Recently Dr Gary Michelson lost a lost a lawsuit against Proskauer. In that suit he claimed he invested in tax shelters recommended by Proskauer which were not legal. The IRS stated that Gary Michelson owed $48,000,000 in unpaid taxes. Gary Michelson sued Proskauer for a $20,000,000.
Gary Michelson lost the lawsuit because Proskauer stated they offered to help defend a lawsuit from the SEC if there were a lawsuit. There was no lawsuit. Gary Michelson just gave the SEC the money they requested. Proskauer stated they gave no other promises. In this case Gary Michelson "lost" $48,000,000 and lost the case. There was no malpractice.
In another lawsuit Gary Michelson sued an appraiser who incorrectly valued a property higher than what it was worth. Gary Michelson gave a second on the property based on that value. The owner defaulted and the property went to foreclosure sale. Gary Michelson for some crazy reason bid the price of the first and his second. He then went to sell the property and could only get the price of the first.
Gary Michelson lost that lawsuit even though he lost money. He lost because Gary didn't have to bid the price of the first and second. He could have bid the price of the first and more than likely would have then owned the property. Or he didn't have to bid at all. Had he not bid and it sold for only the price of the first, Gary might have had a case if he could prove the initial appraisal was wrong.
Back in 2007 there was a third false claim of fraud involving Gary Michelson. Gary claimed his ex-director embezzled money. Gary Michelson reported this to the LAPD. LAPD stated there was no evidence whatsoever of any crime. They refused to press charges. After this Gary Michelson kept telling people the LAPD would be arresting his ex-director any day for fraud. The ex-director then sued Gary Michelson for defamation and received an instant settlement.Gary Michelson has so far cried "wolf" three times that I know of and there was never a wolf.
This brings up to the civil case against Neil Campbell and Richard Powers. Gary sued Campbell and Powers for fraud stating he lost money. Gary Michelson didn't lose any money. The only reason he won the civil lawsuit was because I believe he committed motion abuse to the point the defendants could not respond and lost by default.
Today is the beginning of the criminal trial dealing with the same issues as the civil case. In this case no money was lost or stolen. No property was stolen. There was no agreement for a six percent commission. There was an agreement for cost to plant trees only. There was no signed contract guaranteeing a specific return on investment. Gary Michelson merely bought and received land for a price. There was no fraud.
It will be interesting to see how things play out in this trial. One major issue is the inappropriate and most likely ethics violation caused by the personal relationship between Gary Michelson and DA/ex-DA Steve Cooley and DA candidate/current DA Jackie Lacey. There were very suspicious campaign donations which were given right before action was taken on this case. There was a private "thank you" lunch with the DA's office and Gary Michelson.
It will be interesting to see if there will be justice in light of Gary Michelson's history of crying "fraud" when there was no fraud. It'll be even more interesting to see if Gary's relationship with the DA will influence this case. Fortunately there is a jury trial so it won't be up to a Judge.
