Plaintiff United States of America, by and through its counsel of record, the United States Attorney’s Office for the Central District of California and Assistant United States Attorney John J. Lulejian and relator PHILIP RICHARD POWERS (“POWERS”), by and through his counsel of record, Nina Marino, respectfully request this Court to reschedule the extradition hearing from April 6, 2018, at 11:00 a.m. to August 16, 2018, at 11:00 a.m.

The parties further request this Court to set the following briefing schedule: 

1. The government must file its Memorandum in Support of Extradition on or before June 4, 2018;

2. POWERS must file his opposition to the Government’s Request for Extradition on or before July 9, 2018;

3. The government must file its Reply Memorandum on or before August 3, 2018;

4. POWERS must file his sur-reply on or before August 10, 2018.

This request is supported by the following reasons:

1. POWERS is analyzing an issue of Costa Rican law relevant to the extradition proceedings, and needs time to consult with attorneys in Costa Rica.

2. The government anticipates that Costa Rica will supplement the materials supporting its extradition request. In addition to the time it will take for those materials to arrive through diplomatic channels, the parties will need additional time to review the materials.

3. POWERS currently is not in custody.
