Dr Gary Michelson's bizarre testimony today - Forbes billionaire crazy

During the entire time that I've known Gary Michelson I have always found him to be bizarre. I used to consider him just eccentric but now I know better. Today he took his bizarre to a whole new level. He truly lives in his own reality which he created out of thin air. My comments are in parenthesis.

I missed the first half but was caught up. The Judge had a meeting with Gary Michelson's attorney Luke Dauchot and the other lawyers in chambers on the record. Then the Judge spoke in chambers ex party with Luke Dauchot off the record for three minutes or so.

Part of the audio of the interview with Gary Michelson and Villasenor was played. Gary Michelson admitted he had a meeting with DA Steve Cooley. Gary stated he sold most of the property recently for $32M. (some believe he probably sold it to a straw person to try to make it appear it was not worth as much) Previously he stated there were no appraisals. Then he stated there was an appraisal for $100M by Martine a teak expert whom he hired. Gary paid apx $25M for the land. In mediation P offered him $40M but Gary refused. His original claim stated he lost $5M. Person in charge of his farms after P appraised land at $100M. (Obviously Gary made money and didn't lose any).

1:30 N's attorney Johnathan Michelson (JM) had Gary on the stand. He questions him about when Gary knew something was wrong.( This deals with statute of limitations. Getting straight answers out of Gary was like pulling teeth today. He also had some truly bizarre responses. Gary's lawyer was not there after 12.)

JM questioned Gary about his previous sworn statements which show Gary was concerned something was wrong beginning of 2005 and end of 2005. (You have 3 years from the fraud or discovery of the fraud to file a civil suit. For a criminal prosecution, the statute of limitations for a felony fraud is 4 years. This case should be thrown out based on statute of limitations alone. I think Gary filed the criminal complaint in CR 2007, one here March 2012 or seven years later. Gary sued P in CA civil court in 2007. Why did he wait so long to file the criminal complaint? Probably because he had no yet schmoozed DA Steve Cooley and LAPD knows he's crazy. Gary donated to Cooley in 2010 and his replacement in 2012).

2005 Gary asked for records for land sales, expenses from P. Supposedly P gave him one excuse after another. 2005 David Cohen thought something was wrong. Gary said he, Gary did not think so. He goes back and forth with this. (He forgets yesterday he said Cohen took over all business for him in 2005 because Gary admitted he was a bad business man.)

March 26, 2006 Gary went to CR to meet with Martine who had taken over running his farms. At that time he realized that P was taking multiple commissions on the sales. (Yesterday Gary said he never went to CR. Today we find out he was there three times)

Gary bought 147 properties in all. Gary got a $24M judgement against N. Gary stated "I didn't get a penny from N!" JM asked him if Gary got $2M from the forced sale of N's home. Gary says "no!" (Everyone is confused by his answer. Gary got a judgment, sued N in Florida and forced the sale of his home. I posted all the docs here previously.) Gary continues "I didn't get a penny!" JM again asks "didn't you or one of your holding companies get money from the sale of N's home?" Gary said "that was my home! It was MY house!" JM asks "did you live in it, ever go there, did you buy it?" Gary says "no."(It was N's home. In Gary's odd mind he feels that because N used some money he got from Gary to buy the home that he Gary actually owned it. N had money from the sale of his Dana Point home.) JM says "let's not be cute here" to which Gary replies "I'm not being cute. I take offense!" Judge tells them to knock off with personal comments. Gary ultimately admits that perhaps one of his holding companies might have received the funds from the sale. (Trying to get a direct answer was so difficult today. Gary danced around when he thought there was something wrong. If he filed a criminal complaint in CR in 2007 and admitted in that complaint he knew something was wrong in 2005, the statute of limitations are over here in CA. Gary also admits he lost no money. Case closed at least to Powers)

In Gary's CA criminal complaint he states he the victim wired $28M up to March 2006. He bought 23,000 acres. 2014 he sold 21,000 acres with trees for $32M. He still has 2,000 acres. (Obviously there is no loss here but Gary still claims he lost money. Plus, if it was appraised at $100M by Gary's own expert, why sell for $32M?)

In 2012 Gary admits he had lunch with DA Steve Cooley and the main people in the DA's office while his criminal matter was pending. Gary was invited by a secretary of Cooley to have lunch so Gary could thank them for their help in this case. Gary ended up paying for lunch. Gary admits his lawyers gave docs to DA Steve Cooley. Gary said that was the only time he'd met with Cooley. (Not true. Cooley invited him to stand next to him in a press conference. I posted pics. Gary then gave Cooley an award at a big event in his honor. I posted the event with pics. In that event Gary gave Cooley an award for something he had nothing to do with)

P said he had someone who was willing to buy Gary's land for $60M. Previously Gary said "if it's worth $80M, I'll take $60M, you P can keep the $20M and we can all go home."( Today his answer changed. If Gary had sold it then there would have been no case at all.) Gary was upset that he couldn't sell it for $120M. Gary admits he did not find the properties or improve them. P did that.

U cross examined Gary. Did you know Knowles and Villasenor were working on your case when you went to lunch with Cooley? At first Gary hemmed and hawed then he admitted that he did know because he'd met with them. U asked him why Knowles and Villasenor were not at lunch when they were the actual people working on the case? Gary said he did not know. Previously he said he had lunch with a woman, Cooley, Chief, Asst Chief, head of investigations unit at a restaurant on Sunset to thank them for their work on his, this case.

U shows him P's "consulting agreement." U asked Gary if there is a 6% commission in the consulting agreement? Gary said no. March and April 2003 you expressed concerns about P? Gary went on a little rant and U said "objection, strike, non-responsive."

U then showed Gary a letter from his lawyer Capps to Gary from 2003 about concerns Gary had with P. Judge ruled even though it's a lawyer communication which would be privileged, the DA gave it to Defendants so it's now in the public domain. (Generally this can mean that ALL attorney/client privileges are waived if the party puts a privileged communication in the public domain). In the letter Capps is concerned about purchases.

Gary again refuses to admit that C&M bought property from P. Gary insists he bought directly from seller via Neil and C&M. Obviously that is not the case.

Break. Judge says he has an important out of country appt on Friday so we need to finish by Thursday. We will start earlier, end later and shorter lunch. Start at 8:30, one hour lunch and end at 4:30.

Gary then confers in private with K. Later Gary again confers with K asking him questions. We take a break. As I go out an FBI looking buy with two full semi-auto mags on his belt walks in the court room. When we go back in that FBI guy walks out of the Judge's chambers right ahead of the judge.

Back from break. U retracts exhibit E because of an issue. 7/2006 letter P said he had a buyer for the prop for $60M minus a commission to P. Capps responded to P stating the prop is not for sale. Gary said he didn't want to sell if P was in the deal and got a commission. (What an idiot. He also said something different yesterday which I posted above) Next second Gary said he" would have sold for $60M in a heart beat." (I assume this means without P getting a commission.)

Gary said he relied on P's sense of value of the property. He said he paid what P told him to pay. Karlin Holdings is Gary who wired the money. Gary also owns GHM. C&M is Campbell and Michelson.

JM asked him why he bought the land. Gary responded "I wanted to do good in the world by planting trees. It was also a good investment. I improved the world by planting trees." (And now he's wasted a whole forest of trees in the paper involved in this silly case.)

Gary stated N came to him and said he really needed $500K as he was in big trouble. Gary offered to loan him the money but N said he'd prefer if Gary bought him out. Gary bought out N's less than .5% interest in C&M for $500K. (If it were .5% that means C&M was worth $100M.) August 2008 Gary bought out N.

Early 2005 Gary asked Munoz to find out how much the sellers were paid for their property by P. Gary found out it was a lot less. Munoz was Gary's lawyer in CR. Gary spoke with N and P who said they sometimes had to pay with cash in some odd deals where the actual sales price was not correctly listed. N and P blamed it on the sellers. Gary said he believed that explanation.

Andrea Martine got information to give to Gary January 2007. The report stated that only 27% of the land had trees planted on it. P supposedly stated that 70%+ of the land could be planted. (Maybe all the trees weren't planted yet?) Martine said only 10% of the land is good to plant teak. U objected as Gary was stating facts but Judge over ruled stating Gary is just giving his thoughts, frame of mind. His testimony is not being accepted as facts.

Lunch with Steve Cooley was August 27, 2013. This came from April 2014 email from K.

U asked Gary if he ever rejected a property P offered him. Gary said no. (this is not true). U did the math on value of N's share being $100M. Gary then said that N's shares weren't worth that much but N said he needed the money so Gary gave it to him. Originally Gary said N figured out his shares were worth $500K.

JM Is this your partnership agreement with N? (it was one page) Gary said yes but there was also another agreement. (A one page agreement? I doubt there was a fiduciary clause or anything like that in a one page agreement).

April 30, 2013 K sent an email saying lunch was at a restaurant on Sunset called Freniente? Herb Hazel, Chief, Assit chief, Captain Beemer? and woman were there. The purpose of the lunch was to thank those who worked on the case. V and K were not there. JM asked why not? Gary said he didn't know. (Gary previously donated to Cooley in 2010. Gary donated to current DA in 2012 immediately before this criminal investigation began.)

In 2005 Munoz found out the sales prices of the land. Gary said no. JM then said "you deny the criminal complaint you made in CR which says this?" Finally Gary admits what he wrote in his 2007 criminal complaint in CR. Gary tried to deny most of his sworn statements today but finally admitted the statements were true at that time. Then he admits he knew something was wrong in 2005.

JM asked Gary his net worth. K objected. (Gary as per what he tells Forbes is worth $1.5B. Forbes gets the numbers from the person. They don't verify anything. Gary also publicly stated he did very well financially in teak farms in interviews and in his website)

U, Exhibit E has a date of April 2003 and July 2003. Gary pointed it out earlier. This came from the DA. (That would mean it came from Gary's attorneys). Gary says he only recognizes the first page, not the rest and that isn't his signature. The letter is from P to Gary stating teak is a long term investment. You must hold for 20 years to realize the true gain. It says by the 5th year you will get your original investment back. After 20 years you will have $36M if you invested $9M.

4:10 pm. Gary may be recalled to the stand to answer to exhibit E. K must produce the original. J told Gary not to talk to any other witnesses in this case until end of prelim.

K said he has a forensic accountant, real estate deed expert and computer forensic expert to call as witnesses. H said he has an objection as to almost every exhibit by prosecution and one witness.

(I have a feeling K is not too happy with Gary being such a horrible witness on the stand.)

DA Steve Cooley history of corruption - Gary Michelson, Forbes billionaire Los Angeles, California

Lord only knows how much money Gary gave to Cooley to "consult." Gary Michelson is listed as a top donor to Steve Cooley in 2010 and 2011 giving the max $13,000 twice. Gary also stood next to Cooley in a government press conference. Gary also held an award banquet for Cooley.

May 2012 a mere week or so after she got her donation she launched an investigation. March 21, 2013 the DA filed charges for 140 counts of fraud against each of them now reduced to seven counts each. August 27, 2013 Steve Cooley asks Gary Michelson out to lunch. The main big brass from the DAs office are also at that lunch. Supposedly ex-DA Steve Cooley used his contacts and influence to arrange this lunch to thank the big brass for their help on this case. Oddly enough the two people who actually did all the work on the case are not at the lunch, i.e. Deputy DA Robert Knowles and DA Senior Investigator William Villasenor. Steve Cooley used his past connections to arrange the lunch. August 27, 2013 was a Tuesday. That would be during work hours for the people from the DA's office. This seems improper.

Seems a documentary was made called "Crime after Crime" about DA Steve Cooley and corruption. From an article about the documentary which debuted at the Sundance film festival in 2011.

"According to her lawyers, the district attorney should have disclosed an internal memorandum that concluded a key witness against her had perjured himself and that they never intended to seek the death penalty against her."

DA Robert Knowles knows for a fact that Gary Michelson has perjured himself many times even in an almost identical situation with Gary's ex director here in LA. He knows this because I told him this as soon as I saw his name mentioned in regard to this case. How can they possibly believe Gary's stories? Gary Michelson even perjured himself in my lawsuit against the City of LA. I asked him to recant, retract his statement and he refused. I even stated at that time that if he is ever in a court case in the future, they can strike his testimony as unreliable because he has previously perjured himself. The DA only has three witnesses and only one real witness which is Gary Michelson. The bank witness admitted that she can't tell if the bank docs are real. She only recognized her signature. The DA's investigator merely interviewed Gary and others. He didn't witness anything.

Quite a few investigative reporters made reports about Steve Cooley and corruption. I realize Steve Cooley is the ex-DA and Jackie Lacey is the current DA. Jackie Lacey was basically Steve Cooley's right hand person when he was the DA. Steve Cooley basically named her for the job when she ran. They are of course very closely related. They also both received campaign contributions from Gary Michelson during this exact time period.

I worked for the City of LA for a while. Yes, it's corrupt, so is County. I saw numbers juggled, girlfriends get contracts with no approval of commission, employees illegally using city time/supplies for their personal use, refusal to properly reply to state info act requests, employees/volunteers being harassed, false reports filed by one employee against another, the hiring of convicted felons, employees driving city cars drunk out of their mind, employees drunk on the job, City Attorney stealing my glasses at a campaign fundraiser so he could have an excuse to ask me out....I told him to just throw away my glasses or leave them in Antonio Villaraigosa's office. The City Attorney was upset by that so he made up a fake story about me in retaliation. I'm happy he finally retired. I've even had people in government offer me favors without my asking. I of course said "no."

The timing of the donations to DAs Steve Cooley and Jackie Lacey is just way too coincidental. The DA's office started it's investigation into Neil Campbell and Philip Powers a week after DA Jackie Lacey received a campaign contribution from Gary Michelson at a party. Gary Michelson previously also gave the max to Steve Cooley. I should not be surprised because Gary asked me how he can get the politicians to do what he wanted. I point blank told him to give them money and he did.

I just realized that C&M Investments was a Nevada corporation. It was not in California. The C&M Limitada in Costa Rica was in Costa Rica.

I thought I would check up on Gary's civil lawsuit for malpractice against Prosakauer in LA Superior Court case BC384760. In this case Gary Michelson claims his accountant committed malpractice by suggesting he buy certain tax free or lowered tax investments. The IRS stated they were not legal and Gary tried to evade paying taxes. He was fined and had to pay taxes.

Gary is sooooooooooooo cheap at times always trying to save a penny here and there leaving himself open to huge liability and problems. I had a relative who was similar. He was extremely wealthy but kept investing in tax shelters losing his ass and being fined by the IRS. He said he'd be wealthier if he just paid all the taxes and put his money in his mattress making no interest. My relative was a brilliant inventor but a shitty business person. I'd say just like Gary Michelson but Gary stole the main invention which he merely patented first. While Gary has many patents, only a very few number made any money. Gary sold the rest of his patents to Medtronic in a package deal. His paper clip patent did not make a cent.

Anyway in the above case Gary's accountant had a caveat, disclaimer in his recommendation of the tax shelter. I read it and the accountant is in the right. Gary is again in the wrong.

This is how Gary Michelson the shitty business man operates. He agrees to do business, buy something, invest somewhere with someone. The other person gives disclaimers. They generally have a written agreement. Gary does not do his due diligence. He just dives in blindly. He either loses money or he thinks someone else might have also made money on the deal or he just gets buyer/seller's remorse. In Gary's mind only he can make money. This makes him furious. He then claims the people "cheated" him. In actuality Gary actually did well on the deal and just doesn't realize it because he's not all there psychologically. In the alternative he did not do well and it's his own fault for not doing his proper due diligence or reading the disclaimers. In the further alternative Gary has just changed his mind like when he bought pet kiosks and microchips.

Of course in order for Gary to not feel like an idiot he must claim "they cheated me! I'm not an idiot. They are criminals!" All his brown nosing friends, employees of course agree with him which makes him even more determined to get his pound of flesh. He then sues, files charges and generally loses. This is the first time Gary has made a charge against someone and they ended up in jail. That probably would not have happened if it were not for Gary giving specific campaign donations at a specific time. The DA investigated the current criminal case immediately after receiving funds. The funds that Gary donated at least legally would never cost what this investigation and trial will cost. This is your tax dollar at work, chasing non-existent criminals in other countries over business which happened in another part of the world.

Day 3 Gary Michelson criminal trial. Interesting twists and turns. Forbes billionaire crazy perjury evil.

Gary Michelson came by himself today. For some strange reason he seemed to be frightened to show up by himself the first day or so. He'd run and hide in different rooms including the bathroom between sessions. I perceived this as the paranoia of a crazy person.

 There was only one witness which they did not want present for other witnesses and she gave her testimony today. There is nothing to worry about me posting my notes. There may be mistakes here. Please, correct me. These are not official minutes but merely the jist I would say.

Walter Urban was still cross examining Gary.
U: Are you familiar with real estate transactions in California?
G: Yes.
U: Are you familiar with the term "flipping?"
G: Ya. I understand the concept.
U: The concept being buy with the purposes of resale after upgrade?
G: Ya. The first property we (C&M Investments) bought was already listed. Therefore the seller paid P 6% comm.
U: Did P bring the property to you?
G: Yes. I never went to Costa Rica. N wanted to be the eyes, ears, even the legs of C&M. He wanted to retire there and a teak farm owner.
U: Did you have lawyers in Costa Rica and the US help you with these transactions?
G: I had a law firm in CR set up by Mr Munoz in 2000 or 2001. They were retained to make sure the property was "cleared" (of liens, ownership, title issues). Bill Capps was my lawyer in the US. He found Munoz for me. I started a partnership with N and myself in 2000. P would notify Munoz when the properties were cleared and Munoz would verify it with records. N had full authority, power over C&M. Once P drove Munoz out to see a farm to verify things.
U: Why did P need a power of attorney to buy for C&M?
G: He needed a power of attorney to buy for C&M.
U: When did this 6% commission start with P?
G: It started with the third property. In 2001 we agreed that P would get no more than 6% comm while negotiating the lowest price from the seller.
U: Are there any records that show 6% was paid to P?
G: Welllll.....in March 2006 P said he never took over 5.8% comm, and again in March 2010.
U: Were there any witnesses to this oral agreement of 6%?
G: N witnessed the oral agreement.
U: Where was P, N and you when you had this agreement?
G: N and I were in LA on the phone and P was in CR on the phone 2000 or 2001.
U: How long did it take to clear title on some properties?
G Sometimes up to five years. P would provide me with an invoice. N reviewed them. N was an active partner. I was a passive partner. C&M Limitado in CR was formed by P and his wife Virginia. Then signed it over to us. C&M Inc in the US is a partnership just to pay taxes. P was the actual manager of the properties and C&M. N was the general partner of C&M, not Powers.
U: When did you first feel concerned about the transactions?
G: End of 2005. That's why I hired David Cohen. "I had a lot of bad investments. I'm not a good business man." Cohen asked for all the records from P but didn't receive them.
U: When were your issues with P settled?
G: Bookeeping issues never resolved. P was flipping properties, doubling the prices, giving money to N.
U: Objection.
J. The last statements shall be stricken.
G. I learned about this in 2006 or 2007.  P gave docs to Judge Febrezian to give to Villasenor in mediation.
U: I want to show you the transcript of your recorded interview with V. Then I want to play tapes.
K: The confidentiality agreement was lifted on mediation when there were no results.
G: Can I talk about confidential mediation here and not be in contempt?

K: Prosecution calls witness Jacquelyne Hernandez with Comercia Bank in the US with bank records of wire transactions of N.
H: Move to exclude witness. She is not the custodian of records. Her testimony is therefore irrelevant. There is a lack of foundation. No chain of custody of records.
K: She wrote the affidavit. She is the custodian of records.
H:  I didn't know that. Still there is no chain of custody. We don't know where these records have been for years. They could be altered.
J: Over ruled.
K: How long have you been at this bank?
W: 16 years. I can't verify that any of the docs are accurate. I was not present for the transfers. I am two levels away from the person who entered the data. I speak no Spanish. These look like the form of our docs but don't know if these are the exact numbers. I can only verify my signature.

She goes back outside so Neil's lawyer can object some more.
H: The DA produced documents which we don't know where they came from. They did not come from the bank. They were requested by the CR consulate in 2009 then came back to the US. They are inadmissible. DA should have gotten records straight from bank. Why not?
DA: Records are older possibly out of retention dates. That's why we got this. H thinks we're "trying to weasel this in."
H: I'm offended!
J: Stop that, you two. Let's bring back the bank person and ask her about retention dates.
DA: What is your retention policy?
W: 7 years. You can't request docs from 2006 today and receive them.
J: Court will receive docs by reference.

DA: How long have you been a peace officer?
V: 19 years, previously with LAPD, 12 years with DA. (he is senior investigator)
DA: Did you tape record an interview with G?
V: Yes. I have a transcript. I went to CR 12/2012. DA, I got the case to investigate 5/12. I didn't get info from G. I got it from his attorney Kirkland and Ellis, Sean Paisley. I also got records from the seizure of P's computers in CR.
H: Objection, double heresay.
J: Objection sustained.
V: I got records from CR police Carlos Garcia. I speak Spanish, learned it from my parents. The DOJ requested computers with CR police help. (P was raided at his home in the morning with his wife and kid there. They took four computers)
(Gary comes back in room says he can't get ahold of lawyer yet. J tells him to talk to a lawyer and come back at 1:30)

G: I spoke with my attorney. If P waives confidentiality, I can testify.
U: J, I'd like to speak in chambers on record. (everyone goes to J's chambers)
J: (back in court) G, I want you to have an attorney present. This is the first time I've ever encountered this in a criminal case.
G: My attorney is civil with no criminal experience.
J: Get a criminal attorney referral.
G: P would not agree to waive it?
J: Can you get an attorney here Monday at 9 am? Go call your attorney again. (G leaves room to go call)
J: Good cause to pause for good legal reason. The question is, is a confidentiality clause privileged in a civil case in a criminal matter? (Judge looks on the Internet) Code of criminal evidence 11.15, 11.19 1998 case Winaker v Superior Court. The right to fair trial trumps any confidentiality agreement in a criminal case. (I personally dealt with same issue in civil court. Mediation, confidential settlement agreements are able to be divulged in later civil or criminal suit. They can be under seal, protective order)

G: I just spoke with my civil attorney Luke Dauchot ( http://www.kirkland.com/sitecontent.cfm?contentId=220&itemid=8256&section=1 ), he quoted 11.19 a 1998 case. If P wants to ask about the confidential mediation, they have waived right to confidentiality.
J: We ended up at the same code while you were outside. Still, I think you need a lawyer present. Can your lawyer be here Monday at 9 a.m.?
G: Yes.

Judge agrees to let all lawyers including G's email him over the next few days about a possible resolution. Everyone must be cc'd so it's not ex party comm.

I ran some more land comps. It seems the cheapest teak farm property you can buy is about $3,000/acre. That means Gary at a minimum tripled his investment. Based on other comps the value is about $10,000/acre. I'm looking at listings, not sales.

These last two properties seem similar to Gary's properties. Gary stated his land was near roads, airport, river.

Here is Panamerican Wood company website. They say they are one of the largest teak wood plantations in Costa Rica at 6,000 acres. You are supposed to take pasture land and turn it into a teak forest to improve the land. Why was Gary whining and saying he was sold pasture land when he wanted farm land? That's why the government gives the tax credits. I'm also looking at their farms. Teak trees are sticks. That's probably why they grow so fast because they just grow straight up with no side branches which can't be used. These trees are indeed deciduous. Gary was indeed there during the dry season. Gary made it sound like Powers was lying and giving excuses when it doesn't appear that he was. More about teak here.

More about property sales in Costa Rica. Americans can own beach front property. Everyone just needs to make sure any property within two blocks of the beach has a special municipal lease. Gary was again talking out of his ass just like he did about education and Ben Franklin's patents.

Commissions are generally 3-10% for a regular home sale. There is no law about how much people can charge for a "commission." There are no licensed agents in the country. Anyone can be a real estate agent. Farm land with trees is very different than home sales. In Costa Rica you must add a 13% sales tax on the real estate agent commission which must be paid at close of escrow. Obviously if you had a real commission, the price would be even higher to the buyer. There is no capital gains tax in Costa Rica.

More interesting things. A real estate commission would have to have been included in the sales contract. All property sales must have a written contract so they can be recorded. That means Richard's commission, if there was one, would have been in the sales contracts. I doubt they were because there was no 6% agreement. They do not have MLS or standardized forms like we do here. Lawyers draft the agreements. If Gary really only wanted Powers to get 6%, he had to put it in the written contract which I assume his attorney drafted. Here's more. They offer title insurance. Gary could have bought title insurance. If you transfer title directly instead of transferring shares in a limitada, you have to pay more tax. Seems Powers was trying to save Gary or himself transfer tax. Here in Cali seller pays transfer tax. Gary is looking more ungrateful by the second. Gary is also looking like he did no due diligence whatsoever even though he had US and CR lawyers. The CR lawyer also spoke Spanish. Typical Gary. I saw him do the same with Ed Boks, pet kiosks, microchips..... In fact David Cohen took over in 2005 yet Gary continued to make "bad business deals" in 2006 and 2007. Gary is his own worst enemy. They say doctors are the worst investors and I agree.

Some information on price padding in Costa Rica, "the practice known as "price padding" or "net pricings." This is the common practice of adding an amount to the seller's asking price (normally at least 15% and sometimes 100% or even more) and pocketing the difference. (This is usually on top of the commission they charge the seller or in some cases the buyer) and it is perfectly legal to do so."

Here they are talking about people who do not improve the property, clean liens, remove squattors.... They do nothing to the property, never own it. They just tell the buyer the actual sale price is higher than it is. This is legal and very common in Costa Rica. In the US this would be difficult because of disclosure laws, the MLS, easy availability of public property searches... This is something Gary's Costa Rica lawyer would have been responsible for investigating. This is not what Powers did. Powers bought the land, cleared the title, removed squattors, probably had it surveyed, soils tested, legally described, plat map made.....then I think he sold it to Gary. This is an awful lot of work. No one would do all that for 6%, not even in the US where things are easier.

Gary Michelson criminal trial day two. Things start to heat up. Forbes billionaire crazy perjury

Gary Michelson criminal trial day two. Things are starting to get really good. The truth is just starting to come out. I will not reveal anything that could possibly help Gary's meritless, frivolous case. Today I will basically just post what transpired and what was said. Anyone is free to order the minutes from the court reporter. This is a public trial. I may have made mistakes here.Please, correct me if I did.

I got there at 10:40 a.m. hoping to miss the DA's slow and boring presentation of exhibits. I underestimated how long that would take. Robert Knowles was only at count, exhibit 19 when I got there. There are 50 counts.

I found out later many exhibits were not accepted by the judge. I also found out that Gary stated he had doubts about the transaction in 2004. Previously he said 2006.

DA Robert Knowles questioned Gary about count 19. We took a break then Gary changed his testimony. I can only assume this was after conferring with the DA in the hallway. Gary stated that he paid to reforest a property he did not legally own. Defendants objected as his response stated as if it were fact. Judge over ruled stating his statement would be received as merely Gary's perception of events, not facts.

Going through the counts Gary again was paying about  $1,000 an acre on most properties. I checked some comparables last night and sale prices are closer to $10,000/acre today with list prices even higher.

In Count 27 Gary said he had to give Richard Powers, power of attorney to transfer property to C&M Investments. C&M Investments is owned by Gary Michelson/Karlin Assets or something. Gary is the Manager of C&M Investments. Richard Powers has his own separate investment and holding companies.

Gary stated he retired in 2001. Previously he said he received faxes at his medical office and at home in 2002-2005. Obviously he did not receive faxes at his closed medical office if he retired in 2001.

What I did find odd today was that Gary brags online all the time how great he is doing in teak. In articles he said he did and is still doing very well. What's really odd is that Gary is bragging online in articles and in a website devoted to his private holding company. He acts as if he's a public investment company. That's like me making a website for my checking where I brag that I'm making .001% interest.

Lunch break.

DA Robert Knowles' presentation was monotonous, repetitive and was almost making me fall asleep. I realize this is an important part of any trial. I did the same with my own trial slowly methodically presenting exhibits to be hopefully accepted by the judge. Robert Knowles got lost quite a few times in the monotony.

Supposedly Pan American Wood (sp?) is the largest teak farmer in Costa Rica.

Counts 1 - 49 deal with land purchases. County 50 deals with maintenance costs. Gary contends the maintenance costs were inflated. These funds were to clear land of weeds, buy trees, plant trees, build roads, culverts. Gary paid in advance estimated maintenance costs.

Mr Muno is a lawyer for C & M Investments in Costa Rica. Bill Capps was a lawyer here in LA that would draft agreements between Neil and Gary. Steve Collette was his accountant. He was replaced by Fredelender. David Cohen became Gary's business manager in 2005. Gary said with a laugh and a smile "He would never let me do another business deal ever again. This was one deal which Cohen took over besides others."

Gary has frequently admitted that he's a shitty investor and business person. Gary has frequently admitted that he's been "taken advantage of" by others. Whether he was taken or advantage or not is to be seen. I will agree that Gary is a horrible judge of character. Gary paid the LA Mayor money to hire Ed Boks who was a total liar. Gary donated money to Daniel Guss who is a convicted criminal. I could go on and on.

Gary's relationship with Powers deteriorated after 2006. December 2006 there was to be a final resolution to the business deals. There was a conflict in that Powers did not supposedly turn over books and records in 2005. Oddly enough Gary was filing tax returns with records.

Supposedly Andreas Martin who worked for Pan American would take over C&M Investments and the day to day running of the farms. Gary decided to go to Costa Rica March 23 - 26, 2006 to view the farms. They got on a helicopter and Gary said the farms looked like "tooth pick farms." Obviously saplings, seedlings seen from a helicopter would look like a toothpick farm.

Gary said he didn't think 70% of the land was covered by trees which he said he was promised. Gary said he saw a rusty saw attached to a rusty VW engine which he was told was an expensive saw. Gary tends to really exaggerate. I've known him since 2005.

Gary admits that he was very angry at what he saw. Gary said that Powers said "I can't believe you are an ingrate. My blood, sweat and tears has made this property worth $80 million." Gary said he was told land was worth $30M and trees $50M. Gary said Neil and Powers were offended that Gary did not appreciate what they had done. Gary said they said the rusty saw was not the saw mill property.

Now to the conspiracy charge which is a new charged added last Saturday. I have no way to see the criminal complaints. Supposedly Neil defended Powers saying he, Neil sat through the negotiations. Land was bought at $1,000/acre and is now worth $1,600 acre for 60% return. Neil said he could sell them for $80M.

In May Andreas Martin took over. Martin asked for deeds. 43 deeds had not yet been transferred. Gary said Martin said the properties were in bad shape and could not be used to grow teak. Gary said that Powers said Martin was just bitter than he Powers accumulated such nice properties. I have noticed when a new person enters the field with Gary, Gary instantly turns on other people involved. Gary loved me until someone else wanted my job and they bad mouthed me. Then Gary lied about me and perjured himself in a false sworn statement.

The Judge ruled that these statements were not being admitted as facts. They were being admitted as what Gary thought was happening.

Gary then agreed to close on a few properties if Powers gave him the deeds and he did.

September 2007 Gary filed his first criminal complaint against Powers in Costa Rica. The case was dismissed. Gary refiled in March 2010 or it was reopened. Gary agreed he gave a factual statement to the Costa Rica DA.  Christina Cueros is the DA equivalent in Costa Rica. September 2007 Gary filed civil complaint against Powers in California. Later in 2008 Gary added Neil to the civil complaint. Gary did this after he spoke with Neil twice about something which came up in confidential mediation with Powers.  Powers sued Gary in Costa Rica. In that case it was stated that Neil supposedly shook down Powers for money. Neil demanded money and got $1.3M. Gary confronted Neil about this and supposedly Neil said "Powers took more than that."

The People's theory here is false representation and inducement. Gary stated that Neil "showed his consciousness of guilt." Neil supposedly said "the land was not farm land but cattle grazing. It was worthless" as it was stripped of its top soil. Neil said Powers lied and doubled the number of actual trees and maintenance costs.

Gary with a tear in his eye said and pointed at Neil "that was my best friend." Gary then supposedly told Neil "you should pay me back the money you took and testify against Powers." Neil went and spoke to an attorney. Then he supposedly said "I can't testify against Powers because I would incriminate myself. I will just keep the money." Lord only knows what was actually said. Gary tells so many stories.

Gary said at this time Neil told him he was the credit manager at a dealership near Dana Point where Neil lived.

The DA then asked Gary "If you knew Neil got money in the deal, would you have bought the properties?" Gary, "no."

DA, "did you believe Neil's motivation was to increase his share value in C&M?" Gary, "yes."

DA, "was Neil ever paid by C&M?" Gary, "no."

DA, "if you knew that Powers would make money off sales, would you have invested?" Gary, "no."

DA, "if you knew the maintenance costs would be inflated, would you have invested?" Gary, "no."

Obviously this would be stupid investing but the DA just wants to show there was fraudulent inducement because he knows he will not be able to show any evidence of any financial damages or actual fraud. If Powers got a piece of land for free or bought it for $1 then sold it to me for $1,000 when it was worth $10,000, I'd be happy as hell. I would not be pissed at him for making $999 when I just made $9,000. I'm not an idiot, or a liar unlike Gary. Gary really is a stupid business person. He should stick to stealing people's inventions and being a patent troll. It's what he's best at, really.

3:40 p.m. and finally Walter Urban gets to cross examine Gary. Urban has a hearing issue and did not hear the Judge talk a couple of times. He also has problems hearing me. I don't think the Judge realized this and thought Urban intentionally spoke over him when he didn't.

Urban asked Gary if he wrote a written statement  and gave an oral statement in this criminal complaint. Gary got confused and it took a while for him to answer. Gary also instantly was defiant and on the defensive. First Gary says "I don't recall." Up to this point Gary is proud to tell the Judge and DA that he has an excellent memory. He even shows off by naming certain rare types of trees and specific details here and there. Based on what I know Gary has as "selective" memory. Gary most certainly lied about things which transpired between him and me.

Back to testimony, Urban asked if Gary knew his interview with the Costa Rica DA was under oath and recorded. Gary finally said yes. He read the transcript and signed it. Then Gary blurts out (my criminal complaint) "was improperly dismissed by someone who got bribed." The Judge struck that statement (my spell check keeps changing the word to "stroked.")

Gary then admitted that Powers sued Gary in Costa Rica. They were in mediation. That mediation was confidential. After that mediation is when Gary spoke to Neil about what was said in that confidential mediation. Gary gets nervous and defensive.

Urban asks Gary if he ever got an appraisal of his properties. Did you ever get an appraisal of $80M? Gary says "no." Gary then says that Neil and Powers told him the property was worth $80M. Gary then said he told Powers "if it's worth $80M, sell it for $60M and keep the $20M then we can call go home." My eyes almost rolled out of my eye sockets onto the floor when he said this. If Gary thinks someone else is making one penny in a deal, he will spend $100M in legal fees to get that one penny. He is that crazy. Gary's words will be very important tomorrow. I've read the civil doc and have seen the agreements and such.

Urban asks "in the civil complaint against Powers, Neil, did you ever give a value for the property?" Gary "maybe $30M." Then he adds "there was such gross fraud. None of it was true." The Judge struck that statement.

Gary states he never heard the taped conversation he had with the DA's investigator Villasenor. Urban asks Gary if he knew he was being recorded by Villasenor. Gary says "no." He adds that he also never heard the tapes. Urban asked if Gary asked the DA if the confidentiality agreement in mediation would hold up in a criminal complaint? Gary was told that it would not hold up in a criminal complaint, only a civil complaint. Therefore what was said in mediation would be admissible.

They then stopped cross examination on that item so they could clarify things. They went on to the next item and will return to that in the morning.

Urban asked if Gary originally relied on Neil in making land purchase decisions. Gary said no, not originally but he did later.  Gary again said if he knew the prices were inflated, he would have never bought the property.

Urban asked him if he looked at any other land for sale by other people. Gary said no.

Gary said he paid Powers $1,500/mo to manage property. Gary said the "agreement" with Powers was that if a property was listed for sale, the seller paid the 6% commission. If it was not listed for sale, then Powers could take a 6% commission and split with other people.

Urban asked if there was a written contract about the 6%? Gary said no but it was mentioned in letters. Gary puts all other contracts in writing except this one. Gary admits he had Costa Rican and US lawyers involved the entire time.

Gary then says out of the blue that Powers was the manager of C&M Investments. Urban then shows Gary the C&M Investment agreement. Urban shows that Gary is listed as the manager of C&M Investments. Someone by the name of I think Jeffeer Mangles may have written this agreement for Gary. The manager is listed as Gary Michelson/Karlin Asset Mgmt. Gary insists that Powers was the manager of C&M Investments in Costa Rica and Gary was just the managing partner of C&M Investments in California. Oy.

If you have read any docs in the California civil case you would have seen any agreements that did or did not exist which directly relate to this case. I almost feel sorry for Gary squirming on the witness stand, getting defensive but of course I don't. I very much look forward to tomorrow.

I may have made mistakes. It was tough keeping the facts let alone Gary's stories straight.

Gary Michelson was first witness on the stand. Gary admits he committed perjury!

Things got off to a late start at 1:30 p.m. All phones had to be turned completely off because they interfere with the sound system. Gary was the first and only witness today. He has to come back tomorrow.

I intentionally sat at the other end of the hall to be far away from Gary. Turns out Gary was hiding in the mens room for at least half an hour. He comes out right next to where I was sitting with an investigator from the DA's office.

Neil Campbell was finally brought into the court room. He looks at least ten years older than  a year ago with long greasy looking gray hair. He looks totally broken. I felt so bad for him. He was in blue jail garments handcuffed to the chair. Richard looked good after finally recuperating from his I'm sure horrible time in jail.

The DA amended their complaint on Saturday. They added conspiracy and dropped charges 50 to 140. I don't think they can add conspiracy at this late a date. I think they did it because they know they have no case against Richard Powers. Each count is one land sales transaction.

DA's opening statement was that Gary met Neil in 1999 and did business with him from about 2000 to 2006. DA states Gary bought the properties based on false information. The prices of the property and costs involved were inflated and defendants skimmed the excess. Neil supposedly managed Southbay Lexus. Gary bought the properties for about $1,000/acre. I just looked for comps. $1,000/acre is super cheap compared to these Costa Rica farm listings.

This is the big news. Gary previously stated there was a contract that Richard would only get 6% commission which Gary said is normal. Today Gary finally admitted there was never any contract. Gary again states 6% is normal for Costa Rica. No, it is not, not by a long shot. Even the DA for Costa Rica said this in writing. Today Gary said Richard was supposed to negotiate the best possible price at fair market value. Gary admitted he put all other agreements in writing. He would even modify old written agreements when things changed. But he doesn't put this 6% in an agreement or "fair market value" and "best possible price?" All real estate contracts must be in writing. That's the law in California where he claims jurisdiction. I could tell Gary was lying when he said this. He had all the known signs of lying. I won't mention them because he goes back on the witness stand tomorrow.

Gary admitted that he paid the price offered by Richard. He tried to say that Richard told him that is what it was worth. I couldn't read the letters that well.

Supposedly Neil had a contract with Gary. I haven't seen it yet. Gary was the GM and Neil was the AGM of C&M Investments.

Based on what I saw today Richard is innocent. He offered land to Gary and Gary bought it. There was no 6% commission agreement. I don't know if Neil is guilty of fraud or conspiracy. I think they added conspiracy in case the fraud charge against Richard is dropped.

Few more things. Gary said he didn't want any existing trees on the property cut down and no hunting. He said Neil wanted all trees cut down and teak planted. Gary kind of glared at Neil when he said that. I saw Gary's usual lying and childish behavior.

At the beginning of the hearing judge asked if Gary saw Neil in the audience. Gary stared at Neil for a while. Neil did look for shit and who can blame him. Finally Gary said yes. I looked at Gary then he'd look down or away. He wouldn't look me in the eye or else he couldn't see that well. I will sit closer tomorrow.

He graduated from Cornell University in 1971 and worked in New York City for a year before beginning law school.Judge Pastor attended U.S.C. Law School and graduated in 1975. He then handled criminal defense matters before and after passing the California Bar in 1975."
