Dr. Gary MichAelson vs Neil Campbell, Philip Powers - Michelson
UPDATE: I've been going back and updating my posts now that I have new information. In Gary's lawsuit he states Philip is domiciled in Costa Rica. He says C&M Investments is a Costa Rican corporation. Then I don't understand how he can claim in his civil lawsuit jurisdiction in California, same with the criminal complaint. I would think the agreement which he bases his lawsuit sets jurisdiction in Costa Rica.
The suit was filed only against Philip in October 10, 2007. I guess Neil was a John Doe at the time. Gary states Philip committed "theft of Plaintiff's property." There was no "theft" of property. Loss of a bargain is not theft. There wasn't even loss of a legal bargain.
I looked at the agreement again. There is no 6% commission in the agreement. Philip was paid to plant trees and maintain the farms. Philip agreed not to give money to a government official. That's it. Philip had to maintain records for work he did for C&M Investments. It doesn't say Philip has to turn over his personal records of land he purchased and resold to Gary. It looks like the only records Gary would have been entitled to are records that relate to farming the land.

I found the legal documents for the original lawsuit filed here in California. It's very interesting. In summary Dr. Gary Michelson basically papered Neil Campbell and Philip Powers until they could not afford to respond. They lost because they didn't reply to a motion for summary judgment, discovery requests, amended complaints... They lost their lawyers because they could not pay them. Dr. Gary Michelson basically beat them to death with his wallet. I will post the documents. There were hundreds of filings.
This is very interesting. First, Gary misspells and signs(?) his name as "Michaelson" in the document. Below is copy/paste of his signature. How does one misspell their own name?
Second Gary does not claim to have lost any money. He merely claims that Powers would buy the properties for X then sell them to C & M Investments (Campbell and Michelson) for X+Y keeping the profit. Gary claims his friend Campbell would schmooze Gary on water skiing trips saying the deals were good. Powers would give him some of the profit supposedly in exchange for reassuring Gary.Supposedly the contract which is attached said he can take a commission of 6% for finding the properties. I'm taking this from the order on motion for summary judgment against Powers. It doesn't say he can't buy the property and resell it to Gary.
The final order against Campbell is for $8,000,000 in supposed markups of the properties. They tripled it because Gary yelled RICO so it's $24,000,000. Again, it appears Gary didn't lose a cent. Gary did not lose $24,000,000 or even $8,000,000.
The final order against Powers is for $12,000,000 actual damages trebled or $36,000,000, $365K legal fees, $5K costs.
This is also interesting. Campbell told Gary that Powers is a great guy he met when they were both selling cars. Gary needs to be slapped in the face for that. "You sell cars? Here's $24,000,000. Go buy me some teak farms in Costa Rica. No need to show me any records for years and years. I'll just take your word for it."
How does that saying go? "Fool me once, shame on you. Fool me twice, shame on me. Fool me 140 counts of fraud, shame x 140 on me."
This is so Gary. You can't just give people a lot of money or power with no over sight. When I worked for Gary I gave him a monthly list of everything I did. I kept track of my hours and accomplishments. He never even asked me to do this. This is what honest people do. The second he wasn't offered any records or receipts is when Gary should have stopped this nonsense. I blame Gary for getting suckered. And again, he doesn't claim to have lost money.
I'll post the documents though the case is in lasuperiorcourt.org under "Neil David Campbell" or case number BC378888. Campbell and Powers were arrested because they were found in contempt of court. They were found in contempt of court for not responding to discovery requests. I believe they just could not afford to respond. In a way Defendants lost their case via default. They did not respond. It wasn't a real win for Gary Michaelson, Michelson. Because they were in contempt of court a warrant to appear was issued. They were arrested on those warrants. They weren't arrested because of the current criminal case against them.
These two people are I believe bankrupt, penniless, lives destroyed, still, Gary is not satisfied. He wants them in prison because he needs a pound of flesh. He needs a pound of flesh because he's mad that he made bad decisions by not checking out his business partners, not asking for reports, not trying to verify sales prices or values immediately. He can't blame himself so he must blame others. He can't just blame them he must publicly destroy them so people will "know" that they were evil and he is the great and wonderful Dr. Gary Michelson who saves kitties, puppies and old ladies' spines.
Let this be a lesson to all. Don't do business with Gary Michelson. He loves you one day. The next day a moocher will bad mouth you so they can do business with him. Gary is a VERY POOR JUDGE of character. He's easily conned by charismatic snake oil salesmen. Gary will then attack you and beat you to death with his lawyers and wallet. Thank god there are those who know about all the skeletons in the closet so they won't receive that treatment.

After reading Gary Michelson's original complaint he comes across as the worst business man on the planet, a truly gullible person. Who just works with people without doing a background check? Who just hands people money without asking for receipts or proofs of purchase? Then WHEN he gets ripped off, he wants them buried in a shallow grave in the desert.
Mary Cummins of Animal Advocates is a wildlife rehabilitator licensed by the California Department of Fish and Game and the USDA. Mary Cummins is also a licensed real estate appraiser in Los Angeles, California.
