. Apparently after Mr. Knowles' famous closing argument, Gary went to Knowles and told him he had to "fix it", speaking about the testimony or closing argument given by defense attorney, Jonathan Michaels, which was pretty powerful and left no doubt that the Jurors were not going to find the defendants guilty. The Juror's convened for the weekend and rendered their verdict the following Monday finding them both guilty of only 1 count.
Apparently that weekend Gary told someone that he believed Mr. Powers had bribed Mr. Knowles, the D.A., to throw the case. It was then rumored that Gary was going to have Mr. Knowles brought up before the Bar and have his job and would do the same with the Judge if necessary. Apparently these rumors got back to Judge Richman and to the D.A.'s office, which created more rumors and fears.
I can say, now that the case is over, that I was interviewed by one of the Defendants lawyers as a possible witness in this case. I was given the opportunity to hear a recorded interview made by Gary to the D.A.'s investigator and in that interview he accuses Powers of bribing the D.A.'s highest official in Costa Rica to dismiss his criminal case against him there. When Gary doesn't like the outcome of the case he assumes that there must have been some illegal influence against him, why? Because that's exactly what Gary does, he bribes everyone and those that he can't bribe, like some Judges, he threatens. Subtly of course. In the case of Judge Richman, it was probably a supervising Judge or Political figure who spoke with him of the consequences of dismissing the case against Richard and Neil.
So the fear was out there and to make sure the D.A. and the Judge knew he meant business, Gary shows up to the sentencing with his two very expensive high powered attorneys in tow, sitting there in the courtroom the entire day making sure the Judge was aware he meant business.
The Judge took his only out, making many reversible errors in the process which should leave no doubt that the appellate court should overturn the verdict. It got Richman out of danger and Knowles as well, not to mention the entire D.A.'s office.
Heaven forbid Gary Michelson comes after the D.A.'s office with a Billion Dollar lawsuit. He'd lose of course but how much would it have cost the city, how many jobs would have been lost? This could have also led to an internal investigation on the way this case was filed by Steven Cooley and other high level officials in the D.A.'s office. Everyone would have been pointing the finger at Judge Richman.
Seeing it from his side, I would probably have done the same, unless I was just about to retire and take my pension, but Judge Richman still has a good 20 year career ahead of him. Why throw it away. Nope, he can't do that. He's appears to be a good Judge but that's the way this system works. Richard and Neil are the real victims here and the Real criminal, Gary Michelson, is still out there pretending to be somebody he's not, a "Billionaire philanthropist!" He's a crazy Sociopath and should be locked up before he hurts anyone else. That's POLITICS!

This are the top all time posts. I can also see that many hits are coming from USC administration building. Looks like people at USC realize how crazy Gary Michelson and his wife are. Most of the other hits come from LA County which is probably the DA's office. Also an ip in Brentwood. Could that be Alya? Most likely.

If Richard and Neil choose to appeal pro se - forms, procedure, helpful tips

There is a free pro se clinic which will help you with everything. I only used them once in a case few years back. They did not help me. The clinic is in the federal court house in LA mon, wed and fri 9-11 am I think.
I believe the sentencing motion written by their attorney is the basis of their appeal. Their appeal is already basically written. They should appeal the verdict, sentencing. Most appeals courts will not reverse a jury trial verdict. Of course in this case I think that all charges were outside of the statute of limitations. The jury was not clear on the questions to answer. The only charge where they were found guilty was outside of the statute of limitations.
As Judge did not make ruling on restitution, judge committed an error. You don't want to have to re-do the trial, just the verdict, sentencing. I spoke about the main issues with the sentencing here.

I've posted my appeal docs in .pages, .pdf, and .doc format for anyone to copy. If they can't find an attorney to help them with the appeal because of money issues, they should at least give it a shot themselves. I was sued by the largest law firm in Philadelphia who represented the Philly mob. I won as a defendant pro se without the help of any lawyer. That was my first case ever. I was in the legal right. I was also lucky my judge was not corrupt.

Gary Michelson's "victim impact statement" at sentencing hearing, crazy, Forbes, billionaire
Victim impact statements are written or oral information from crime victims, in their own words, about how a crime has affected them. All 50 states allow victim impact statements at some phase of the sentencing process. Most states permit them at parole hearings, and victim impact information is generally included in the pre-sentencing report presented to the judge. They usually are limited by the Judge to 5-10 minutes depending on the crime. In murder cases they may go as long as 15 minutes.
Contents: Victim impact statements may include descriptions of:
Physical damage caused by the crime.
Emotional damage caused by the crime.
Financial costs to the victim from the crime.
Medical or psychological treatments required by the victim or his or her family.
The need for restitution (court-ordered funds that the offender pays the victim for crime-related expenses).
The victim's views on the crime or the offender (in some states).
The victim's views on an appropriate sentence (in some states).
Gary was asked to stand at the podium which was moved to the wall dividing the court from the audience. He was NOT under oath, but it wouldn't have mattered if he was anyway as he always lies. Gary lies so much and gets away with it that he doesn't bother trying to keep his stories straight. When I worked for him I had to write down his instructions word for word because he would deny giving the instructions.
Gray Michelson's statement went on for almost an hour. Gary, who arrived to sentencing with both his high powered attorneys in tow, had a carefully prepared script that he used as his guide for his statement. No doubt it was prepared by his attorney, Luke Duchot, who sat there in the audience looking like a proud father to a serial killer. Though in this case only a Narcissistic Paranoid Sociopath with a Bi-Polar disorder was evidently present.
Gary starts off calling Richard and Neil's lawyer, Jonathan Michaels, a "Slime ball" for telling the truth about him in his closing statements. If you'll recall Jonathan Michaels brought up the fact that Gary had stolen evidence from the court room and only brought it back five days later when confronted by the Judge. "If he took the book he must be the crook" was the banter in the hallway after the closing arguments. Jonathan also pointed out the many lies Michelson had made during the preliminaries and the trial. He made a point to the Jurors that Michelson was not only a liar but a thief as well. Anyway Gary didn't like this so he insulted Mr. Michaels on many points. His way of getting even I guess, though Mr. Michaels didn't seemed fazed by the insults at all.
Then he gave his most famous speech, the one he uses at every event he's attended for the last 10 years. You can see it on U-Tube recently on the presentation for USC. I copied that link here a few weeks ago. It goes something like this, "Your honor, I drive an 18 year old PT Cruiser that I bought new for $19,000 and I drive it every day, I drove it here this morning". Boo hoo, I'm so poor! He then got on this long story about how he believes in "Karma" and how he's such a good citizen and how he donates so much money to the poor and to research in helping the dying and how his best friend, Neil Campbell, had betrayed him, bla, bla, bla. (he tried to fake out a few tears but they just wouldn't come, boo hoo) He then tells the Judge that Powers was walking up and down the hallway "smirking" at him, "Like he had not a care in the world, and that he just got away with stealing my money, $18 Million of it", was his approx. quote. Boo, hoo. Keep in mind that the trial proved otherwise, that no money was ever stolen and the Jurors found no loss to Michelson as did the Judge who refused to order any restitution to Gary as it was clear that Neil and Richard had made him millions of dollars.
Gary then goes on to tell the Judge that Powers and Campbell conspired to sell him properties that should have made him at least $200 Million dollars but because the properties were so bad he could only make a few million dollars instead, selling only half the properties because he said the other half is worthless, then demonstrates this with an overhead projection of his remaining properties, which appears to be heavily wooded and in front of the ocean. That made no sense.
Then he tells the Judge how much fun Richard and Neil are having spending his money, buying Million dollar Ferrari's, condos and the world's most expensive watches. But Gary doesn't spend any money on anything so he can't have any fun or a life, boo hoo. Then he says, "You know why these guys couldn't bail themselves out? Because they would have had to use my money and that would have led us to where they had it hidden."
He then goes on to tell a story about Daniel Webster. "The Devil and Daniel Webster" is a short story by Stephen Vincent Benét. Benet's version of the story centers on a New Hampshire farmer who sells his soul to the Devil and is defended by Daniel Webster, a fictional version of the famous lawyer and orator. Gary's version is that Neil and Richard conspired to steal millions of dollars from him figuring if they got caught they would only spend three years in jail then they could live out the rest of their lives spending Gary's money in luxury. "What a great deal", said Gary. Boo hoo, he cries again.
Gary doesn't mention his $15 Million dollar mansion which Alya has just decorated with expensive gaudy art, his $5 million dollar garden or his private lake and lake house that has a private runway for him to land his personal airplane or that extravagant hangar he built to keep his airplane in, etc. which by the way the Judge happens to be a neighbor of his, on a neighboring lake, and personal friends with his ex-wife, Amy whose also an avid water skier. I believe he also keeps a Villa in Italy and in other countries. He also has more than just his PT Cruiser. He owns an expensive hot rod car which he drove my friends around in.
It was pitiful, you could see the Judge was not buying a word of it. In fact Gary started off telling the Judge that Powers and Campbell had never paid taxes or worked a day in their life. He said, "Your honor, honest people like you and me, pay our taxes and with what's left over we buy our car. These guys don't pay taxes and go out and buy expensive automobiles". At one point Neil laughed at the absurdity of these claims and Gary turned to the Judge and said, "Look your honor, there's Mr. Powers smirking again," at which point Mr. Powers retorted back, "Just keep up the lie Dr." And so he did. Gary forgets Neil and Richard owned nice homes, cars, watches long before he met them. They both bought/sold exotic cars, watches, real estate before they ever knew Gary existed. They weren't poor homeless people.
The Judge let Gary ramble on for almost an hour about things that were not relevant to the case or to anything. You could see the Judge wasn't buying any of it but at the same time you could also see the loathing in the Judges expression at listening to this prepared speech which Gary just read off from his papers, a couple times dropping them to the floor and saying, "I'll just be another minute your honor", then rambling on for another 30 minutes. It appeared the Judge was intimidated by the presence of Gary and his attorneys so this could have been a factor at him being irritated. But why didn't the Judge stop him then? Who knows. I personally feel Judge Craig Richman is frightened of Gary and the DA's office. Judge Richman already got a bad taste of judicial politics in the flimsy assault case against him from a crazy person. As his wife is retired, two kids in college he needs to tread lightly on the hurt feelings of a crazy billionaire and his paid for DA.
It's interesting that the Judge didn't stop him. Gary clearly made statements that the Judge should have stopped him on. For example, Gary started reading off a supposed email exchange between Richard and Neil, taking quotes out of context and trying to make his own story more plausible. Richard and Neil should have been allowed to make their own statements as they are the REAL victims here.
But that's what Gary does, he makes victims out of his prey, as he is a predator. He didn't become a billionaire without being ruthless and conniving. He's a patent troll and has stolen many of the ideas of inventors and their patents. Gary Michelson stole the invention which he patented to make 99.9999% of his money. He's the one that should be in jail. One day someone is going to take him down legally in court. He spent $62 million on 36 lawyers ($500K each?) to fight Medtronic. In the meantime he gets to pretend that he's somebody when the truth is that he is nothing more than a miserable lying little man with "big" hands. I guess Karma started at birth for him and time will tell how his "Karma" works out. And FTR coming from a woman when a guy says he has "big hands," it means the exact opposite. I've heard some statements from people who know Gary very, very, very well. Plus what type of civilized professional man would want to mention that he has "big" "lobster claw" hands with a wink at public events which have to do with public charities for animals, people with back problems, USC, finding a cure for pet over population? Crazy insecure severely mentally ill Gary Michelson, that's who. I hope USC made him a tshirt in USC colors that says "Gary has lobster claw hands" "wink wink" "he's got a ...."

Gary was asked to stand at the podium which was moved to the wall dividing the court from the audience. He was NOT under oath, but it wouldn't have mattered if he was anyway as he always lies. Gary lies so much and gets away with it that he doesn't bother trying to keep his stories straight. When I worked for him I had to write down his instructions word for word because he would deny giving the instructions.
Gray Michelson's statement went on for almost an hour. Gary, who arrived to sentencing with both his high powered attorneys in tow, had a carefully prepared script that he used as his guide for his statement. No doubt it was prepared by his attorney, Luke Duchot, who sat there in the audience looking like a proud father to a serial killer. Though in this case only a Narcissistic Paranoid Sociopath with a Bi-Polar disorder was evidently present.
Gary starts off calling Richard and Neil's lawyer, Jonathan Michaels, a "Slime ball" for telling the truth about him in his closing statements. If you'll recall Jonathan Michaels brought up the fact that Gary had stolen evidence from the court room and only brought it back five days later when confronted by the Judge. "If he took the book he must be the crook" was the banter in the hallway after the closing arguments. Jonathan also pointed out the many lies Michelson had made during the preliminaries and the trial. He made a point to the Jurors that Michelson was not only a liar but a thief as well. Anyway Gary didn't like this so he insulted Mr. Michaels on many points. His way of getting even I guess, though Mr. Michaels didn't seemed fazed by the insults at all.
Then he gave his most famous speech, the one he uses at every event he's attended for the last 10 years. You can see it on U-Tube recently on the presentation for USC. I copied that link here a few weeks ago. It goes something like this, "Your honor, I drive an 18 year old PT Cruiser that I bought new for $19,000 and I drive it every day, I drove it here this morning". Boo hoo, I'm so poor! He then got on this long story about how he believes in "Karma" and how he's such a good citizen and how he donates so much money to the poor and to research in helping the dying and how his best friend, Neil Campbell, had betrayed him, bla, bla, bla. (he tried to fake out a few tears but they just wouldn't come, boo hoo) He then tells the Judge that Powers was walking up and down the hallway "smirking" at him, "Like he had not a care in the world, and that he just got away with stealing my money, $18 Million of it", was his approx. quote. Boo, hoo. Keep in mind that the trial proved otherwise, that no money was ever stolen and the Jurors found no loss to Michelson as did the Judge who refused to order any restitution to Gary as it was clear that Neil and Richard had made him millions of dollars.
Gary then goes on to tell the Judge that Powers and Campbell conspired to sell him properties that should have made him at least $200 Million dollars but because the properties were so bad he could only make a few million dollars instead, selling only half the properties because he said the other half is worthless, then demonstrates this with an overhead projection of his remaining properties, which appears to be heavily wooded and in front of the ocean. That made no sense.
Then he tells the Judge how much fun Richard and Neil are having spending his money, buying Million dollar Ferrari's, condos and the world's most expensive watches. But Gary doesn't spend any money on anything so he can't have any fun or a life, boo hoo. Then he says, "You know why these guys couldn't bail themselves out? Because they would have had to use my money and that would have led us to where they had it hidden."
He then goes on to tell a story about Daniel Webster. "The Devil and Daniel Webster" is a short story by Stephen Vincent Benét. Benet's version of the story centers on a New Hampshire farmer who sells his soul to the Devil and is defended by Daniel Webster, a fictional version of the famous lawyer and orator. Gary's version is that Neil and Richard conspired to steal millions of dollars from him figuring if they got caught they would only spend three years in jail then they could live out the rest of their lives spending Gary's money in luxury. "What a great deal", said Gary. Boo hoo, he cries again.
Gary doesn't mention his $15 Million dollar mansion which Alya has just decorated with expensive gaudy art, his $5 million dollar garden or his private lake and lake house that has a private runway for him to land his personal airplane or that extravagant hangar he built to keep his airplane in, etc. which by the way the Judge happens to be a neighbor of his, on a neighboring lake, and personal friends with his ex-wife, Amy whose also an avid water skier. I believe he also keeps a Villa in Italy and in other countries. He also has more than just his PT Cruiser. He owns an expensive hot rod car which he drove my friends around in.

Politics of the judicial system - Gary Michelson, Forbes billionaire, patent, spine
After sitting here for the past week mulling over the sentencing hearing I think I'm finally getting my head around it. Perhaps all is not what it seems. I am thankful that Neil and Richard are out of jail and will never be going back to jail. Previously they were looking at life in prison based on all the charges and related charges that could up the time. Gary Michelson is of course extremely upset that he couldn't throw them in prison for life even after paying off the DA. While I still feel the Judge did not rule properly on sentencing I think I understand why.
Our judicial system here in Los Angeles is corrupt. There is no doubt about that. I worked for the City of Los Angeles. I saw it first hand. I saw employees lie, cheat, steal, commit perjury, fraud....The fact that the DA hired a real estate appraiser to appraiser an easily $10 million home for a measly $3.5 million is factual proof. To see the DA get up there and try to argue that the $3.5M appraisal was accurate was truly pathetic. Robert Knowles is a smart man. There's no way he believed his argument or that appraisal. He was intentionally lying to the court. He was committing fraud upon the court by giving the judge a fraudulent appraisal. Fortunately Judge Rene Korn realized this and ruled that the property was more likely worth $10 million. Richard was then allowed out on bond.
Here in LA and in most cities and countries a wealthy person will give money to a politician. The wealthy person wants a favor from the politician. In this case Gary Michelson gave money to DAs Steve Cooley and Jackie Lacey. I believe Gary also gave Cooley money in the form of "consulting fees." In exchange the DAs used their influence to charge Gary's ex-friends with a non-existent crime. Gary intentionally went to the DA because the last time he tried to file a fraudulent criminal report with the LAPD he was denied.
The DAs used their influence to falsely charge Neil and Richard with crimes. They instructed their Deputy DAs Robert Knowles and his partner to pursue the case. They instructed their detectives to investigate. They allowed them to use vast sums of money to fly LA DAs to Costa Rica. They also used city and county funds to bring "witnesses" from CR to LA. I may do an info act request to find out just how much money was wasted in this fraudulent investigation.
The DA used their powers along with the state attorney general and federal government to arrest and extradite Neil and Richard from Idaho and Texas respectively. The DA threw them in LA County jail one of the worst in the nation. The DA dragged their feet in the investigation to intentionally keep them in jail in horrible conditions. Perhaps they hoped they'd cop a plea, lie about each other, break them down. Or perhaps they were just following Gary's instructions to torment, punish, abuse them as much as possible.
The DA finally present their case at the preliminary hearing. Almost all of the charges are dropped due to statute of limitations, lack of evidence. The charges are whittled down from I think 140 to five. At the end of the trial defendants were only found guilty of one charge. It makes no sense as that one charge was barred by statute of limitations. I personally believe that one of the jurors was a plant. He was very different than the other jurors. The second I saw him I knew he'd be the lead juror and he was. None of the other jurors cared at all. I saw three of them sleeping at the same time.
Finally the case is at the sentencing phase. Jonathan Michaels did a wonderful job with this case. He argued that the one charge should be reduced from a felony to a misdemeanor and dismissed. Based on case precedent and law it should have been dismissed. Richard and Neil would have been exonerated. That is what should have happened. Instead Judge Craig Richman made some very questionable and appealable decisions. He refused to rule on restitution. He refused to reduce the charge or dismiss it. He stated paraphrased "I've been wrong in the past. I invite you to appeal the decision."
I believe Judge Craig Richman did not want to rule because his job, livelihood would have been in jeopardy. He probably would have been demoted, transferred to traffic court in a horrible area miles from his home. I've seen this happen many times in Animal Services. I think he previously must have done something to piss off the city attorney. That battery case should have never been filed against him. When someone hit me LAPD said they'd only file charges if I had broken bones or profuse bleeding which caused me to go to the emergency room. The LAPD detective told me "it's legal to hit someone."
The DA filed a frivolous criminal case against Neil and Richard as a personal favor to Gary Michelson in exchange for money. Deputy DA Robert Knowles was forced to put forth a shamble of a case just to appease the DA so he also doesn't get a bad assignment. In the end Judge Craig Richman did not rule according to evidence, case precedent or the law. The case will be appealed and reversed by three appellate judges. Hopefully by then enough time would have passed so Gary Michelson will not want to continue to destroy Neil and Richard. If Judge Craig Richman had dismissed the one charge Gary would have been irate and would have continued to destroy them, DA, Judge. There would have been heaps of negative media and other attention on the DA's office. As it is the civil case is still open and perhaps a criminal case in Costa Rica. Gary has taken absolutely everything from these two people. They are penniless, homeless, jobless. Knowing Gary he will soon find someone else who is "profoundly cheating" him and he will try to destroy that person. He's been doing this his entire adult life. Who will be his next victim? David Cohen?

Instead Judge Craig Richman made some very questionable and appealable decisions. He refused to rule on restitution. He refused to reduce the charge or dismiss it. He stated paraphrased "I've been wrong in the past. I invite you to appeal the decision."
I believe Judge Craig Richman did not want to rule because his job, livelihood would have been in jeopardy. He probably would have been demoted, transferred to traffic court in a horrible area miles from his home. I've seen this happen many times in Animal Services. I think he previously must have done something to piss off the city attorney. That battery case should have never been filed against him. When someone hit me LAPD said they'd only file charges if I had broken bones or profuse bleeding which caused me to go to the emergency room. The LAPD detective told me "it's legal to hit someone."
The DA filed a frivolous criminal case against Neil and Richard as a personal favor to Gary Michelson in exchange for money. Deputy DA Robert Knowles was forced to put forth a shamble of a case just to appease the DA so he also doesn't get a bad assignment. In the end Judge Craig Richman did not rule according to evidence, case precedent or the law. The case will be appealed and reversed by three appellate judges. Hopefully by then enough time would have passed so Gary Michelson will not want to continue to destroy Neil and Richard. If Judge Craig Richman had dismissed the one charge Gary would have been irate and would have continued to destroy them, DA, Judge. There would have been heaps of negative media and other attention on the DA's office. As it is the civil case is still open and perhaps a criminal case in Costa Rica. Gary has taken absolutely everything from these two people. They are penniless, homeless, jobless. Knowing Gary he will soon find someone else who is "profoundly cheating" him and he will try to destroy that person. He's been doing this his entire adult life. Who will be his next victim? David Cohen?

DA's sentencing motion. Gary Michelson, Forbes, billionaire, spine, patent, Los Angeles
I have located the motion that was filed by the D.A. late last Friday before the sentencing was heard on the following Monday the 15th. What's interesting here is the D.A. makes several mistakes here in his filing. First he talks about Prop. 46 which has nothing to do with the issue here. He must have meant Prop. 47. Then at the bottom he refers to count 47 where he must have meant count 46, as count 46 was referred to as count #3 for the Jurors. He refers to Prop. 46 as relating to theft of Guns, Fowls and Avocados. Again he meant Prop. 47. Here is the motion.

On page 2 line 9 and 10 Knowles even admits to the facts here. By lines 11 and 12 he makes assumptions that the Jury must have meant to charge $759K as the theft. You can't do that, not even the Judge would make that assumption as neither a theft or for restitution. By line 25-28 Knowles requests the high prison term of 3 years because the amount he believes was stolen to be over $100K.
On Page 3 line 13, Knowles says, "the court must make an order regarding restitution" The Judge would not.
Line 14-19 the D.A. makes all this stuff up even to the point that he believes that he can guess what the Jurors must have meant to award an new arbitrary number of $375K and by line 20 he once again makes the statement, "therefore that is the amount the people recommend to the court as restitution in this case". The Judge did not and would not, therefore he must have ruled it a misdemeanor and dismissed the case due to the statue of limitations of petty theft of 1 year. As such he made several "Reversal Errors" here. This should be an easy appeal for the Judges in the Appellate Court. A first year law student wouldn't have gotten it so wrong.
Judge Richman doesn't get demoted to Traffic Court in Inglewood, the D.A. and the Judge don't get sued by Michelson and everybody is happy, except the defendants who made Gary Millions of dollars despite his continued statements of being cheated out of millions of dollars. Look up Love vs People again. He can't do that, it's case law.

Judge Craig Richman should have reduced charge to misdemeanor then dismissed it
This next bit confirms my thoughts about the improper ruling by Judge Craig Richman. It really boggles my mind that the Judge should have reduced it to a misdemeanor then dismissed it based on case law but he chose not to. He had this case to back his decision but decided on his own not to rule. He will now force Neil and Richard to live out three or four years of appeal hell. They can't get a job, Richard can't leave the state... And all for what? So Judge Craig Richman can continue being a judge with the support of the DA. He doesn't want to piss anyone off so he doesn't have to deal with the City Attorney allowing another crazy person to file assault charges against him. I would like to note in that case Judge Craig Richman was not 100% innocent it turns out. The crazy lady threw a bag of dog shit in his car. He then as per his own statement pushed her. He also lied and told her he was a police officer. That is a crime in and of itself. Then she pushed him. During that case he had to step down from the bench during the investigation and trial. Below is an almost identical case to the Powers/Campbell case in which the defendants were convicted of felony charges but the Jurors made no restitution or findings in the amount over $400 so the Appellate Court ruled them misdemeanors from felonies. This is now "CASE LAW." Jonathan Michaels argued this case after lunch with the Judge saying, "lets forget about prop. 47 for a minute and look at this CASE LAW which makes published findings that you must reduce the count to a misdemeanor as the findings are identical to our case".
Judge Richman basically said, "that's a very good argument Mr. Michaels but I'm sticking with my earlier decision to NOT RULE, I may be wrong and I've been wrong before and you may be right and I invite you to appeal, and I expect you will, however I am letting the Jurors decision on one count of Felony Grand Theft to stand and I will not rule on a presumption of knowing what the Jurors decision would have been as far as restitution."
Jonathan then argued that is exactly the point and said, "Upon the failure of the jury to so determine, the degree of the crime with no stated restitution amount then it shall be deemed to be of the lesser degree, a misdemeanor by the court.”
"This is the published findings of the Appellate Court."
Since 2008 the amount of petty theft misdemeanor has been raised to $950 from the previous $400. Still the Judge did not even find a restitution in the amount of over the misdemeanor threshold.

Accordingly, we strike defendant's conviction in count fifteen and remand the convictions in counts four, eight, twelve and thirteen for re-sentencing as misdemeanors. We disagree with defendant's first claim. In the unpublished portion of this opinion, we reject defendant's fourth claim.
Background
Counts Four, Eight, Twelve, and Thirteen as Misdemeanors Based on Amounts Taken Not Determined⌑ Defendant next contends that her convictions for grand theft in counts four, eight, twelve, and thirteen must be reduced to misdemeanors because the jury did not find that the value of the items obtained exceeded $400. The People have conceded the merit of this argument, and we agree.
In counts four, eight, and twelve, the jury convicted defendant of grand theft under section 484g, subdivision (a). Section 484g, subdivision (a) provides, “[I]f the value of all money, goods, services, and other things of value obtained in violation of this section exceeds four hundred dollars ($400) in any consecutive six-month period, then the same shall constitute grand theft.” Otherwise, the statute dictates the proper conviction as “petty theft,” a misdemeanor. (See §§ 484g, subd. (a), 488, 490.)
In count thirteen (the postage meter), the jury convicted defendant of embezzlement, a form of theft, under section 508. (§ 490a.) Embezzlement is punishable as grand theft if the value of the property taken exceeds $400 (§ 487, subd. (a)) or “[w]here the ․ property is taken by a servant, agent, or employee from his or her principal or employer and aggregates four hundred dollars ($400) or more in any 12 consecutive month period.” (§ 487, subd. (b)(3).) Otherwise, it is punishable only as petty theft. (§ 488.)
In all four of these counts, the jury was required to determine the degree of the offense under section 1157, which provides: “Whenever a defendant is convicted of a crime or attempt to commit a crime which is distinguished into degrees, the jury ․ must find the degree of the crime or attempted crime of which he is guilty. Upon the failure of the jury ․ to so determine, the degree of the crime or attempted crime ․ shall be deemed to be of the lesser degree.” The People acknowledge that section 1157 applies to defendant's case. The offenses of which defendant was convicted, sections 484g, subdivision (a), and 508, require that the jury make the determination of degree, based upon its finding whether the value of the property taken exceeded $400 or not.
Here, the jury made no findings as to the value of the items obtained. As for counts eight and twelve, the trial court initially instructed the jury to make a finding as to the value of the property obtained by defendant's fraudulent use of the access card information (CALCRIM No. 3220.) However, the trial court withdrew this instruction following a question by the jury as to whether the property actually had to be received in order for a value to be placed upon it. The court gave no instruction to assess a value for count four or count thirteen.
Because the jury did not find that the value of the items obtained exceeded $400 in counts four, eight, twelve, or thirteen, these felony convictions must be reduced to misdemeanors and defendant must be re-sentenced.
The convictions in counts four, eight, twelve, and thirteen are reduced to misdemeanors and the case is remanded for re-sentencing. Defendant's conviction in count fifteen is stricken.

In all four of these counts, the jury was required to determine the degree of the offense under section 1157, which provides: “Whenever a defendant is convicted of a crime or attempt to commit a crime which is distinguished into degrees, the jury ․ must find the degree of the crime or attempted crime of which he is guilty. Upon the failure of the jury ․ to so determine, the degree of the crime or attempted crime ․ shall be deemed to be of the lesser degree.” The People acknowledge that section 1157 applies to defendant's case. The offenses of which defendant was convicted, sections 484g, subdivision (a), and 508, require that the jury make the determination of degree, based upon its finding whether the value of the property taken exceeded $400 or not.
Here, the jury made no findings as to the value of the items obtained. As for counts eight and twelve, the trial court initially instructed the jury to make a finding as to the value of the property obtained by defendant's fraudulent use of the access card information (CALCRIM No. 3220.) However, the trial court withdrew this instruction following a question by the jury as to whether the property actually had to be received in order for a value to be placed upon it. The court gave no instruction to assess a value for count four or count thirteen.
Because the jury did not find that the value of the items obtained exceeded $400 in counts four, eight, twelve, or thirteen, these felony convictions must be reduced to misdemeanors and defendant must be re-sentenced.
The convictions in counts four, eight, twelve, and thirteen are reduced to misdemeanors and the case is remanded for re-sentencing. Defendant's conviction in count fifteen is stricken.
