June 5, 2018 the US filed their Extradition Memorandum with a declaration from John Lulejian and Exhibits. I just started reading it and it's pretty ridiculous. Gary Michelson states he had an agreement where he would give money to Richard and Richard would buy land for him. There was no such agreement. Richard offered him land at a price. Gary agreed to the price then sent money and received the properties as agreed. Gary now says Richard was the manager of C&M Investments. No, he wasn't. Richard was supposed to tend to the teak farms. There is an agreement for that.

In this convoluted summary Gary states that he gave Richard  money to buy land and Richard "instead" bought cars and real estate for himself. Gary gave Richard money for land and Gary received the land. Richard used his own money to buy cars and real estate from the profits of selling land to Gary and others. Surely the Judge will be able to easily see this. I'll post the doc after I finish reading it. It's 99 pages. Fortunately the main memo is only 39 pages. Below is the doc.

This memorandum is so crazy it reads as if Rudy Giuliani wrote it. The legal gymnastics involved in contorting extradition case law is mind boggling. First of course is their premise that Gary gave money to Richard to buy land and instead he bought cars and real estate for himself. Gary gave money to Richard to buy land and Gary received the land for the price he agreed upon. The memo also says that Richard was the manager of C & M Investments. He was not. Richard did sign an agreement about taking care of the teak farms and plantings.

The memo states that Richard is not allowed to present any evidence that conflicts with the memo. That would mean Richard can't defend himself from these lies. The memo states that the Judge only has to rule that the person in court, Richard, is the same person mentioned in their documents. It goes on to state that the Judge does not have to determine if a crime has been committed or if there is sufficient evidence of a crime. The memo states that the state may present hearsay evidence. They don't have to have live people testify. Lastly it states that it is the Secretary of State who makes the decision about extraditing the person, not the Judge. This sounds like the same insane legal gymnastics in my case in Texas. In my case the Plaintiff forged almost all of their exhibits and submitted perjured testimony. I gave absolute proof in the trial court and the real exhibits are online. The appeals court ruled I didn't even bring it up in the trial court. If I didn't bring it up, why would the Appeals court mention it? Texas Appeals Court helps lawyers and parties commit the crimes of forgery and perjury. So much corruption in our judicial system.

Oddly the letter in exhibit A states not to include the draft opinion in any court filing yet it's included in the court filing by the person who wrote the letter stating not to use it or give it to the court.
