There was a hearing this morning at 9:00 am 5th Fl Roybal courthouse in downtown Los Angeles. Richard Powers was not extradited to Costa Rica. The judge is taking the status conference hearing today under submission. Both parties will argue one more point in a motion then the judge will rule without another in person hearing. Richard Powers and 17 of his friends were in the courtroom today. Defendant gets 30 day to file a motion on one issue and Prosecution gets 30 day to reply. Judge will rule after that from the bench.
The issue under consideration is the interpretation of the extradition treaty between the US and Costa Rica. At issue is double jeopardy. Powers was already tried in the US for certain issues. He cannot be extradited to Costa Rica for the same issues upon which he was already convicted in the US.
