Request for letter response from Appellate Court Judges - Gary Michelson case

I don't know why I didn't receive notification of this as I'm signed up to this case. Fortunately I happened to check the docket manually.

I think the Appeals Court wants to give Appellees i.e. DA, absolutely every chance to prove that there was theft. If I remember, the deeds the DA wanted to submit to the court were all in Spanish. The Judge refused them as they had not been transcribed into English by an independent translator. There was no other proof of what Defendants paid for the land. The DA only had proof of what Gary Michelson paid Defendants for the land.

Another thing to consider is let's say Defendants paid $100 for the land. They still had to pay to clear title, clear squatters, escrow, title, remove liens.... After the land met all of Gary Michelson's requirements then Gary would buy it. If they paid $100 for the land then spent $100 to clear it, Defendants would have been in the land $200. If Gary Michelson paid $200 for it, there would be no net gain to defendants.

Even if Defendants paid $100 for the land, invested another $100 to clear it over the course of a year, then they sold it for $1,000, that still would not be theft. They used their own money to buy the land and clear it. The most important thing would be what the land was worth. If Gary paid $1,000 for a piece of land worth $1,000, he lost no money. In this case Gary made a huge profit on the land. I would gladly pay $200 for a piece of land worth $1,000 any day of the week.

As the request is due 12/18, I will assume there will be no opinion until after the new year with holiday recess.

The People's theory of the case was that the amount of money that defendants stole in count 46-i.e., the gravamen of the offense-was the difference between the price at which defendants arranged for the properties specified in count 46 to be acquired and the sales price they presented to and was paid by Dr. Michelson. Defendants contend that insufficient evidence supports their convictions because there is no evidence of the original price for the count 46 properties. [...]

Gary Michelson brags Found Animals is 10 years old. Two days later closing, restructuring.

December 8, 2015 Gary Michelson announced Found Animals had been around ten years. It was legally formed as a corporation in 2005 but they did absolutely nothing until starting maybe 2008. They weren't really doing much until 2012.

Today the employees were told they were no longer needed as they were restructuring. Merry Christmas! What a horrible time of year to deliver that news. Employees said it didn't come as a shock to them. They expected it. Ten people had left on their own and the others were let go. They had a very high turnover rate in terms of employees. They are fired as of December 31. They can work the last 21 days or leave now.

Gary Michelson is extremely fickle. When I worked for him one day he loved someone. Next day he hated them and wanted them dead. In the beginning goal of Found Animals was spayneuter. Next day he said "I never said that was the goal. It's going to be microchips and pet kiosks." Next day he said "I never wanted microchips or pet kiosks! You're all trying to profoundly cheat me!!! Police!!!!! Steve Cooley!!!!! I can give you lots of money!"

Just learned that Found Animals do not give Christmas bonuses. On top of this they demand donations and beg for volunteers. A billionaire who said he wanted to start a foundation so he could give all his wealth to "good" causes. Sounds like Zuckerberg's "foundation."

Gary Michelson started Found Animals with his $75,000,000 prize offering. He never awarded the god damn prize! I sent in four prize winners then he changed the damn rules. Every year he moved the goal posts even farther away until they were impossible and made no sense. I thought he did the silly prize just to get some guys, ass kissing, friends, good PR. Initially he told me he wanted to be anonymous. LA Weekly wrote an article using his full name. I contacted Gary who said he was so pissed the writer did that. I, stupidly, contacted the writer and told him that was not what he agreed to and it was not very nice. Writer told me Gary demanded to have his name included. He did. Gary lied to me. He put a little money in Found Animals but never spent it. Looks like more tax evasion to me. He did that with Gary Michelson's Medical Foundation. He put in $108,000,000 then spent $3,000,000? I have to look up the 990's again. I believe I posted them here.

Oral argument summary - Dr Gary Michelson criminal case, Ex-Forbes billionaire, Spine, patent

Appellant spoke first. Jonathan Michaels spoke for a couple of minutes. The Justices interrupted and asked a few questions. Then the Justices asked the Attorney General representative to speak. The Justices asked him what type of case was this. The AG stated it was "larceny by trick." AG said that defendants marked up price of land by 40% to 50%. Justice asked AG how much defendants "stole." AG said paraphrased "count 3 was for a $759,000 purchase." Again Justices asked him how much defendants "stole." Justice rephrased the question "Do you have any proof what the defendants paid for the land?" AG said "no." AG then said paraphrased "Powers was only supposed to take a 6% commission." Of course we all know there was no such oral or written agreement. Justice then asked, said "you have no document, no physical evidence of what was stolen." AG admitted that Gary gave an agreed upon amount of money i.e. $759,000 and received the agreed upon land. I believe the Justices wanted the AG to admit that the state had no proof of anything being stolen as they had no evidence of what defendants paid for the properties. If you don't know what they paid for the property, you can't prove if they made a profit or had a loss.

The Justices did not bring up the fact that the one standing claim should be a misdemeanor which should then be dismissed under the new proposition as both defendants did not have a record.

As per the Appeals case file the exhibits were returned to the county clerk four days before oral argument. That means Justices already read the briefs and saw the evidence. It appears their minds were 99% made up before oral argument which is normal. The actual opinion is due at the latest February 1, 2016. Below is the case file, docket.

Based on the evidence and law that I've seen the defendants are of course innocent. We can only pray that the court will be fair. This case should have been dismissed in the lower courts. I think the superior court judge just didn't want to do that because of pressure from the DA's office because Gary Michelson gave Cooley money. Gary Michelson also took Cooley and his office out to lunch to "thank them for their work on this case" per Gary Michelson in court.

Case argued this morning. Opinion will be filed by 02/01/2015

There was oral argument this morning in the Second Court of Appeals at 300 S Spring street. The case has been submitted. The opinion will be filed by February 1, 2015. We shall see if there will be justice.

As it stands there is just one count on appeal. The question is, is it a misdemeanor. If it is, should it be dismissed as it was first offense for both defendants after the passing of recent proposition 47. After those questions are answered, there will be more.

Gary Michelson writes new life story for wife Alya Michelson - ex Forbes billionaire

I'd posted the real history of Alya Michelson which I pieced together from the Internet and people who've met her. I'd also posted the fake history of Alya Michelson which Alya told the world. Since then Gary Michelson has written a new history for Alya Michelson. Which one of these is the real history? Based on facts it's the one I posted.

Alya Michelson told the world she was the first test tube baby. She wrote and sung the song used for the opening of the Olympics in Beijing. She was a singer, rapper and a Kremlin correspondent. None of that was true of course. Such huge lies which were easily disproven yet Gary Michelson believed them.

She tried to be a model but didn't get any work as far as I can tell. I searched in Russian and English for all her names. She then had a Russian mail order bride website where she looks a little heavier and very rough. She said she was a Kremlin correspondent when all she did was translate Russian news copy into English and not very well. I don't see any video of her work doing news. I see no evidence of any other work.

Her dad works in and with the Russian government. I'm sure he swung getting her the volunteer job in Beijing. He probably also got her the press job.

Originally I found it odd that their first child a girl was named Sasha. In Russia that is a boy's name. I then realized that her Russian boyfriend is named Sasha. She named her first kid after her boyfriend. That's okay because Gary named their third kid after his dog Grace. Tit for tat. I think the middle boy being being named Isaiah was a hat tip to the fact that he's Jewish. Even though he said horrible things about his mother his entire life he still wants to try to please her.

Looks like Gary is using Alya as a campaign contribution funnel.

After three kids and having to put up with Gary Michelson, can't blame her. If you notice, neither is wearing a wedding ring. Gary Michelson makes own "Forbes Billionaire" video about himself? Looks like it

Gary Michelson paid one of his employees to load up (make?) a video about him and the Forbes billionaires. This was loaded up May 2015 AFTER he was no longer on the list. The video says September 2008. I think he was off the list at least the last two years. You need $1.65 to get on last year, $1.7 B to get on this year. In this video he had $1.5B.

I searched the Forbes website and can't find this video. Did Gary Michelson pay someone to make it? I also think Gary was behind that silly Gary Michelson song video.

Gary did make it into two articles about "Missed the Cut: The Billionaires Too Poor To Crack The Forbes 400." His page in Forbes says he was #395 in 2014. I remember that he was not on the list. He probably fought them over his listing like Donald Trump and the middle eastern person.

I assume Gary Michelson harassing the Forbes people last year to make sure he was on the list is the reason he was highlighted this year as an official drop-off. Dr Gary Michelson is too poor to be on the list. He must be fuming.

For the at least second year in a row Dr Gary Michelson is NOT on the Forbes 400 lit of wealthiest people. Gary Michelson was very upset he didn't make the list last year and swore he had $1.65 billion in order to try to make the list. In previous years he worked hard to make sure he was on the list. Money is very important to Gary K Michelson.

State Attorney abuses the system to get extra time. State filed reply brief. Reply due 9/2/2015

Just as I thought the state intentionally didn't file in time knowing they'd get an extra 30 days automatically. They waited until the very last second and filed 8/13. Appellant now has until 9/2/2015 to file a reply brief unless they ask for an extension.

Gary Michelson isn't truthful about donations to medical research - Forbes billionaire

Gary Michelson claims he donated over $100 million to cutting edge medical research. http://michelsonmedical.org/what-we-do/ Unfortunately that is not true.

As per his tax return below he donated $100 million to his medical research foundation. The money is still sitting there. He didn't spend it on medical research.

Sounds like he may be using DAF to avoid, evade taxes. That's probably the main reason why he started these non-profits in the first place, i.e. he hates paying his fair share of taxes.

He already got in trouble with the IRS for tax evasion on illegal tax write offs as per his lawsuit against Proskauer. Maybe that is what's happening here?

Remember he also offered a $75 million prize in 2006 or 2008 I think. It's been years and he hasn't awarded the prize even though he was given drugs which cause permanent sterilization. Gary enjoys dangling meat in front of dogs.

California Attorney General office did not file reply brief. Dragging it out for more time? Gary Michelson

David A Voet of the California Attorney General's office did not file his reply brief. I'm sure he will file his brief. I would bet he's just trying to get more time. Appellees did the same in my appeal. I then filed motion for sanctions as they filed two 60 day extensions then didn't file a brief. Within a day the Appellees in my case copied someone else's reply brief and filed that. I believe it was someone else's brief because it had the information of an Appellant other than me.

I just hope Neil and Richard win this thing soon. Their lives have already been destroyed. Gary took every penny they had and destroyed their reputations.

In order to have personal information removed about yourself via the "right to be forgotten"law in the UK you must state and show you are a resident of the UK. That means web sheriff lied and told Google that Gary and Alya Michelson are residents of the UK? You have to show an ID card from the UK with a physical home address in the UK.

Gary Michelson and Alya Michelson live in Brentwood, California 90049. It is stated in my places all over the Internet. They posted they live there.They publicly posted the name of their third child. You can find it by searching Gary and Alya Michelson. Gary named his kid after his dog. Gary also wanted public parts of a book about him and his purebred bought and paid for pitbull removed from the internet. Gary talks about Bull all the time. State asks for another 30 day extension after being told "no." They got seven days, Gary Michelson crazy billionaire

The state asked for their third extension. They first requested 60 days and got 30 days. Then at the end of 30 days they requested 30 more and received it. They just requested 30 more and got seven. I think the state is just extending things to drag things out as much as possible.

State makes third request for extension of time to reply, crazy - Dr Gary Michelson, Forbes, billionaire

I received this email alert this morning. I thought it was for my appeal. Respondent in my appeal said he would request an extension as his reply due same time as this one. When I finally looked at it more closely I realized it was for this case.

This is their third request for extension of time. First time they requested 60 days and got 30. After 30 days they requested another 30 days. Now at the end of that time they want another 30 days. They'd better have a damn good reason for this request like the attorney in charge died or something. This is crazy.

Gary Michelson wasting tons of money to remove things he himself posted and shared on the Internet

Looks like the sheriff has been suckering Gary Michelson into giving him more money to try to remove things. Two blogs posts were hidden from the uk version of this blog. They are still here in this website. No one in the UK even knows who Gary Michelson is. They also don't look at the uk version of this blog.

The blog posts were about Gary's 95 lb pure bred pitbull which he bought. Everything in that post came from public books and newspapers.

The other was about Alya Michelson hating Gary Michelson. In that post I quoted from a public media document where Gary announces the birth of his kid posting her full name. That is "private" information? Then why did he announce it to the world? Alya's posted pics of her kids online. Her daughter is incredibly cute and fortunately look like Alya. In odd coincidence Gary's kid looks exactly like the clone of Neil Campbell's kid. Maybe that is why Gary bought a light skinned blonde wife. He wanted a kid just like Neil's kid.

I just realized that Gary named his kid after his dead dog Grace. At least "Grace" is a pretty name. Here is the newsletter where Gary Michelson released the news of his new kid. Go sue them, Gary! Make them remove what they wrote from a religious newsletter. Page five from the below link,

This is St Matthews Church in the Palisades. Gary Michelson is of course Jewish. His wife is not. She is Episcopal. Lucky for her he allows her to go to church. Otherwise she's trapped in the castle forced to buy trinkets from Tiffany's online while she sleeps with the dog whom she calls her husband. The award is basically a receipt for money. "Thanks for the money. Here's a piece of plastic." His employees keep posting about this award every week as if it's a new award. It's not even an award but a paid for piece of plastic. This was posted half an hour ago.

Dr Gary Michelson still on the hook for Medtronic lawsuit - Forbes billionaire

Gary Michelson was dismissed from this major lawsuit over his threaded spinal cage invention which he stole from someone else and patented. Appeals could just put him back into the lawsuit. He is a nominal defendant as Medtronic stated he didn't manufacture or market his patent or medical device.

Extension granted: States requests another extension after being previously denied. Gary Michelson, Forbes, billionaire, teak farm

UPDATE: 30 day extension granted. Respondent's brief due 07/06/2015.

They requested two month extension and got one. Day before reply brief due they request another 30 days even though they were originally denied. They would need a damn good excuse. I'm sure they'll
"find" one.

My personal feeling is the state is requesting extensions to drag this out because they know they have no case. Just trying to postpone the inevitable. Fortunately the prelim judge was pretty just. The trial judge was a little just. The jury is the one who made the verdict. I think the trial judge really should have reduced then dismissed the one charge. Hopefully the appeals court will be just. I've seen some good and bad opinions.

This case involves money, power, politicians, campaign contributions. The DA past and present is very close with all the judges in criminal courts. They know each other very well, have worked together.

I've seen some really horrible appeals in civil court. The judges received campaign contributions from the big corporate parties and others. They ruled for the big corporations even though they were in the wrong and up against one of the best attorneys I've ever seen. We can only pray for justice.

Attorney General requested extension and was denied in part. AG represents state of California

The Attorney General is representing the state in this matter, not the District Attorney which represented the state in the local case. The AG's office is in the same building as the Court of Appeals. I believe the AG is the one who gave the DA permission to arrest Neil and Richard and have them extradited back to LA. I need to confirm this.

It's interesting that the Appeals Court only gave a 30 day extension when they requested 60 days. In my case the same court gave the Appellees two sixty day extensions and they still didn't file their brief. Perhaps the Appeals could had found the AG abusive in the past in making extension requests? I don't know.

A friend of mine is a highly educated, brilliant and experienced attorney. He filed a case for an insurance claim and lost is superior court. He went to the appeals court with his very solid case. He lost. He filed a petition for rehearing which was granted then still lost. He lost all faith in the justice system and was considering abandoning the law profession. Fortunately he didn't.

I for one know first hand how incredibly corrupt our judicial system is. There is a major conflict of interest here between lawyers and judges. Many articles have been written about the fact that judges are close friends with lawyers.

In order to be a judge you must be a lawyer first. Most criminal judges are past city prosecutors. If a lawyer wants to become a judge, he knows he has to make campaign contributions to the winning candidate for the DA's office and other political offices. The lawyer must join every law organization, bar association and legal club. The lawyer must get cozy with all the existing judges and their friends. Lawyers are the major contributors to Judge's campaigns. Judges should not be allowed to take contributions for lawyers, law firms or law organizations of any type. In Texas it's the same way. Most contributors to Judges are lawyers.

In exchange for campaign donations or just personal relationships the Judges will bend the law and rule in favor of their donors or friends. That's just how it works. I have campaigned for politicians and causes. The main thing the animal people do is donate to animal friendly candidates.

Legally a judge must disclose any relationship he has with any attorney before a proceeding begins. Of course they don't do that. My judges didn't disclose their very, very close relationships with Plaintiffs' attorney and his wife. I even put the Plaintiffs' attorney on the stand and he admitted he had a long standing relationship with my judge. They meet at all the legal organizations events, are on the same boards of directors, bar association.

I personally believe anyone who wants to be a judge should not be allowed. They should be randomly nominated from an anonymous pool of highly experienced lawyers with good reputations. They should only get one term of four years. There also needs to be more disclosures about relationships to parties. I've been in court where a Judge said to an attorney "I think you interned for me 20 years ago. Did you?" The attorney replied yes so the Judge stated he had to recuse himself. In my case none of the judges did this even though they should have.

Cost of college education has not increased due to cost of books as Gary states. The cause is extra administration and new buildings

The article below in the NY Times states that colleges have told the public the rise in tuition was caused by a drop in government funding. Turns out the opposite is true. Government funding has increased yet tuition rates still rose disproportionately to price of car and professors salaries.

The real cause for the increase in tuition as per the article is the increase in administration staff and their salaries. Professors are making almost the same as they were in the 1970's.

I have another theory which I believe also applies to larger non-profit organizations. Most of these schools are non-profit organizations even though in most cases they are for profit in reality. Let's take USC for instance. When I went to school on scholarship 1982 tuition was $18,000 and included dormitory and food. Today tuition is $45,000 not including dormitory or food. The price of books is only slightly higher in today's dollars. My most expensive books were $75 and $100 used. I'd trade them back in end of year and got most of my money back.

I believe the main reason behind cost of college tuition is new buildings. USC is a non-profit organization. They make money off tuition, store, sports. They also derive income through donations. As a non-profit I can from experience state you can only get a donation for a building, physical asset or project. People mainly want to donate for say enclosures so they can see the physical result of their donation. In the case of USC they sell naming rights to buildings for about 25% of the construction costs.

In order to get donations universities have to keep on building or buying things. When the new buildings are finished maintenance costs for school goes up, i.e. utilities, insurance, janitors, security, administrators, assistants... As the school keeps growing, the cost to maintain the school keeps growing. There is an ever growing need for donations which forces the schools to keep on building and spending.

The donations don't benefit the students. USC really doesn't need more buildings yet they keep tearing down smaller buildings just so they can build bigger buildings and sell naming rights. They also start new projects in people's names with donations. These projects need administrators and other non-professor employees. This causes maintenance costs to increase. The projects don't benefit the school but sometimes the community for a short while like student tutoring programs.

This is why I'm all for online education for people beyond high school. I am for free digital books and digital video classes. I myself write manuals which are free. I post educational videos which are free. We really don't need a bricks and mortar building in which to learn book classes. We do still need some hands on labs for medical, dental students and the like. They just don't have to sit in a building for non-hands-on learning. Hopefully in the future we will veer away from physical schools and even office buildings with the help of technology. There is no reason for people to drive to a building and sit there for hours a day to learn. We would save so much money on costs, traffic and related expenses.
